European Communities (Avian Influenza) (Control on Imports of Avian Products and Live Birds from Several Third Countries) (Amendment) Regulations 2005

I, Mary Coughlan, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Decision 2005/692/EC1 of 6 October 2005, hereby make the following regulations -

1.     These Regulations may be cited as the European Communities (Avian Influenza) (Control on Imports of Avian Products and Live Birds from Several Third Countries) (Amendment) Regulations 2005.

2.     The European Communities (Avian Influenza) (Control on Imports of Avian Products and Live Birds from Several Third Countries) Regulations 2005 ( S.I No. 565 of 2005 ) are amended by -

(a)    the substitution, for the definition of “Commission Decision” in regulation 2(1), of-

“ ‘Commission Decision’ means Commission Decision 2005/692/EC'; ”,

(b)    the substitution, for the definition of “several third countries” in regulation 2(1) of-

“ ‘several third countries’ ” means Cambodia, Peoples Republic of China including Hong Kong, Indonesia Kazakhstan, Laos, Malaysia, Mongolia, North Korea Pakistan, Thailand, and Vietnam'; ”,

(c)    the insertion, after Regulation 7(2), of-

“(3)    Paragraph (1) does not apply to the import of unprocessed feathers and parts of feathers from Mongolia”.

This Order amends S.I No 565 of 2005 and gives effect to Commission Decision 2005/692/EC of 6 October 2005 concerning certain protective measures in relation to avian influenza in several third countries.
