Tallaght Hospital Board (Establishment) Order, 1980 (Amendment) Order, 2005

TALLAGHT HOSPITAL BOARD (ESTABLISHMENT) ORDER, 1980 (AMENDMENT) ORDER, 2005.

The Minister for Health and Children, in exercise of the powers conferred on her by sections 3, 4, 5 and 6 of the Health (Corporate Bodies) Act, 1961 (No. 27 of 1961), as amended by Section 22 of the Health (Amendment) (No. 3) Act, 1996 ( No. 32 of 1996 ) and adapted by the Health (Alteration of Name of Department and Title of Minister) Order 1997 ( S.I. No. 308 of 1997 ) hereby orders as follows:-

1. This Order may be cited as the Tallaght Hospital Board (Establishment) Order 1980 (Amendment) Order, 2005.

2. In this Order:-

“the Establishment Order” means the Tallaght Hospital Board (Establishment Order, 1980 ( S.I. No 38 of 1980 );

“the Order of 1982” means the Tallaght Hospital Board (Establishment Order, 1980 (Amendment) Order 1982 ( S.I. No 313 of 1982 );

“the Order of 1984” means Tallaght Hospital Board (Establishment) Order 1980 (Amendment) Order 1984 ( S.I. No 162 of 1984 );

3. The Establishment Order is hereby amended:

(a) by the deletion in Article 4 of paragraph (b) and paragraph (c)

(b) by the substitution for Article 5 (as amended by Article 2 (a) of the Order of 1982 and as amended by Article 2 (a) of the Order of 1984) of the following Article:-

“The Board shall consist of eight members who shall be appointed by the Minister.”

(c) by the substitution for Article 6 (as amended by article 2 (b) of the Order of 1984), of the following Article:-

“The term of office of a member of the Board shall unless he or she sooner dies, resigns or ceases to be a member under Article 9 of this Order, terminate on the 31^st December 2005.”

(d) by the substitution for Article 7 (as amended by article 2 (c) of the Order of 1984), of the following Article:-

“7. In the event of a casual vacancy arising through the death, resignation or cessation of membership under article 9 of this Order, of a member of the Board the vacancy shall be filled by appointment by the Minister for the unexpired period of the term of office of the said member.”

(e) by the substitution for Article 9 (as amended by article 2 (d) of the Order of 1984), of the following Article:-

“A member shall cease to be a member of the Board on his being requested by the Minister to resign.”

(f) by the substitution for Article 10 of the following Article :-

“The Minister shall appoint one of the members of the Board to be Chairman of the Board”

(g) by the substitution for Article 11 (as amended by Article 2 (b) of the Order of 1982 and as amended by Article 2 (e) of the Order of 1984) of the following Article:-

“The quorum of the Board shall be four.”

EXPLANATORY NOTE.

The effect of this Order is to restructure the Tallaght Hospital Board providing for a Board of eight members appointed directly by the Minister, one of whom shall be appointed to be the Chairman of the Board.
