European Communities (Protein Feedingstuffs) (Amendment) Regulations 2005

I, Mary Coughlan, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 ( No. 27 of 1972 ) for the purpose of giving effect to Commission Directive 90/439/EEC of 24 July 19901 and Commission Directive 2004/116/EC of 23 December 20042 , hereby make the following regulations-

1.   (1)  These Regulations may be cited as the European Communities (Protein Feedingstuffs) (Amendment) Regulations 2005

(2)    The European Communities (Protein Feedingstuffs) Regulations 2004 and these Regulations may be cited collectively as the European Communities (Protein Feedingstuffs) Regulations 2004 to 2005

2.   The European Communities (Protein Feedingstuffs) Regulations 2004 are amended -

(a) in Regulation 2 (1), by substituting for the definition of “Directive” the following:

““Directive” means Council Directive 82/471/EEC of 30 June 19823 as amended by Commission Directive 84/443/EEC of 26 July 19844 Commission Directive 85/509/EEC of 6 November 19855 , Commission Directive 86/530/EEC of 28 October 19866 , Commission Directive 90/439/EEC of 24 July 1990, Council Directive 90/654/EEC of 4 December 19907 , Commission Directive 93/56/EEC of 29 June 19938 , Council Directive 93/74/EEC of 13 September 19939 , Commission Directive 95/33/EC of 10 July 199510 , Council Directive 95/69/EC of 22 December 199511 , Council Directive 96/25/EC of 29 April 199612 , Directive 2000/16/EC of the European Parliament and of the Council of 10 April 200013 , Council Directive 1999/20/EC of 22 March 199914 , and Commission Directive 2004/116/EC of 23 December 2004;”

(b)   by substituting for Regulation 6(2) the following:

“6 (2) An authorised officer shall not enter, other than with the consent of the occupier, a private dwelling, unless he or she has obtained a search warrant under Regulation 7 other than if he or she has reasonable cause to suspect that before a search warrant could be sought in relation to the dwelling, anything to which paragraph (1) relates is being or is likely to be destroyed or disposed.”

Explanatory Note

These Regulations give effect to the provisions of Commission Directive 90/439/EEC of 24 July 1990 and Commission Directive 2004/116/EC of 23 December 2004 which amends the annex to Council Directive 82/471/EEC on bioproteins in feedingstuffs.
