I, MARTIN CULLEN, Minister for Transport, in exercise of the powers conferred on me by section 1(2) of the Road Traffic Act 2004 (No. 44 of 2004), hereby order as follows:

1. This Order may be cited as the Road Traffic Act 2004 (Commencement) (Parts 3 and 4) Order 2005.

2. The day fixed, on which Parts 3 and 4 (save in so far as it is already in operation) of the Road Traffic Act 2004 (No. 44 of 2004) come into operation, is 24 January 2005.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order brings into operation, on 24 January 2005, Part 3 and Part 4 (remaining provisions) of the Road Traffic Act 2004 (No. 44). The provisions in Part 3 support the operation of the fixed charge and penalty points systems:— Garda Síochána may outsource administrative functions; new provisions include identification of who is deemed to be the driver of a vehicle where registered owner is not an individual; offence by a corporate body; requirement to produce driving licence in court; offence of driving without reasonable consideration is scheduled within the fixed charge and penalty points systems.

Part 4 includes creation of new offence to supply a mechanically propelled vehicle to minors; new offence and powers of inspection for Garda Síochána and traffic warden for certain permits; new offence and power for Garda Síochána to request production of driving licence subsequent to commission of road traffic offence; definition of a ‘local authority’ for bye-laws in relation to taxi stands.
