DISEASES OF ANIMALS ACT 1966 (BLUETONGUE) (RESTRICTION ON IMPORTS FROM SPAIN) ORDER 2004.

I, MARY COUGHLAN, Minister for Agriculture and Food, in exercise of the powers conferred on me by sections 3 and 30 of the Diseases of Animals Act 1966 (No. 6 of 1966) (as adapted by the Agriculture, Food and Rural Development (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 306 of 2002 )), for the purpose of giving effect to Commission Decision 2004/697/EC of 14 October 2004¹ , hereby order as follows—

1. This Order may be cited as the Diseases of Animals Act 1966 (Bluetongue) (Restriction on Imports from Spain) Order 2004.

2.  (1)  In this Order—

“animal” means an animal of a species susceptible to bluetongue;

“Commission Decision” means Commission Decision No. 2204/697/EC of 14 October 2004 on certain protective measures relating to bluetongue in Spain;

“restricted area” means the provinces of Cadiz, Malaga and Seville, the district of La Palma del Condado and Ayamonte in the province of Huelva, the districts of Lucena, Montilla and Posada in the province of Cordoba and the districts of Alhama, Granada and Loja in the province of Granada.

(2) A reference to an Article is to an Article of this Order unless it is indicated that reference to some other provision is intended and a reference to a paragraph is to a paragraph of the provision in which the reference occurs, unless it is indicated that reference to some other provision is intended.

3. (1) A person shall not import an animal, its semen or the ova or embryos of an animal from the restricted area.

(2)  A person shall not have in his or her possession or under his or her control, sell or supply an animal, its semen or the ova or embryos of an animal that have been imported in contravention of paragraph (1).

This Order gives effect to Commission Decision No. 2004/697/EC of 14 October 2004, concerning restrictions on the importation of live animals, semen and the ova or embryos of species susceptible to bluetongue, from specified regions in Spain, due to the outbreak of bluetongue in that country.
