I, BRIAN LENIHAN, Minister of State at the Department of Health and Children, in exercise of the powers conferred on me by Section 1 (2) of the Child Care Act 1991 (No. 17 of 1991) (as adapted by the Health (Alteration of Name of Department and Title of Minister) Order 1997 ( S.I. No. 308 of 1997 )) and the Health and Children (Delegation of Ministerial Functions) Order 2003 ( S.I. No. 474 of 2003 ), hereby order as follows:

1.  This Order may be cited as the Child Care Act of 1991 (Commencement) Order 2004.

2.  (1)  The 23rd day of September 2004 is fixed as the day on which Section 79 of, and the schedule to, the Child Care Act 1991 (No. 17 of 1991) come into operation, in so far as they relate to the unrepealed provisions specified in the third column of the Schedule thereto, of the enactments specified in the second column of that Schedule.

(2)  In paragraph (1) of this Article, “unrepealed provisions” does not include section 119 of the Children Act 1908 (8 Edw. 7, c.67) and section 31 (2) of the Adoption Act 1952 (No. 25 of 1952).

This order provides for the repeal of a number of redundant legal provisions in the Children Act 1908 and a number of other enactments including provisions relating to private foster care.
