COMPANIES (AMENDMENT) ACT 1982 (SECTION 13(2)) ORDER 2004.

I, MARY HARNEY, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 13(2) (as amended by section 55 of the Companies (Auditing and Accounting) Act 2003 (No. 44 of 2003)) of the Companies (Amendment) Act 1982 (No. 10 of 1982), hereby order as follows:

1.  This Order may be cited as the Companies (Amendment) Act 1982 (Section 13(2)) Order 2004.

2.  It is hereby declared that the provisions of section 376 of the Companies Act 1963 (No. 33 of 1963) (prohibition of partnerships with more than 20 members) shall not apply to the formation of a limited partnership registered under the Limited Partnerships Act 1907 (7 Edw. 7 c.24) consisting of not more than 50 partners which is formed for the purpose of, and whose main business consists of, the provision of investment and loan finance and ancillary facilities and services to persons engaged in industrial or commercial activities.

EXPLANATORY NOTE.

The purpose of this Order is to allow limited partnerships registered under the Limited Partnerships Act 1907 to have up to 50 partners where such partnerships are formed for the purpose of, and whose main business consists of, the provision of investment and loan finance and ancillary facilities and services to persons engaged in industrial or commercial activities.
