S.I. No. 6/2002 - Diseases of Animals Act 1966 (Foot-And-Mouth Disease) (Restriction on Imports From The United Kingdom) (No. 3) Order 2001 (Amendment) Order 2002
I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by sections 3 and 30 of the Diseases of Animals Act 1966 (No. 6 of 1966) (as adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order 1999 ( S.I. No. 307 of 1999 )), and for the purpose of giving effect to the Commission Decision 2001/740/EC of 19 October 20011 as amended by Commission Decision 2001/763/EC of 30 October 20012 , Commission Decision 2001/ 789/EC of 12 November 20013 , Commission Decision 2001/848/EC of 30 November 20014 Commission Decision 2001/911/EC of 19 December 20015 and Commission Decision 2001/938 of 28 December 20016 , hereby order as follows:- 1. This Order may be cited as the Diseases of Animals Act 1966 (Foot-and-Mouth Disease) (Restriction on Imports from the United Kingdom (No. 3) Order 2001 (Amendment) Order 2002. 2. The Diseases of Animals Act 1966 (Foot-and-Mouth Disease (Restriction on Imports from the United Kingdom) (No. 3) Order 2001 ( S.I. No. 470 of 2001 ) is amended by — | ||||||||
(a) the substitution, in Article 2(1), for the definition of “Commission Decision” (inserted by Article 2(a) of the Diseases of Animals Act 1966 (Foot-and-Mouth Disease) (Restriction on Imports from the United Kingdom) (No. 3) (Amendment) Order 2001 ( S.I. No. 555 of 2001 )) of — | ||||||||
“‘Commission Decision’ means Commission Decision 2001/740/EC of 19 October20011 as amended by Commission Decision 2001/763/EC of 30 October 20012 Commission Decision 2001/ 789/EC of 12 November 20013 , Commission Decision 2001/848/EC of 30 November 20014 Commission Decision 2001/911/EC of 19 December 20015 and Commission Decision 2001/938 of 28 December 20016 .”, | ||||||||
(b) the substitution, for paragraph (2) of Article 3, of- | ||||||||
“(2) Subject to paragraphs (3) and (4), a person may import an animal to which paragraph (1) refers that complies with Article 3 of the Commission Decision and that has originated in the area of limited restriction or outside the United Kingdom if the animal travelled through the United Kingdom in direct and uninterrupted transit on main roads or by rail.”, | ||||||||
(c) the substitution, in Article 3, for “Commission Decision 2001/172/EC of 1 March 2001”, in each place where it occurs, of “Commission Decision 2001/740/EC of 19 October 2001”, | ||||||||
(d) the insertion, after paragraph (6) of Article 3, of — | ||||||||
“(7) A person shall not move or cause or permit another person to move an animal (including an animal imported in accordance with this Article) from a premises (within the State) on which an animal imported in accordance with this Article is present, for a period of at least thirty days after the arrival of the second mentioned animal.”, and | ||||||||
(e) the insertion, in paragraph 6 of Article 13 (inserted by Article 2(g) of the Diseases of Animals Act 1966 (Foot-and- Mouth Disease) (Restriction on Imports from the United Kingdom) (No. 3) (Amendment Order 2001 ( S.I. No. 555 of 2001 )), after “Decision” of “and the certificate will accompany the vehicle”. | ||||||||
