DISTRICT COURT DISTRICTS AND AREAS (SECTION 26) (NO. 6) ORDER, 1997.

I, NORA OWEN, Minister for Justice, in exercise of the powers conferred on me by section 26 of the Courts of Justice Act, 1953 (No. 32 of 1953), as amended by section 43 of the Courts (Supplemental Provisions) Act, 1961 (No. 39 of 1961), and by section 16 of the Courts Act, 1971 (No. 36 of 1971), and after consultation with the President of the District Court, hereby order as follows:

1. (1) This Order may be cited as the District Court Districts and Areas (Section 26) (No. 6) Order, 1997.

(2) This Order shall come into operation on the 13th day of January, 1997.

2. The First Schedule to the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ), is hereby amended by—

( a ) the deletion of the matter in columns (2), (3), (4) and (5) at reference numbers 203 and 204,

( b ) the substitution for the matter in column (5) at reference number 207 of the following:

"the area comprising—

( a ) the District Electoral Divisions of Ballycommon, Cappancur, Derrycooley, Durrow, Killeigh, Rahan, Rathrobin, Screggan, Silverbrook, Tinnycross, Tullamore Rural, Tullamore Urban, Ballaghassaan, Croghan, Daingean, Esker, Geashill, Kilclonfert, Mountbriscoe, Rathfeston, Ballyburly, Ballymacwilliam, Clonbulloge, Clonmore, Edenderry Rural, Edenderry Urban, Knockdrin and Monasteroris in the county of Offaly,

( b ) the District Electoral Divisions of Carbury, Carrick, Kilpatrick, Kilrainy and Windmill Cross in the county of Kildare, and.

( c ) the District Electoral Division of Castle-jordan in the county of Meath.",

and

( c ) the substitution for the matter in column (4) at reference number 207 of the following:

"Tullamore—

 First and Third Wednesday in each month at 11 a.m.

 First Thursday in February, April, June, October and December at 11 a.m.

 Third Wednesday in September at 3 p.m. for the business of the Annual Licensing District Court.

 Second Tuesday in each month at 11 a.m.".

3. The Second Schedule to the District Court (Areas) Order, 1961, is hereby amended by—

( a ) the deletion of the matter in columns (2), (3), (4) and (5) at reference numbers 173 and 174,

( b ) the substitution for the matter in column (5) at reference number 177 of the following:

"the area comprising—

( a ) the District Electoral Divisions of Ballycommon, Cappancur, Derrycooley, Durrow, Killeigh, Rahan, Rathrobin, Screggan, Silverbrook, Tinnycross, Tullamore Rural, Tullamore Urban, Ballaghassaan, Croghan, Daingean, Esker, Geashill, Kilclonfert, Mountbriscoe, Rathfeston, Ballyburly, Ballymacwilliam, Clonbulloge, Clonmore, Edenderry Rural, Edenderry Urban, Knockdrin and Monasteroris in the county of Offaly,

"Tullamore—

First and third Wednesday in each month at 11 a.m.

First Thursday in February, April, June, October and December at 11 a.m.

Second Tuesday in each month at 11 a.m.".

4. ( a ) The Schedule to the District Court Areas (Amendment) Order, 1970 ( S.I. No. 161 of 1970 ), is hereby amended in column 4 at reference number 9 by the deletion of—

(i) "Daingean and Edenderry", and

(ii) "203 and 204",

5. Business transacted in the District Court which is initiated and not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business had been initiated.

EXPLANATORY NOTE.

This Order provides for the abolition of the District Court Areas of Daingean and Edenderry and the amalgamation of the District Electoral Divisions which comprised that Area with the District Court Area of Tullamore.
