COMPANIES (STOCK EXCHANGE) REGULATIONS, 1995.

I, PAT RABBITTE, Minister of State at the Department of Enterprise and Employment, in exercise of the power conferred on me by section 2 of the Companies Act, 1963 (No. 33 of 1963) as amended by section 3 (2) of the Companies Act, 1990 (No. 33 of 1990), and the Enterprise and Employment (Delegation of Ministerial Functions) Order, 1995 ( S.I. No. 42 of 1995 ), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Companies (Stock Exchange) Regulations, 1995.

(2) These Regulations shall come into operation on the 9th day of December 1995.

2. In these regulations "the Irish Stock Exchange" has the meaning given to it by section 3 (1) of the Stock Exchange Act, 1995 (No. 9 of 1995).

3. The Irish Stock Exchange is hereby prescribed as a recognised stock exchange for the purposes of the following provisions of the Companies Acts—

(a) sections 44, 45, 361 and 362 of, and paragraph 28 of the Sixth Schedule to, the Companies Act, 1963 (No. 33 of 1963).

(b) section 1 of the Companies (Amendment) Act, 1977 (No. 31 of 1977).

(c) sections 65, 66, 78, 90 to 96, 107, 112, 115, 116, 117, 118, 120, 212, 229 and 230 of the Companies Act, 1990 (No. 33 of 1990).

4. The Companies (Stock Exchange) Regulations, 1990 ( S.I. No. 337 of 1990 ), are hereby revoked.

EXPLANATORY NOTE.

These Regulations prescribe the Irish Stock Exchange for the purposes of the provisions listed in the Regulations and revoke the Companies (Stock Exchange) Regulations, 1990 ( S.I. No. 337 of 1990 ).
