ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF KILKENNY) REGULATIONS, 1994.

The Minister for the Environment in exercise of the powers conferred on him by section 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Kilkenny) Regulations, 1994.

2 Commencement

2. These Regulations shall come into operation on the 16th day of May, 1994.

3 Interpretation

3. In these Regulations save where the context otherwise requires "the Act" means the Road Traffic Act, 1961 ;

"built-up area speed limit" and "special speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road;

"National Road" means a road declared to be a National Road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such road shall be a reference to the number of such road as shown in column 1 of the First Schedule or column 1 of the Second Schedule to the aforementioned Order;

"road" means a public road;

4 Built-up area speed limit

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation

7. The Road Traffic (Speed Limits) (County of Kilkenny) Regulations, 1988 ( S.I. No. 271 of 1988 ) are hereby revoked.

FIRST SCHEDULE

Roads declared not to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following roads in the town of Callan:—

( a ) Lower Haggardsgreen, The Ballywalter Road.

( b ) The Kilkenny Road (National Road N76) for a distance of 46 metres from the town boundary.

( c ) The Minnauns Road for a distance of 489 metres from the town boundary.

( d ) The Coolagh Road between the town boundary and a point 92 metres south-east of its junction with the Clonmel Road (National Road N76).

( e ) The Clonmel Road (National Road N76) between the town boundary and a point 83 metres south-west of its junction with the Coolagh Road.

( f ) The Carrabine Bridge Road for a distance of 128 metres from the point where the town boundary intersects the northern side of the road.

( g ) The laneway leading from the Carrabine Bridge road to the King's River.

( h ) Flaggy Lane between its junction with Upper Haggardsgreen and a point 28 metres west of its junction with Lower Bridge Street.

( i ) Upper Haggardsgreen between its junction with the Ballywalter Road and a point 10 metres west of its junction with the Kilkenny Road (National Road N76).

SECOND SCHEDULE

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Ballyhale:—

( a ) The Carlow-Waterford road (National Road N9) between a point 26 metres south of its junction with the Station Road and a point 350 metres south of its junction with the Coolmore Road.

( b ) The Coolmore Road for a distance of 46 metres south west of its junction with the Carlow-Waterford road (National Road N9).

2. The following roads at Ballyragget:—

( a ) The Square, The Fair Green.

( b ) Castle Street and its continuation as the Kilkenny Road (National Road N77) for a distance of 875 metres from the junction of Castle Street with the Square.

( c ) High Street and its continuation as the Castlecomer Road (National Road N77) for a distance of 366 metres from the junction of High Street with Patrick Street.

( d ) Patrick Street and its continuation as Smith's Road for a distance of 120 metres from the junction of Patrick Street with High Street.

( e ) Moat Street and its continuation as the Moatpark Road between the junction of Moat Street with the Square and a point 128 metres north of the junction of the Moatpark Road with the Fair Green.

( f ) Bridge Street for a distance of 270 metres from its junction with the Square.

3. The following roads at Bennettsbridge:—

( a ) The Ring, Marian Terrace.

( b ) The Thomastown-Kilkenny road between a point 326 metres south-east of its junction with the road to Ring and a point 265 metres north of its junction with the Annamult Road.

( c ) The Gowran Road for a distance of 605 metres from its junction with the Kilkenny-Thomastown road.

( d ) The Maddockstown Road for a distance of 440 metres from its junction with the Gowran Road.

( e ) The Link Road between the Maddockstown Road and the Gowran Road.

( f ) The Annamult Road for a distance of 125 metres from its junction with the Kilkenny Road.

( g ) The Danesfort Road for a distance of 65 metres from its junction with the Annamult Road.

( h ) The Tullaherin Road for a distance of 290 metres from its junction with the Thomastown Road.

4. The following road adjacent to the town of Callan:—

The Dunnamaggan Road for a distance of 137 metres from the point where the town boundary intersects the north-eastern side of the road.

5. The following roads at Castlecomer:—

( a ) Market Lane, Market Square, Mill Lane, The Glebe, Love Lane, Maryville Housing Scheme Roads, Hospital Lane, Donaguille Road, Chatsworth Row, Hillside View Housing Estate Road.

( b ) The Kilkenny-Dublin road (National Road N78) between a point 110 metres south of its junction with Hospital Lane and a point 480 metres east of its junction with Barrack Street.

( c ) Barrack Street and its continuation as the Ballyragget Road between the junction of Barrack Street with the Kilkenny-Dublin road (National Road N78) and a point 183 metres north-west of the junction of the Ballyragget Road with Love Lane.

( d ) The Old Road between its junction with the Ballyragget Road and a point 20 metres west of its western junction with the Glebe.

( e ) The Clogh Road for a distance of 21 metres from its junction with the Skehana Road.

( f ) The Skehana Road for a distance of 140 metres from its junction with Chatsworth Row.

( g ) The Prince Road for a distance of 70 metres from its junction with Chatsworth Row.

6. The following roads at Clogh:—

( a ) The Abbeyleix-Castlecomer road between a point 1,235 metres north of its junction with the Cloneen Road and a point 275 metres south of the said junction.

( b ) The Clooneen Road for a distance of 78 metres from its junction with the Abbeyleix-Castlecomer road.

( c ) The Chatsworth Housing Scheme Roads.

7. The following roads at Dunnamaggan:—

( a ) The Callan-Knocktopher road between a point 110 metres north-west of its junction with the Raheen Road and a point 735 metres south-east of the said junction.

( b ) The Raheen Road for a distance of 35 metres from its junction with the Callan-Knocktopher road.

8. The following roads at Fiddown:—

( a ) The Waterford-Carrick-on-Suir road (National Road N24) between a point 72 metres south of its junction with the Strand Road and a point 430 metres north-west of its junction with the Rathmore Road.

( b ) The Rathmore Road for a distance of 295 metres from its junction with the Waterford-Carrick-on-Suir road (National Road N24).

9. The following roads at Freshford:—

( a ) The Square.

( b ) The Kilkenny-Thurles road between a point 115 metres south-east of its junction with the Clintstown Road and a point 211 metres west of its junction with Bohergloss Street.

( c ) The Clintstown Road for a distance of 37 metres from its junction with the Kilkenny-Thurles road.

( d ) The Moat Road for a distance of 95 metres from its junction with the Uppercourt Road.

( e ) Chapel Street and its continuation as the Uppercourt Road for a distance of 256 metres from the junction of Chapel Street with the Kilkenny-Thurles road.

10. The following road at Galmoy:—

The Moneynamuck-Rathreagh road between a point 517 metres north-west of Moneynamuck Cross Roads and a point 977 metres north-west of the said crossroads.

11. The following roads at Gathabawn:—

( a ) The Foyle Bridge-Beggar Cross road between a point 270 metres north-west of its junction with the Foyle North Road and a point 220 metres south-east of the said junction.

( b ) The Foyle North Road for a distance of 90 metres from its junction with the Foyle Bridge-Beggar Cross road.

( c ) The Ballylehaun Road for a distance of 88 metres from its junction with the Foyle Bridge-Beggar Cross road.

12. The following roads at Glenmore:—

( a ) The Robinstown-Jamestown road between a point 580 metres south-west of its junction with the Graiguenakill Road and a point 220 metres north-east of the said junction.

( b ) The Graiguenakill Road for a distance of 90 metres from its junction with the Robinstown-Jamestown road.

( c ) The Creamery Road for a distance of 240 metres from its junction with the Robinstown-Jamestown road.

( a ) Chapel Street, Cluain Mhuire Road.

14. The following roads at Gowran:—

All roads in the area enclosed by a line commencing at a point on the Carlow Road 336 metres north of its junction with the Thomastown Road and drawn thence in straight lines successively to the following points:—

( a ) The northwesternmost point of the Fairview Cottages Road,

( b ) a point on the Killeen Road 86 metres north of its junction with the Fairview Cottages Road,

( c ) a point on the Ullard Road 348 metres north-east of its junction with Barrow Lane,

( d ) the easternmost point of the Quay,

( e ) the centre point of Graiguenamanagh Bridge,

( f ) a point on the New Ross Road 180 metres south of its junction with the Inistioge Road,

( g ) a point on the Inistioge Road 51 metres west of its junction with the New Ross Road,

17. The following roads at Inistioge:—

( a ) Hatchery Lane, The Square.

( b ) The Thomastown-New Ross road between a point 320 metres north of its junction with the Killeen Road and a point 70 metres east of its junction with the Graiguenamanagh Road.

( c ) The Killeen Road for a distance of 340 metres from its junction with the Thomastown-New Ross road.

( d ) The Ballyduff road for a distance of 275 metres from its junction with the Killeen Road.

18. The following roads at Johnstown:—

( a ) The Dublin-Cork road (National Road N8) between a point 700 metres north-east of its junction with the Freshford-Templemore road and a point 220 metres south west of the said junction.

( b ) The Freshford-Templemore road between a point 470 metres north west of its junction with the Dublin-Cork road (National Road N8) and a point 403 metres south east of the said junction.

( c ) The Rathdowney Road for a distance of 10 metres north-west of its junction with the Templemore Road.

19. The following roads at Kells:—

( a ) The Kilkenny-Kilmoganny road between a point 25 metres north-west of its junction with the Ennisnag Road and a point 377 metres west of its junction with the Stoneyford Road.

( b ) The Haggard Road for a distance of 135 metres south of its junction with the Kilkenny-Kilmoganny road.

( b ) a point on the Graiguenamanagh Road 183 metres north-east of its junction with the Inistioge Road,

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following roads at Boherboy and Paulstown:—

( a ) The Carlow Road (National Road N9) for a distance of 770 metres from its junction with the Kellymount Road.

( b ) The Kilkenny Road (National Road N10) for a distance of 225 metres from its junction with the Kellymount Road.

( c ) The Waterford Road (National Road N9) for a distance of 515 metres from its junction with the Kilkenny Road (National Road N10).

( d ) The Goresbridge Road for a distance of 670 metres east of its junction with the Waterford Road (National Road N9).

( e ) The Kellymount Road for a distance of 40 metres from its junction with the Kilkenny Road (National Road N10).

2. The following roads in and adjacent to the town of Callan:—

( a ) The Clonmel Road (National Road N76) between a point 83 metres south-west of its junction with the Coolagh Road and a point 320 metres south-west of the said junction.

( b ) The Kilkenny Road (National Road N76) between a point 385 metres north-east of the town boundary and a point 46 metres south-west of the said boundary.

3. The following roads at Castlecomer:—

( a ) The Kilkenny Road (National Road N78) between a point 110 metres south of its junction with Hospital Lane and a point 5 metres north of its junction with Ward's Lane.

( b ) The Dublin Road (National Road N78) between a point 480 metres east of its junction with Barrack Street and a point 1,345 metres east of the said junction.

4. The following roads at Dungarvan:—

( a ) The Waterford-Carlow road (National Road N9) between a point 80 metres north-west of its junction with the Bramblestown Road and a point 205 metres south-west of the said junction.

( b ) The Bramblestown Road between its junction with the Waterford-Carlow road (National Road N9) and a point 25 metres north-east of its junction with the Coppanagh Road.

( c ) The Coppanagh Road for a distance of 25 metres from its junction with the Bramblestown Road.

5. The following road at Graiguenamanagh:

The New Ross Road between a point 180 metres south of its junction with the Inistioge Road and a point 545 metres south of the said junction.

6. The following roads at Johnstown:—

( a ) The Cork Road (National Road N8) between a point 220 metres south-west of its junction with the Freshford-Templemore Road and a point 700 metres south-west of the said junction.

( b ) The Rathdowney Road between a point 10 metres north west of its junction with the Templemore Road and a point 395 metres north-west of the said junction.

7. The following roads in and adjacent to the Borough of Kilkenny:—

( a ) The Clonmel Road (National Road N76) between a point 15 metres east of its junction with the Ring Road and a point 275 metres west of the said junction.

( b ) The Carlow Road (National Road N10) between a point 979 metres south-east of the borough boundary and a point 1350 metres south-east of the said boundary.

8. The following road adjacent to the Urban District of New Ross:—

The Waterford Road (National Road N25) for a distance of 460 metres from the urban district boundary.

9. The following roads at the Rower:—

( a ) The Graiguenamanagh-New Ross road between a point 275 metres south-west of its junction with the Old New Ross Road and a point 275 metres north of the said junction.

( b ) The Inistioge Road for a distance of 20 metres from its junction with the Graiguenamanagh-New Road.

( c ) The Ballynunry Road for a distance of 37 metres from its junction with the Graiguenamanagh-New Ross road.

( d ) The Old New Ross Road for a distance of 20 metres from its junction with the Graiguenamanagh-New Ross road.

10. The following roads at Thomastown:—

( a ) The Carlow Road (National Road N9) between a point 137 metres north of its junction with Newtown Terrace and a point 605 metres north of the said junction.

( b ) The Ballyhale Road (National Road N9) between a point 183 metres south-west of its junction with the Creamery Road and a point 760 metres south-west of the said junction.

11. The following roads at Urlingford:—

( a ) The Dublin-Cork road (National Road N8) between a point 230 metres south-west of its junction with the Killenaule or Gortnahoe Road and a point 375 metres south-west of the said junction.

( b ) The Dublin-Cork road (National Road N8) between a point 92 metres north-east of its junction with the Kilkenny Road and a point 192 metres north-east of the said junction.

12. The following roads adjacent to the County Borough of Waterford:—

( a ) The Dublin Road (National Road N9) between a point 55 metres west of the point where the county borough boundary intersects the northern side of the road and a point 343 metres north of its junction with the Newrath Road.

( b ) The Slieverue Road between a point 183 metres north-east of the point where the county borough boundary intersects the south-eastern side of the road and a point 425 metres south-west of the junction of the Kilmacow Road with the Old New Ross-Waterford road at Slieverue.

( c ) The Abbey Road between a point 101 metres from the county borough boundary and a point 1,735 metres from the said boundary.

( d ) The Slieverue By-Pass between a point 1,120 metres north-east of the point where the county borough boundary intersects the south-eastern side of the road and a point 1,141 metres from the said boundary.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County of Kilkenny) Regulations 1988 ( S.I. No. 271 of 1988 ) and alter the speed limits applicable to certain roads in County Kilkenny.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit of 30 m.p.h. prescribed by section 45 of the Road Traffic Act, 1961 and declare the roads mentioned in the Second Schedule which would otherwise be outside the scope of the 30 m.p.h. limit to be subject to that limit.

The Regulations prescribe a speed limit of 40 m.p.h. in respect of the public roads mentioned in the Third Schedule.

Ambulances, Fire Brigade vehicles and Garda Síochána vehicles while being used in the course of duty are exempted from all speed limits by the Regulations.
