ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF KILKENNY) REGULATIONS, 1988.

The Minister for the Environment in exercise of the powers conferred on him by section 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Kilkenny) Regulations, 1988.

2 Commencement

2. These Regulations shall come into operation on the 1st day of November, 1988.

3 Interpretation

3. In these Regulations save where the context otherwise requires "the Act" means the Road Traffic Act, 1961 ;

"built-up area speed limit" and "special speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road;

"National Road" means a road declared to be a National road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such road shall be a reference to the number of such road as shown in column 1 of the First Schedule or column 1 of the Second Schedule to the aforementioned Order;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a borough;

"road" means a public road;

4 Built-up area speed limit

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation

7. The Road Traffic (Speed Limits) (County of Kilkenny) Regulations, 1977 (S.I. 332 of 1981) are hereby revoked.

FIRST SCHEDULE

Roads declared not to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following roads in the town of Callan:—

( a ) Lower Haggardsgreen, The Ballywalter Road.

( b ) The Kilkenny Road (National Road N76) for a distance of 46 metres from the town boundary.

( c ) The Minnauns road for a distance of 489 metres from the town boundary.

( d ) The Coolagh Road between the town boundary and a point 92 metres south-east of its junction with the Clonmel Road.

( e ) The Clonmel Road (National Road N76) between the town boundary and a point 83 metres south-west of its junction with the Coolagh Road.

( f ) Chapel Lane between its junction with the Carrabine Bridge road and a point 41 metres north-west of its junction with Green Street.

( g ) The Carrabine Bridge Road for a distance of 128 metres from the point where the town boundary intersects the northern side of the road.

( h ) The laneway leading from the Carrabine Bridge road to the King's River.

( i ) Flaggy Lane between its junction with Upper Haggardsgreen and a point 28 metres west of its junction with Lower Bridge Street.

( j ) Upper Haggardsgreen between its junction with the Ballywalter Road and a point 10 metres west of its junction with the Kilkenny Road (National Road N76).

2. The following roads in the Borough of Kilkenny:—

( a ) The Old Glendine Road, The Castleinch Road.

( b ) The Castlecomer Road (National Road N77) for a distance of 1,188 metres from the borough boundary.

( c ) College Road (National Road N76) and its continuation as the Callan Road (National Road N76) for a distance of 600 metres from the borough boundary.

( d ) The Circular Road between the borough boundary and a point 18 metres south-east of its junction with the Castleinch Road.

( e ) The Ballycallan Road for a distance of 164 metres from the borough boundary.

SECOND SCHEDULE

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Ballyhale:—

( a ) The Kilkenny-Waterford road (National Road N9) between a point 26 metres south of its junction with the Station Road and a point 350 metres south of its junction with the Coolmore Road.

( b ) The Coolmore Road for a distance of 46 metres from its junction with the Kilkenny-Waterford road (National Road N9).

2. The following roads at Ballyragget:—

( a ) The Square, The Fair Green.

( b ) Castle Street and its continuation as the Kilkenny Road (National Road N37) for a distance of 875 metres from the junction of Castle Street with the Square.

( c ) High Street and its continuation as the Castlecomer Road (National Road N77) for a distance of 366 metres from the junction of High Street with Patrick Street.

( d ) Patrick Street and its continuation as Smith's Road for a distance of 120 metres from the junction of Patrick Street with High Street.

( e ) Moat Street and its continuation as the Moatpark Road between the junction of Moat Street with the Square and a point 128 metres north of the junction of the Moatpark Road with the Fair Green.

( d ) The Maddockstown Road for a distance of 440 metres from its junction with the Gowran Road.

( e ) The Link Road between the Maddockstown Road and the Gowran Road.

( f ) The Annamult Road for a distance of 125 metres from its junction with the Kilkenny Road.

( g ) The Danesfort Road for a distance of 65 metres from its junction with the Annamult Road.

4. The following roads adjacent to the town of Callan:—

( a ) Fair Green Lane, Mill Street.

( b ) The Dunnamaggan Road for a distance of 137 metres from the point where the boundary of the town of Callan intersects the north-eastern side of the road.

( c ) The easternmost laneway leading from Mill Street to the King's River.

5. The following roads at Castlecomer:—

( a ) Market Lane, Market Square, Mill Lane, The Glebe, Love Lane, Maryville Housing Scheme Roads, Hospital Lane, Donaguille Road, Chatsworth Row, Hillside View Housing Estate Road.

( b ) The Kilkenny-Dublin Road (National Road N78) between a point 110 metres south of its junction with Hospital Lane and a point 480 metres east of its junction with Barrack Street.

( c ) Barrack Street and its continuation as the Ballyragget Road between the junction of Barrack Street with the Kilkenny-Dublin Road (National Road N78) and a point 183 metres north-west of the junction of the Ballyragget Road with Love Lane.

7. The following roads at Dunnamaggan:—

( a ) The Callan-Knocktopher road between a point 110 metres north-west of its junction with the Raheen Road and a point 735 metres south-east of the said junction.

( b ) The Raheen Road for a distance of 35 metres from its junction with the Callan-Knocktopher road.

8. The following roads at Fiddown:—

( a ) The Waterford-Carrick-on-Suir road (National Road N24) between a point 72 metres south of its junction with the Strand Road and a point 430 metres north-west of its junction with the Rathmore Road.

( b ) The Rathmore Road for a distance of 295 metres from its junction with the Waterford-Carrick-on Suir road (National Road N24).

9. The following roads at Freshford:—

( a ) The Square.

( b ) The Kilkenny-Thurles road between a point 115 metres south-east of its junction with the Clintstown Road and a point 211 metres west of its junction with Bohergloss Street.

( a ) The Foyle Bridge-Beggar Cross road between a point 270 metres northwest of its junction with the Foyle North Road and a point 220 metres south-east of the said junction.

( b ) The Foyle North road for a distance of 90 metres from its junction with the Foyle Bridge-Beggar Cross road.

( b ) a point on the Killeen Road 86 metres north of its junction with the Fairview Cottages Road,

( c ) a point on the Ullard Road 348 metres north-east of its junction with Barrow Lane,

( d ) the easternmost point of the Quay,

( e ) the centre point of Graiguenamanagh Bridge,

( f ) a point on the New Ross Road 180 metres south of its junction with the Inistioge Road,

( g ) a point on the Inistioge Road 51 metres west of its junction with the New Ross Road,

( a ) Hatchery Lane, The Square.

( b ) The Thomastown-New Ross road between a point 320 metres north of its junction with the Killeen Road and a point 70 metres east of its junction with the Graiguenamanagh Road.

( c ) The Killeen Road for a distance of 340 metres from its junction with the Thomastown-New Ross road.

( d ) The Ballyduff road for a distance of 275 metres from its junction with the Kileen Road.

18. The following roads at Johnstown:—

( a ) The Square.

( b ) The Dublin-Cork road (National Road N8) between a point 700 metres north-east of its junction with the Square and a point 220 metres south-west of the said junction.

( c ) The Kilkenny Road for a distance of 403 metres from its junction with the Dublin-Cork road (National Road N8).

( d ) The Canal Road for a distance of 410 metres from its junction with the Square.

19. The following roads at Kells:—

All roads in the area enclosed by a line commencing at a point on the Kilkenny road 92 metres north of Lady's Well Cross Roads and drawn thence in straight lines successively to the following points:—

( a ) a point on the Carlow Road (National Road N9) 137 metres north of its junction with Newtown Terrace,

( b ) a point on the Graiguenamanagh Road 183 metres north-east of its junction with the Inistioge Road,

( c ) a point on the Inistioge road 230 metres south-east of its junction with the Graiguenamanagh Road.

( d ) a point on the Creamery Road 390 metres south-east of its junction with the Ballyhale Road.

( c ) The Smartscastle Road for a distance of 275 metres from its junction with the Rockshire Road.

( d ) The New Ross Road (National Road N25) for a distance of 183 metres from the point where the boundary of the county borough of Waterford intersects the south-eastern side of the road.

THIRD SCHEDULE

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (county of Kilkenny) 1981 ( S.I. No. 332 of 1981 ) and alter the speed limits applicable to certain roads in County Kilkenny.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit of 30 m.p.h. prescribed by section 45 of the Road Traffic Act, 1961 .

The Regulations declare that the roads mentioned in Second Schedule, which would otherwise be outside the scope of the built-up area speed limit of 30 m.p.h. shall be subject to that limit.

The Regulations prescribe a speed limit of 40 m.p.h. in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Sióchana vehicles while being used in the course of duty are exempted from all speed limits by the Regulations.
