INDUSTRIAL TRAINING (TEXTILES, CLOTHING AND FOOTWEAR COMMITTEE) ORDER, 1989.

An Foras Aiseanna Saothair, in exercise of the powers conferred on it by Section 24 of the Industrial Training Act, 1967 (No. 5 of 1967), and Section 4 (2) of the Labour Services Act 1987 (No. 15 of 1987), hereby makes the following order:—

1. This Order may be cited as the Industrial Training (Textiles, Clothing and Footwear Committee) Order, 1989.

2. The following Orders are hereby revoked:—

The Industrial Training (Clothing & Footwear Committee) Order, 1969 ( S.I. No. 219 of 1969 ), The Industrial Training (Clothing and Footwear Committee) (Amendment) Order, 1982 ( S.I. No. 118 of 1982 ), The Industrial Training (Textiles Committee) Order, 1969 ( S.I. No. 171 of 1969 ), The Industrial Training (Textiles Committee) (Amendment) Order, 1972 ( S.I. No. 107 of 1972 ) and the Industrial Training (Textiles Committee) (Amendment) Order 1982 ( S.I. No. 119 of 1982 ).

3. An Industrial Training Committee to be known as the Textiles, Clothing and Footwear Industry Training Committee (hereinafter referred to as the Committee) is hereby established to advise and assist An Foras Aiseanna Saothair (in this Order referred to as An Foras) as respects the performance by An Foras of its functions in relation to the activities of Industry declared by the Industrial Training (Textiles Industry) Order, 1968 ( S.I. No. 278 of 1968 ) as amended and the Industrial Training (Clothing and Footwear Industry) Order 1969 ( S.I. No. 44 of 1969 ), to be designated industrial activities for the purposes of the Industrial Training Act, 1967 (No. 5 of 1967) and the Labour Services Act, 1987 (No. 15 of 1987).

4. The Committee shall consist of a Chairman and twelve ordinary members.

5. An Foras shall appoint a person who is not representative of either workers' or employers' interests to be Chairman of the Committee.

6. The ordinary members of the Committee shall include five workers' members, five employers' members, one educational member and one other ordinary member.

7. An Foras shall—

(a) after consultation with the Minister, invite, in respect of each workers' member, an organisation representative of trade unions of workers to nominate a person for appointment as a workers' member and shall appoint each person so nominated to be a workers' member,

(b) after consultation with the Minister, invite an organisation or organisations representative of employers to nominate persons for appointment as employers' members and shall appoint five persons from the persons so nominated to be the employers' members,

(c) after consultation with the Minister for Education, appoint one person to be the educational member, and

(d) after consultation with such organisations as An Foras considers suitable, appoint one person to be the other ordinary member.

8. Subject to Article 11 of the Second Schedule to the Industrial Training Act, 1967 (No. 5 of 1967), the term of office of a member of the Committee shall be three years or such other period as An Foras shall determine at the time of his appointment.

9. The quorum for a meeting of the Committee shall be six members.

10. The Chairman of the Committee and each ordinary member of the Committee at a meeting thereof shall have a vote.

11. Every question at a meeting of the Committee shall be determined by a majority of the votes of the members present and voting on the question and, in the case of an equal division of votes, the Chairman of the meeting shall have a second or casting vote.

12. The Committee may act notwithstanding one or more than one vacancy amongst its members.

13. This Order shall come into operation on the 15th June 1989.

EXPLANATORY NOTE.

An Foras Aiseanna Saothair (The Training and Employment Authority was established under the Labour Services Act, 1987 .

This Order establishes an industrial training committee, to be known as the Textiles, Clothing and Footwear Industry Training Committee, to advise and assist An Foras as respects the performance of its functions in relation to the activities of the industry as defined by the Industrial Training (Textiles Industry) Order, 1968 ( S.I. No. 278 of 1968 ) as amended and the Industrial Training (Clothing and Footwear Industry) Order, 1969 ( S.I. No. 44 of 1969 ).
