AQUACULTURE (ST. JOHN'S POINT) ORDER, 1988.

I, BRENDAN DALY, Minister for the Marine, in exercise of the powers conferred on me by section 54 of the Fisheries Act, 1980 (No. 1 of 1980) (as adapted by the Tourism, Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1987 ( S.I. No. 82 of 1987 )), and by the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), having complied with the requirements of subsection (3) of the said section 54 and being of the opinion that, notwithstanding the existence of any public right to fish in the waters to which the following order relates, it is in the public interest that the order be made, hereby, order as follows:

1. This order may be cited as the Aquaculture (St. John's Point) Order, 1988.

2. The areas described in the Schedule hereto are hereby designated to be areas within which it shall be lawful to engage in aquaculture pursuant to and in accordance with a licence granted under section 54 of the Fisheries Act, 1980 (No. of 1980).

SCHEDULE

All that area of Donegal Bay and adjoining waters which is enclosed by a line drawn from the most easterly point of the high water mark of the townland of Menamny, barony of Banagh, county of Donegal, at a bearing of 135° true for a distance of 450 metres and thence continuing at a bearing of 045° true for a distance of 1350 metres and thence continuing at a bearing of 315° true to where such line meets the high water mark of the townland of Ballybodonnell, barony of Banagh, county of Donegal, and thence continuing along the high water mark, initially in a southerly direction, to the point first mentioned.

All that area of Donegal Bay and adjoining waters which is enclosed by a line drawn due south from the most westerly point of the high water mark of the townland of Ballysaggart, barony of Banagh, county of Donegal, for a distance of 650 metres and thence continuing at a bearing of 215° true for a distance of 900 metres and thence continuing due west to where such line meets the high water mark of the townland of Point, parish of Killaghtee, barony of Banagh, county of Donegal, and thence continuing along the high water mark, initially in a northerly direction, to the point first mentioned.

EXPLANATORY NOTE.

This Order designates parts of the area of sea known as St. John's Point as being areas within which it shall be lawful to engage in aquaculture pursuant to a licence issued by the Minister for the Marine.
