S.I. No. 1/1988 - District Court Districts and Areas (Amendment) Order, 1988.

I, GERARD COLLINS, Minister for Justice, in exercise of the powers conferred on me by ( section 26 of the Courts of Justice Act, 1953 ) (No. 32 of 1953), hereby order as follows:

1. (1) This Order may be cited asthe District Court Districts and Areas (Amendment) Order, 1988.

(2) This Order shall come into operation on the 1st day of February, 1988.

2. In this Order "the Principal Order" means the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ).

3. The district court area of Newtowncunningham is hereby abolished by the deletion of the matter at reference number 69 in columns (2), (3), (4) and (5), respectively, in the First Schedule to, and at reference number 62 in columns (2), (3), (4) and (5), respectively, in the Second Schedule to, (the Principal Order).

4. The district court area of Buncrana is hereby varied by the substitution in column (5) at reference number 57 in the First Schedule to, and in column (5) at reference number 51 in the Second Schedule to, (the Principal Order), for "and Mintiagh" of "Mintiaghs, Burt and Castleforward".

5. The district court area of Raphoe is hereby varied by the substitution in column (5) at reference number 71 in the First Schedule to, and in column (5) at reference number 63 in the Second Schedule to, (the Principal Order), for "and Treantaghmucklagh" of "Treantaghmucklagh, Killea and Newtown Cunningham".

6. The District Court (Districts) Order, 1961 ( S.I. No. 6 of 1961 ), is hereby amended by the deletion in column (3) at reference number 1 in the First Schedule and in column (3) at reference number 1 in the Second Schedule thereto of "Newtowncunningham".

7. The Schedule to the District Court Areas (Amendment) Order, 1970 ( S.I. No. 161 of 1970 ), is hereby amended by the deletion in column (4) at reference number 1 of "Newtowncunningham" and "69".

8. Business transacted in the District Court which is initiated and is not completed before the commencement of this Order shall be continued and completed as if this Order has been in force at the time at which such business was initiated.

EXPLANATORY NOTE.

This Order provides for the abolition of the District Court Area of Newtowncunningham and the amalgamation of the District Electoral Divisions of Burt and Castleforward with the District Court Area of Buncrana and the amalgamation of the District Electoral Divisions of Killea and Newtown Cunningham with the District Court Area of Raphoe.
