SALMON, EEL AND OYSTER (MISCELLANEOUS COMMERCIAL LICENCES) (ALTERATION OF DUTIES) ORDER, 1987.

I, BRENDAN DALY, Minister for the Marine, in exercise of the powers conferred on me by—

( a ) sections—

(i) 68 (as amended by section 4 of the Fisheries (Amendment) Act, 1976 (No. 23 of 1976),

(ii) 159(6) and 160(5) (both of which subsections were inserted by section 69 of the Fisheries Act, 1980 (No. 1 of 1980)), and

(iii) 279(2) (as amended by the said section 4),

of the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959), and

( b ) the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Tourism, Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1987 ( S.I. No. 82 of 1987 )).

hereby make the following order with respect to which, pursuant to sections 68(7) and 279(4) (both of which subsections were inserted by section 3 of the Fisheries (Amendment) Act, 1976 , and applied by the said sections 159(6) and 160(5)) of the Fisheries (Consolidation) Act, 1959 , a draft has been laid before each House of the Oireachtas and a resolution approving of the draft has been passed by each such House:

1. This Order may be cited as the Salmon, Eel and Oyster (Miscellaneous Commercial Licences) (Alteration of Duties) Order, 1987.

2. The amount of the ordinary licence duty in respect of an ordinary fishing licence authorising the use of a fishing engine of a kind specified in column (2) of the Schedule to this Order at any reference number is hereby altered to the amount specified in column (3) of the said Schedule at that reference number.

3. The licence duty on oyster fishing licences is hereby altered to £40.

4. (1) The Fisheries (Consolidation) Act, 1959 (No. 14 of 1959), is hereby amended—

( a ) in section 159 (as amended by the Salmon, Eel and Oyster (miscellaneous Licences) (Alteration of Duties) Order, 1982 ( S.I. No. 386 of 1982 )) by—

(i) the substitution in subsection (1) (b) (ii) of "£60" for "fifty pounds", and

(ii) the substitution in subsection (2) (b) (ii) of "£250" for "two hundred pounds",

and

( b ) in section 160(1)(b) (as amended by the said Salmon, Eel and oyster (miscellaneous Licences) (Alteration of Duties) Order, 1982) by the substitution of "£60" for "fifty pounds".

(2) This Article shall have effect as respects Part X licences issued or renewed on or after the 1st day of January, 1988.

EXPLANATORY NOTE.

This Order prescribes the rates payable from 1 January, 1988 for salmon, eel and oyster commercial fishing licences and for salmon dealers' and salmon exporters' licences.
