EUROPEAN COMMUNITIES (COSMETIC PRODUCTS) (AMENDMENT) REGULATIONS, 1987.

The Minister for Health in exercise of the powers conferred on him by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the European Communities (Cosmetic Products) (Amendment) Regulations, 1987.

(2) These Regulations shall be construed as one with the European Communities (Cosmetic Products) Regulations, 1984 and 1986 and may be cited with those Regulations as the European Communities (Cosmetic Products) Regulations, 1984 to 1987.

2. In these Regulations "the Principal Regulations" means the European Communities (Cosmetic Products) Regulations, 1984 ( S.I. No. 11 of 1984 ).

3. The definition of "the Council Directive" in article 3(1) of the Principal Regulations, as amended by article 3 of the European Communities (Cosmetic Products) Regulations, 1986 ( S.I. No. 35 of 1986 ) shall

(1) with effect from the 1st day of January, 1988 be further amended by the addition thereto after the reference "85/391/EEC(13)" of the references "86/179/EEC(15) and 86/199/EEC(16)".

(2) with effect from the 1st day of January, 1989 be further amended by the addition thereto after the reference "86/199/EEC(16)" of the reference "87/137/EEC(17)".

4. (1) The reference in article 5(2) of the Principal Regulations to the "1st day of January, 1988" as respects cosmetic products affected by Commission Directives Nos. 86/179/EEC and 86/199/EEC shall be construed as a reference to the 31st day of December, 1989.

(2) The reference in article 5(2) of the Principal Regulations to the "1st day of January, 1988" as respects cosmetic products affected by Commission Directive No. 87/137/EEC shall be construed as a reference to the 31st day of December, 1990.

(3) Nothing in this article shall authorise the sale by retail or the supply to a consumer of a cosmetic product which by virtue of article 5(2) of the Principal Regulations would have been unlawful before the making of these Regulations.

5. Article 10 of the Principal Regulations as amended by article 4 of the European Communities (Cosmetic Products) Regulations, 1986 is hereby further amended by the addition thereto after the reference "85/490/EEC(14)" of the reference "87/143/EEC(18)".

EXPLANATORY NOTE

The purpose of these Regulations is to give effect to four additional EEC Directives relating to cosmetic products.

The effect of the Regulations is to further safeguard public health in regard to the substances which may be contained in cosmetic products.

The use of certain additional substances (e.g. Chloroform) is prohibited while the use of certain other substances is permitted subject to certain restrictions and conditions. The list of colouring agents and antimicrobial preservatives permitted for use in cosmetic products has been revised.
