NATIONAL AGRICULTURAL ADVISORY, EDUCATION AND RESEARCH AUTHORITY ACT, 1977 (SECTION 39) (PRESCRIBED FORMS) ORDER, 1986.

I, AUSTIN DEASY, Minister for Agriculture, in exercise of the powers conferred on me by section 39 of the National Agricultural Advisory, Education and Research Authority Act, 1977 (No. 13 of 1977), hereby order as follows:

1. This Order may be cited as the National Agricultural Advisory, Education and Research Authority Act, 1977 (Section 39) (Prescribed Forms) Order, 1986.

2. In this Order "the Act" means the National Agricultural Advisory, Education and Research Authority Act, 1977 (No. 13 of 1977).

3. A certificate for the purposes of section 39 of the Act shall be in the form set out in Part I of the Schedule to this Order.

4. A demand by a committee of agriculture under section 39 (4) of the Act shall be in the form specified in Part II of the Schedule to this Order.

SCHEDULE.

PART I.

CERTIFICATE OF MINISTER.

National Agricultural Advisory, Education and Research Authority Act, 1977 .

Certificate authorising demand for annual local contribution.

Local financial year commencing on 1st day of January, 19 .

WHEREAS the Minister for Agriculture has considered the annual scheme in respect of the said financial year submitted to him by the............................................................ ........................................⁽¹⁾;

AND WHEREAS the said Minister has had regard to the estimate of expenses and receipts contained in the said scheme and the estimate of expenses and receipts furnished under section 44 of the National Agricultural Advisory, Education and Research Authority Act, 1977 (No. 13 of 1977), to the said Minister by An Chomhairle Oiliuna Talmhaiochta:

NOW, the said Minister—

(a) in pursuance of section 39 (2) of the National Agricultural Advisory, Education and Research Authority Act, 1977 , hereby authorises the said....................................... ⁽¹⁾to demand from

the........................................, ⁽²⁾being the council of the county in which the functional area of the committee is situate, an annual local contribution in respect of the said local financial year of the amount of...... (£ );

(b) declares in accordance with section 39 (3) of the said Act that, of the annual local contribution the demand for which is authorised by this certificate, £ relates to the estimate of expenses and receipts contained in the said scheme and £ relates to the estimate of expenses and receipts furnished under the said section 44;

, the demand for which is authorised by this certificate, be made in four equal instalments the first whereof to be paid not later than the 31st day of March, 19 , the second whereof, not later than the 30th day of June, 19 , the third whereof, not later than the 30th day of September, 19 , and the fourth whereof, not later than the 31st day of December, 19 .

EXPLANATORY NOTE.

The order prescribes the form of

(a) certificate by the Minister for Agriculture authorising Committees of Agriculture in each County to demand the statutory annual local contribution from County Councils

and

(b) demand by Committees of Agriculture from County Councils for such contributions.
