FOREIGN POST AMENDMENT (No. 25) SCHEME, 1985.

AN POST, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act, 1983 , hereby makes the following Scheme:

1. (i) This Scheme may be cited as the Foreign Post Amendment (No. 25) Scheme, 1985.

(ii) This Scheme shall be operative with effect from the 1st day of January, 1984.

2. In this Scheme "the Principal Warrant" means the Foreign post Warrant, 1949 ( S.I. No. 267 of 1949 ).

3. The following Regulation is hereby substituted for Regulation 25 of the Principal Warrant [inserted by Regulation 8 of the Foreign Post Amendment (No. 13) Warrant, 1971 ( S.I. No. 198 of 1971 ) as amended by Regulation 7 of the Foreign Post Amendment (No. 16) Warrant, 1975 ( S.I. No. 317 of 1975 )]

SPECIAL CONDITIONS AS TO PRINTED PACKETS, SMALL PACKETS AND PACKETS CONSISTING OF LITERATURE FOR THE BLIND.

"25.

(1) Every printed packet, small packet, and packet consisting of literature for the blind shall be subject to examination in the post and, subject to the provisions of this Warrant, shall not contain anything sealed or otherwise closed against inspection, or contain anything in the nature of a current and personal correspondence.

(2) ( a ) Notwithstanding paragraph (1) of this Regulation, printed paper items containing books and brochures may be accepted for transmission by Post in sealed internal transparent wrappers within an external unsealed wrapper.

( b ) Notwithstanding paragraph (1) of this Regulation, printed paper items may be accepted by An Post for transmission by post in closed or sealed plastic wrappers either transparent or opaque, provided that each of the following conditions is observed by the senders:

(i) Every item shall be made up in a reasonably strong wrapper appropriate to its contents and so that no part of the contents can be removed without either breaking or tearing the wrapper or forcing two adhering surfaces apart or breaking a seal.

(ii) The sender shall pay in respect of each period of twelve months an annual fee of £20 for a permit to post printed paper items in closed or sealed plastic wrappers, transparent or opaque, if such fee has not already been paid in respect of a comparable permit for the same period under the provisions of Regulation 15 (b) (ii) or Regulation 17 (1a) (ii) of the Inland Post Warrant, 1939.

(iii) Application for a permit shall be made to the local Head Post Office or, in the case of applicants in the Dublin Postal District, to the Controller, Dublin Postal District.

(iv) Where a sender has branches at different addresses in the same Head Post Office District, or within the Dublin Postal District, application may be made for a single permit to cover all the said sender's branches in such District; in all other cases, each branch of a sender shall require a separate permit.

(v) Each posting must consist of a minimum number of one hundred items.

(vi) Postings must be made at least once every twelve months.

(vii) Postings must be made at a designated Post Office.

(viii) The cover of each item shall bear in the upper left-hand corner, beneath the sender's name and address, where these are given, the words "Printed Paper" or, if the item qualifies for reduced printed paper rate, the words

"Printed Paper — Reduced Rate" and, under these words, a slogan comprising the words "Ceadaithe faoi Shéala Sealed under Permit" with the name of the appropriate Head Post Office and the permit number in the following format:

"Ceadaithe faoi Shéala

Sealed under Permit

Corcaigh 3.

Cork 3."

(ix) The address of the addressee shall be set out in the direction of the greatest dimension; the address of the addressee, the address of the sender and the prescribed postage paid imprint may be placed under the plastic film in such a way that they are perfectly legible through the transparent panel or panels provided for that purpose. The wrapping shall include, on the address side, a sufficiently wide part on which service instructions, any reasons for non-delivery or, when applicable, the addressee's new address, can be written by hand, or shown by means of a label or by any other process, as on paper; a sufficiently wide part of the wrapping on the address side must have the properties of paper. Items wrapped in plastic may also be prepaid by means of franking machine impressions made on a self-adhesive label or, in some indelible way, on the actual wrapping.

(x) When an application is made for a permit, or for its annual renewal, a sample of each item (cover and contents) shall be provided.

(xi) In the event of an item being found to contravene Post Office regulations, An Post shall have the right to terminate the permit without refund of the fee or part thereof.

( c ) Sealed printed papers shall remain subject to examination at any time by an officer of the Post Office.

( d ) Subject to the foregoing, all provisions of the Principal Warrant applicable to printed paper items shall continue to apply.

EXPLANATORY NOTE

This Scheme applies to the Foreign Post service and comes into operation on the 1st day of January, 1984. It authorises the acceptance of printed papers in sealed or closed plastic wrapping, subject to conditions laid down by An Post.
