LICENSING OF SEA-FISHING BOATS (EXEMPTION) REGULATIONS, 1983.

I, PADDY O'TOOLE, Minister for Fisheries and Forestry, in exercise of the powers conferred on me by subsection (4) (b) of section 222 B (inserted by the Fisheries (Amendment) Act, 1983 (No. 27 of 1983)) of the Fisheries (Consolidation) Act, 1959 ) (No. 14 of 1959), and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries (Alteration of Name of Department and Title of Minister) Order, 1978 ( S.I. No. 195 of 1978 )), hereby make the following regulations:—

1. These Regulations may be cited as the Licensing of Sea-fishing Boats (Exemption) Regulations, 1983.

2. In these Regulations "length", in relation to a sea-fishing boat, means the distance from the forepart of the stem of the boat to—

( a ) in case the boat has a sternpost, the aft side of the head of the sternpost,

( b ) in any other case, the forepart of the rudder stock.

3. A sea-fishing boat which measures 65 feet or less in length shall be exempt from the provisions of subsection (2) of section 222 B (inserted by section 2 of the Fisheries (Amendment) Act, 1983 (No. 27 of 1983)) of the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959).

EXPLANATORY NOTE.

The effect of these Regulations is to exempt Irish sea-fishing boats of 65 feet and under in the defined length from the provisions of subsection (2) of section 222 B of the Fisheries (Consolidation) Act, 1959 which requires that sea-fishing boats shall not fish except under licence by the Minister for Fisheries and Forestry.
