WILDLIFE (WILD BIRDS) (OPEN SEASONS) (AMENDMENT) ORDER, 1982.

I, BRENDAN DALY, Minister for Fisheries and Forestry, in exercise of the powers conferred on me by sections 8 and 24 of the Wildlife Act, 1976 (No. 39 of 1976), as adapted by the Fisheries (Alteration of Name of Department and Title of Minister) Order, 1978 ( S.I. No. 195 of 1978 ), do hereby order as follows:

1. (1) This Order may be cited as the Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 1982.

(2) The Wildlife (Wild Birds) (Open Seasons) Orders, 1979 and 1980, and this Order may be cited together as the Wildlife (Wild Birds) (Open Seasons) Orders, 1979 to 1982.

2. In this Order "the Principal Order" means the Wildlife (Wild Birds) (Open Seasons) Order, 1979 ( S.I. No. 192 of 1979 ).

3. Part I of the Second Schedule to the Principal Order is hereby amended by—

( a ) the substitution of the following for paragraph 46:

"46. Lough Gara in the Counties of Roscommon and Sligo.

The area for the time being covered by the waters of the southern portion of Lough Gara in the Counties of Roscommon and Sligo, as divided by Cuil Bridge together with the following lands, namely:

( a ) the lands forming the islands in the aforementioned portion;

( b ) the island of Inchmore;

( c ) the lands comprising the townlands of Clooncunny, Lomcloon, and Annagh Beg (or Monasterredan);

( d ) the lands comprising that part of the townland of Tawnymucklagh which is bounded on the north by the Clooncunny road, on the west by the railway line and on the south by Creggan townland;

( e ) the lands comprising that part of the townland of Callow or Runnawillin, which is enclosed by an imaginary line drawn from the point where the townland boundary between Creggan and Callow townlands (which boundary runs along the centre of the Lung River) meets the lake shore along the said townland boundary, initially in a south-westerly direction, for approximately 180 yards to the centre of the cut or drain fence, then continuing, initially south-eastwards, along the said cut or drain fence to the point where the said cut or drain fence meets the Irish Land Commission road, then continuing along the said road, initially in an easterly direction, to the point there-on which is 44 yards south-west of Bench Mark 230.7, and finally continuing north-westwards to the lake shore."

( b ) the substitution of the following for paragraph 50:

"50. Lough Iron in the County of Westmeath.

( a ) The area comprised of the land for the time being covered by the water of Lough Iron, in the County of Westmeath, together with the land forming the islands in the aforementioned lake.

( b ) The area in the County of Westmeath enclosed by an imaginary line drawn from Bench Mark 341 in the townland of Grangegeeth, in a westerly direction along the townland boundary between Piercefield and Piercefield or Templeoran townlands to a point 167 yards distant, then continuing north from the last-mentioned point for a distance of 233 yards to the field boundary and ditch, then continuing west along the said field boundary and ditch to the ditch 447 yards distant, then continuing along the last-mentioned ditch, initially in a northerly direction, to the ditch 500 yards distant, then continuing, initially in a north-westerly direction along the last-mentioned ditch for 260 yards to the lakeshore, then continuing in a south south-westerly direction along the lake shore to the point where the townland boundary between Piercefield and Piercefield or Templeoran townlands meets the lakeshore, then continuing, initially south south-westwards along the last-mentioned townland boundary to the field boundary 500 yards distant, then continuing, initially south south-west, along the last-mentioned field boundary and other field boundaries by the shortest route to Bench Mark 328.1, that is to say a distance of approximately 2,000 yards, and finally continuing in a northerly direction along the road beside that Bench Mark for 167 yards to the point first-mentioned."

( c ) the substitution for the following for paragraph 58:

"58. River Blackwater (part) in the County of Waterford.

The waters, islands and weirs of the River Blackwater in the County of Waterford which lie between Ballyduff Bridge and Lismore Bridge, together with the lands which are enclosed by an imaginary line drawn from the southern end of the downstream parapet of Ballyduff Bridge east along the southern bank of the said river for 792 yards to the point where it meets a fence, then continuing along that fence in a south-easterly direction for 33 yards to the point where it meets a ditch, then continuing along the said ditch in an easterly direction through the townlands of Ballyduff Lower, Glen Beg, Ballygally West, Ballygally, and Ballygalley East to the south Bank of the said river in Ballygalley East townland, then continuing east along the said south bank for 792 yards to the point where it meets a fence, then continuing, initially in a south-easterly direction, along the last-mentioned fence for 418 yards, then for a distance of 814 yards in a north-easterly direction, and then in an easterly direction to the point where the said last-mentioned fence meets the townland boundary between Glencairn and Fort William townlands, then continuing along the said townland boundary in a southerly direction for 132 yards to the point where it meets a fence, then continuing in an easterly direction, initially along the last-mentioned fence and then along a drain to where it meets the sluice (in the townland of Castlelands) on the said south bank, opposite Cottage Island; then continuing eastwards along the said south bank to the upstream parapet of Lismore Bridge, then continuing along the last-mentioned parapet and then westwards along the county road between Lismore and Ballyduff to the point where it meets the townland boundary between Coolishal and Flowerhill townlands, then continuing in a southerly direction along the last-mentioned townland boundary to the point where it meets the centre of the river Blackwater, then continuing, initially in a westerly direction, along the centre of the said river to the point where it meets the townland boundary between Gairha and Garrison townlands, then continuing in a northerly direction along the last-mentioned townland boundary to the point where it meets the said county road, then continuing westwards along that road to the point where it meets the townland boundary between Ballyduff and Garrison townlands, and finally continuing in a southerly direction along the last-mentioned townland boundary and the downstream parapet of Ballyduff Bridge to its southern end."

( d ) the substitution of the following for paragraph 59:

"59. River Barrow (part) in the County of Carlow.

The waters, islands, weirs and lands in the County of Carlow enclosed by an imaginary line drawn from the point on the (towpath) on the south bank of the River Barrow which is 10 yards distant from the south-eastern end of the upstream parapet of Royal Oak Bridge, initially north-eastwards along the southern edge of the drain lying south of the towpath to the drawbridge, then continuing through the town of Muine Bheag along the Quay and Brewery Road, then continuing along the county road to Leighlinbridge to the point where it meets the boundary of the said town, then continuing south-westwards along the said town boundary, across the River Barrow, to the west bank of the said river, then continuing downstream, along the west bank of the said river to the point on the said west bank 67 yards north-east of the north-western end of the said parapet, at which point it meets a fence, then continuing along the said fence to a point which is 10 yards distant from the said upstream parapet, and finally continuing parallel to the said parapet to the point first-mentioned"; and

( e ) the addition of the following paragraphs:

"60. Tullaher Lough in the County of Clare.

The area in the County of Clare which is enclosed by an imaginary line drawn from Bench Mark 19.2 at the Y junction north of Moyasta Village along the public road from Kilrush to Kilkee road, initially in a westerly direction, to the Y junction 300 yards distant, then continuing north westerly along the public road running through Tullaher townland to the crossroads 2,556 yards distant; then continuing, initially in a northerly direction, along the public road running through the said townland to the crossroads in Carrowmore South townland 2,480 yards distant, then continuing, initially in an easterly direction, along the public road running through Carrowmore South townland to the crossroads at Bench Mark 58.8, and finally continuing southwards along the public road adjacent to Tullaher Lough to the point first-mentioned.

61. Sheskinmore Lough in the County of Donegal.

The area in the County of Donegal which is enclosed by an imaginary line commencing at the most south-westerly point of the High Water Mark in Magheramore Townland (south of Trawmore Strand), then continuing along the townland boundary of the said townland, initially in an easterly direction, to the south-easterly point of Trawmore Strand, then continuing along an imaginary straight line drawn from the last-mentioned point to the most southerly point of the townland boundary between the townlands of Magheramore and Mullyvea, then continuing in a north-easterly direction along the last-mentioned townland boundary and the townland boundary of Lackaweer townland via Sheskinmore Lough and the Duvoge River to the point where the said river meets the townland boundary between the townlands of Lackaweer and Kilclooney, then continuing south-eastwards along the last-mentioned townland boundary to the point where it meets the townland boundary of Sandfield townland, then continuing eastwards along the last-mentioned townland boundary to the point at which it meets the fence 70 yards distant, then continuing south-westwards along a straight line projected from the last-mentioned point and through Bench Mark 25.1 to where it meets the High Water Mark at Ballinreavy Strand, and finally continuing in a westerly direction along the High Water Mark to the point first-mentioned.

62. Lough Rusheen in the County of Galway.

The area in the County of Galway which is enclosed by an imaginary line drawn from Knocknacarragh Cross Roads, initially westwards, along the townland boundary of Rusheen townland to the point where it meets the townland boundary between the townlands of Barna and Knockaunnacarragh, then continuing in a southerly direction along the said townland boundary and an accommodation road to the point where the latter meets the High Water Mark (at Trawhagan) then continuing, initially in a south-easterly direction, along the High Water Mark to the most southerly point of Derryloney townland, then continuing along an imaginary straight line projected from the aforementioned point to the accommodation road at the High Water Mark at the most southerly point of Blake's Hill, then continuing, initially in a northerly direction, along the said accommodation road to the point where it meets the public road from Knocknacarragh to Galway, then finally continuing along that public road, initially in a westerly direction, to the point first-mentioned.

63. Moyne in the Counties of Mayo and Galway.

The Following lands and waters in the Counties of Mayo and Galway:

( a ) The lands and waters in the County of Mayo enclosed by an imaginary line drawn from the centre of Moyne Bridge on the Black River along the public road, initially in a north-westerly direction, to the point where the said road meets the public road at the south-western point of the townland of Moyne, then continuing westwards along the last-mentioned public road to the point approximately 160 yards east of Bench Mark 99.8 (which point is known as Ball Alley) to the accommodation road at that point, then continuing along the said accommodation road to the point where it meets the north bank of the Black River, then continuing to the point on the centre line of the said river which is directly opposite, and finally continuing upstream along the said centre line to the point first-mentioned.

( b ) The lands and waters in the County of Galway enclosed by an imaginary line drawn from the centre of Moyne Bridge on the Black River, along the public road, initially in a south-easterly direction, through Bench Marks 59.8, 68.2, 75.7 and 59.9 to the point 39 yards south east of the said Bench Mark 59.9, then continuing, initially west, along the townland boundary of the townland of Cordarragh to the point where it meets the townland boundary of Kildaree, then continuing north-westwards along the accommodation road at that point to where the said road meets the townland boundary of the townland of Ross, then continuing, initially north-westwards, along the last-mentioned townland boundary to where it meets the centre line of the Black River, and finally continuing upstream along the said centre line to the point first-mentioned.

64. Marlfield Lake in the County of Tipperary.

The area comprised of the land for the time being covered by the waters of Marlfield Lake in the County of Tipperary together with the other lands and waters enclosed by an imaginary line drawn from Patrickswell cross roads, initially in a south-westerly direction, along the townland boundary between Gortmore and Irishlounaght to the public road (approximately opposite the entrance to Oaklands) 198 yards distant, then continuing along the last-mentioned road to the T junction at Marlfield, then continuing along the public road in an easterly direction to the cross roads at Hazeldene, and finally continuing from the last-mentioned cross roads in an northerly direction along the public road to Patrickswell cross roads.

65. Bannow Bay in the County of Wexford.

The following lands and waters in the County of Wexford comprised of:

( a ) the area enclosed by an imaginary line projected northwards from the point in Newtown townland (E.D. Bannow) where the centre of the road known as Newtown Road meets the High Water Mark to the point in the townland of Clonmines where the centre of the public road known as Scar Road meets the High Water Mark, then continuing along the High Water Mark, initially in a north-easterly direction to the point in the last-mentioned townland which is 221 yards due north of the corner of Black Castle, then continuing along a line projected due east from the last-mentioned point to the point where it meets the High Water Mark in the townland of Maudlintown, and finally continuing along the High Water Mark, initially in a south-easterly direction to the point first-mentioned.

( b ) the area enclosed by an imaginary line projected from the most southerly point on the High Water Mark at New Quay in the townland of Vernegly to the most north-easterly point on the High Water Mark in the townland of Bannow Island, then continuing, initially in a south-westerly direction, along the townland boundaries of the townlands of Bannow Island, Bannow and Brandane to the point first-mentioned."

4. Paragraph (b) of Article 2 of the Principal Order is hereby revoked.

EXPLANATORY NOTE.

The effect of the Order is to remove the Greenland Whitefronted Goose from the open seasons list and to amend existing and include new areas, excluded from the effects of open seasons.
