DISTRICT COURT AREAS (VARIATION OF DAYS AND HOURS) (NO. 4) ORDER, 1979.

I, GERARD COLLINS, Minister for Justice, in exercise of the powers conferred on me by section 26 (1) of the Courts of Justice Act, 1953 (No. 32 of 1953), and after consultation with the President of the District Court, hereby order as follows:

1. (1) This Order may be cited as the District Court Areas (Variation of Days and Hours) (No. 4) Order, 1979.

(2) This Order shall come into operation on the 1st day of September, 1979.

2. In this Order "the Principal Order" means the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ).

3. The days and hours for holding the District Court in the district court area of Youghal shall, in lieu of the days and hours specified in column (4) at reference number 54 in the First Schedule to the Principal Order, be the first Friday and the fourth Thursday in each month at 11.00 a.m.

4. The days and hours for holding the District Court exercising its summary jurisdiction in the district court area of Clonmel shall, in lieu of the days and hours specified in column (4) at reference number 231 in the First Schedule to the Principal Order, be the second and fourth Tuesdays in each month at 11.00 a.m. and the third Friday in each month at 10.30 a.m. (Juvenile Court).

5. The days and hours for holding the District Court exercising its civil jurisdiction in the district court area of Clonmel shall, in lieu of the days and hours specified in column (4) at reference number 199 in the Second Schedule to the Principal Order, be the third Friday in each month at 2.30 p.m.

6. The days and hours for holding the District Court exercising its summary jurisdiction in the district court area of Tipperary shall, in lieu of the days and hours specified in column (4) at reference number 237 in the First Schedule to the Principal Order, be the first and third Tuesdays in each month at 11.00 a.m. (Juvenile Court 10.30 a.m.).

7. The days and hours for holding the District Court exercising its civil jurisdiction in the district court area of Tipperary shall, in lieu of the days and hours specified in column (4) at reference number 205 in the Second Schedule to the Principal Order, be the third Tuesday in each month at 11.00 a.m.

8. The days and hours for holding the District Court in the district court area of Cappoquin shall, in lieu of the days and hours specified in column (4) at reference number 239 in the First Schedule to the Principal Order, be the second Friday in February, April, June, October and December at 11.00 a.m., and the second Friday in September at 3.00 p.m.

9. The days and hours (as amended by the District Court Areas (Variation of Days and Hours) (No. 3) Order, 1976 ( S.I. No. 117 of 1976 )) for holding the District Court in the district court area of Dungarvan shall, in lieu of the days and hours specified in column (4) at reference number 240 in the First Schedule, and at reference number 206 in the Second Schedule, to the Principal Order, be the second and fourth Wednesdays in each month at 11.00 a.m.

10. The days and hours for holding the District Court in the district court area of Tallow shall, in lieu of the days and hours specified in column (4) at reference number 243 in the First Schedule to the Principal Order, be the second Friday in January, March, May, July, September and November at 11.00 a.m.

11. Business transacted in the District Court which is initiated and is not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business had been initiated.

EXPLANATORY NOTE.

This order provides for additional sittings of the District Court in Youghal and Clonmel, and for a reduction in sittings at Cappoquin and Tallow. It also provides for changes in starting time of District Courts in Clonmel, Dungarvan and Tipperary.
