AIR NAVIGATION (EUROCONTROL) (ROUTE CHARGES) (AMENDMENT) REGULATIONS, 1978.

I, PADRAIG FAULKNER, Minister for Tourism and Transport, in exercise of the power conferred on me by section 12 of the Air Navigation (Eurocontrol) Act, 1963 , (No. 15 of 1963), (as amended by section 1 of the Air Navigation (Eurocontrol) Act, 1971 (No. 19 of 1971)), and the Transport and Power (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 305 of 1977 ), hereby make the following regulations (the charges thereunder having been determined by me in pursuance of tariffs approved of under an international agreement to which the State is a party):

1. (1) These Regulations may be cited as the Air Navigation (Eurocontrol) (Route Charges) (Amendment) Regulations, 1978, and shall come into operation on the 1st day of April, 1978.

(2) The Air Navigation (Eurocontrol) (Route Charges) Regulations, 1971 to 1977, and these Regulations may be cited together as the Air Navigation (Eurocontrol) (Route Charges) Regulations, 1971 to 1978.

2. (1) The Air Navigation (Eurocontrol) (Route Charges) Regulations, 1971 ( S.I. No. 290 of 1971 ), are hereby amended as follows:

( a ) in Regulation 5 (1), "9.9364 United States dollars" shall be substituted for "8.4425 United States dollars" (inserted by the Air Navigation (Eurocontrol) (Route Charges) (Amendment) Regulations, 1977 ( S.I. No. 83 of 1977 )),

( b ) for the Schedule there shall be substituted the Schedule set out in the Annex to these Regulations.

(2) The reference in the preceding paragraph to the Air Navigation (Eurocontrol) (Route Charges) Regulations, 1971, is to those Regulations as amended by the regulations amending them which were made before the commencement of these Regulations and of which the last is the Air Navigation (Eurocontrol) (Route Charges) (Amendment) Regulations, 1977 ( S.I. No. 83 of 1977 ).

EXPLANATORY NOTE.

These Regulations provide for the application of increased charges to reflect an increase to 75% in the rate of recovery of the cost of the provision of route facilities and services as well as increases in such costs.
