CONTROL OF IMPORTS (QUOTA No. 51) (MISCELLANEOUS TEXTILES) (AMENDMENT) ORDER, 1977.

The Government, in exercise of the powers conferred on them by Section 11 of the Control of Imports Act, 1934 (No. 12 of 1934), hereby make the following Order:

1. This Order may be cited as the Control of Imports (Quota No. 51) (Miscellaneous Textiles) (Amendment) Order, 1977, and shall come into operation on the 1st day of April, 1977.

2. The Interpretation Act, 1937 (No. 38 of 1937) applies to this Order.

3. In this Order "the Order of 1964" means the Control of Imports (Miscellaneous Textiles) (Quota No. 51) Order, 1964 ( S.I. No. 297 of 1964 ).

4. The Order of 1964 is hereby amended by the substitution for paragraph (c) of the Second Schedule thereto of the following:—

"(c) All countries not previously mentioned in this Schedule other than the following:

Japan,	Bulgaria,
Czechoslovakia,	Poland,
Roumania,	East Germany,
India,	Pakistan,
Malaysia,	Yugoslavia,
Macao,	U.S.S.R.,
People's Republic of China,	Albania,
Hungary,	Mongolia,
Hong Kong,	North Korea,
China Nationalist,	Vietnam (North)".
(Taiwan)

5. Subject to Article 6 of this Order, the prohibition on the importation of goods effected by the Order of 1964 shall cease to apply to goods which are shown to the satisfaction of the Revenue Commissioners to have been manufactured in, or to have originated in, Hong Kong, India, Japan, Macao, Malaysia, Pakistan or Yugoslavia.

6. Notwithstanding the provisions of Article 5 of this Order—

(a) the prohibition effected by the Order of 1964 on the importation of goods that are specified at tariff heading number 55.06 and are shown to the satisfaction of the Revenue Commissioners to have been manufactured in, or to have originated in, Hong Kong, India, Macao or Pakistan shall continue in force until the 30th day of June, 1977, and shall then cease to have effect:

(b) the prohibition effected by the Order of 1964 on the importation of goods that are specified at tariff heading 62.05 and are shown to the satisfaction of the Revenue Commissioners to have been manufactured in, or to have originated in, India, Pakistan, Hong Kong, Macao or Malaysia shall continue in force until the 30th day of June, 1977, and shall then cease to have effect;

and

(c) the prohibition effected by the Order of 1964 on the importation of goods that are specified at tariff heading 62.03 shall continue in force.

7. The prohibition effected by the Order of 1964 in respect of the importation of goods which are:—

(a) specified at a tariff heading number in column (1) of the Schedule to this Order or at a tariff code number specified in column (2) of that Schedule,

(b) of a description specified in column (3) of that Schedule opposite the mention in column (1) or column (2), as the case may be, of a tariff heading number or a tariff code number,

(c) shown to the satisfaction of the Revenue Commissioners to have been manufactured in, or to have originated in, Taiwan, shall cease to have effect.

8. The Control of Imports (Quota No. 51) (Miscellaneous Textiles) (Amendment) Order, 1975 ( S.I. No. 283 of 1975 ), is hereby revoked.

EXPLANATORY NOTE.

The effect of this Instrument is to amend Control of Imports (Quota No. 51) (Miscellaneous Textiles) Order, 1964 as follows:—

1. to extend the prohibitions of the Order to the four countries Albania, Mongolia, North Korea and Vietnam (North).

2. to eliminate from the scope of the Order in respect of Hong Kong, India, Japan, Macao, Malaysia, Pakistan, Yugoslavia all goods to which the Order applies except:

(a) tariff heading 55.06—cotton yarn put up for retail sale which will remain under the quota from Hong Kong, India, Macao and Pakistan until 30th June, 1977,

(b) tariff heading 62.05—other made-up textile articles which will remain under quota from India, Pakistan, Kong Hong, Macao and Malaysia until 30th June, 1977,

(c) tariff heading 62.03—sacks and bags of a kind used for packaging of goods which will remain under quota indefinitely.

3. to delete from the Order in respect of Taiwan and the goods set out in the Schedule.
