FOREIGN POST AMENDMENT (NO. 16) WARRANT, 1975.

I, CONOR CRUISE O'BRIEN, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by sections 2 , 3 and 6 of the Post Office (Amendment) Act, 1969 (No. 18 of 1969), and with the consent of the Minister for Finance, hereby order as follows:

1. (1) This Warrant may be cited as the Foreign Post Amendment (No. 16) Warrant, 1975.

(2) This Warrant shall come into operation on the 1st day of January, 1976.

2. In this Warrant

"the Principal Warrant" means the Foreign Post Warrant, 1949 ( S.I. No. 267 of 1949 );

"the Warrant of 1959" means the Foreign Post Amendment (No. 6) Warrant, 1959 ( S.I. No. 47 of 1959 );

"the Warrant of 1965" means the Foreign Post Amendment (No. 8) Warrant, 1965 ( S.I. No. 253 of 1965 );

"the Warrant of 1974" means the Foreign Post Amendment (No. 15) Warrant, 1974 ( S.I. No. 281 of 1974 ).

3. Regulation 3 of the Principal Warrant, as amended by Regulation 4 of the Foreign Post Amendment (No. 8) Warrant, 1965 ( S.I. No. 253 of 1965 ), is hereby amended by:

( a ) the substitution of the following paragraph for paragraph (7).

"(7) The expression 'insured letter' means any insured letter which is for the time being transmissible under the provisions of the Universal Postal Union Agreement for the Exchange of Insured Letters for the time being in force, and the Detailed Regulations made thereunder.", and

( b ) the substitution in sub-paragraph (a) of paragraph (17) of "letters and postcards" for "letter post items".

4. Regulation 9 of the Principal Warrant (inserted by Regulation 3 of the Foreign Post Amendment (No. 10) Warrant 1969 ( S.I. No. 152 of 1969 )) is hereby further amended by the addition of the following:

"Notwithstanding Regulation 13 or 14 of this Warrant, in relation to the services set out in the Second Schedule hereto, a packet consisting of literature for the blind shall not be subject to the fees set out in that Schedule."

5. Regulation 14 of the Principal Warrant shall have effect as if the words "or insured box" and "or box" were deleted.

6. Regulation 15 of the Principal Warrant, as amended by Regulation 11 of the Warrant of 1959 is hereby amended by:

( a ) the substitution of the following sub-paragraph for sub-paragraph (a) of paragraph (3): "(a) opium, morphine, cocaine and other narcotics,";

( b ) the substitution of the following sub-paragraph for sub-paragraph (a) of paragraph (4);

"(a) (except in letter packets, printed packets, small packets and packets of literature for the blind) any article liable to customs duty,";

( c ) the insertion in paragraph (7) of "save as may be permitted under Regulation 25 of this Warrant" after "open panel".

7. Regulation 25 of the Principal Warrant inserted by Regulation 8 of the Foreign Post Amendment (No. 13) Warrant, 1971 ( S.I. No. 198 of 1971 ) is hereby amended by the addition of the following:

"The Minister may permit the acceptance of packets in sealed envelopes or in sealed transparent plastic covers for transmission in mail bags provided by the Minister pursuant to Regulation 4 of the Foreign Post Amendment (No. 4) Warrant of 1956 ( S.I. No. 148 of 1956 ).

8. Regulation 42 (2) of the Principal Warrant, as amended by Regulation 15 of the Warrant of 1965, shall have effect as if all words after "posting" were deleted.

9. Regulation 44 of the Principal Warrant, as amended by Regulation 17 of the Warrant of 1959, is hereby amended by the insertion after "payment" of "at the time of posting" and in addition to the foregoing the said Regulation 44, as so amended, shall have effect as if all the words after "or place of address of the packet" were deleted.

10. Regulation 45 (2) of the Principal Warrant is hereby amended by the insertion after the word "contains" in line 1 of "perishable biological substances, radio-active materials" and after "currency notes" in line 2 of "travellers cheques".

11. The following Regulation is hereby substituted for Regulation 57 of the Principal Warrant:

"57. The Minister may, out of moneys provided by the Oireachtas for that purpose, give effect to the provisions of this Warrant as to the loss or damage of registered postal packets, insured letters and of articles enclosed in or forming part of a registered postal packet or insured letter but nothing contained in or done under or in pursuance of this Warrant shall render him liable to any action or other legal proceeding in respect of or in consequence of any such loss or damage. The decision of the Minister on all questions arising between him and any person claiming payment in respect of the loss or damage of a registered postal packet, insured letter or of any article enclosed in or forming part thereof shall be final and conclusive."

12. The First Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 3 of the Warrant of 1974) of the entries in the First Schedule to this Warrant.

13. The Second Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 4 of the Warrant of 1974) of the entries in the Second Schedule to this Warrant.

14. The Fourth Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 5 of the Warrant of 1974) of the entries in the Third Schedule to this Warrant.

15. Regulation 5 (1) of the Foreign Post Amendment (No. 2) Warrant 1953 ( S.I. No. 280 of 1953 ), as amended by Regulation 18 of the Warrant of 1959 shall have effect as if the words "insured boxes" were deleted.

16. Regulation 5 (1) of the Foreign Post Amendment (No. 4) Warrant 1956 ( S.I. No. 148 of 1956 ) (inserted by Regulation 6 of the Warrant of 1974) is hereby amended by the substitution for "22p" and "165p" of "35p" and "350p", respectively.

17. The Foreign Post Amendment (No. 5) Warrant, 1957 ( S.I. No. 58 of 1957 ), is hereby amended by the substitution of the following paragraphs for paragraphs (1) and (2) of Regulation 5 (inserted by Regulation 7 of the Warrant of 1974):

"5. (1) Subject to the following paragraphs of this Regulation there shall be charged and paid on outgoing packets to which this Warrant applies the following rates of postage:

( b ) For every two pounds weight of the mail bag and its contents conveyed by surface means, 25p, and

( b ) For every two pounds weight of the mail bag and its contents conveyed by air over all or part of the route, a rate not exceeding 340p.

18. Regulations 10, 49, 50, 51, 52 and 53 and Clauses (i), (ii) and (vii) of sub-paragraph (b) of the proviso to Regulation 27 (1) of the Principal Warrant (inserted by Regulation 12 of the Warrant of 1965) are hereby revoked.

At the scale of fees in force for express delivery of Inland postal packets.

4. Ordinary registration

A fee of 24p per packet.

EXPLANATORY NOTE.

This Warrant applies to the Foreign Post service and comes into operation on 1st January, 1976. It authorises increases in the postage rates for letters, postcards, printed packets (ordinary rate, reduced rate, bulk post rate, and accelerated surface bulk rate) and small packets as well as in the fees for the registration insurance and customs clearance services. It abolishes the category of "insured boxes" and makes other provisions in accordance with the decisions of the UPU Congress held at Lausanne in 1974.
