SOCIAL WELFARE (EXTENSION OF DURATION OF PAY-RELATED BENEFIT) ORDER, 1975.

I, FRANK CLUSKEY, Parliamentary Secretary to the Minister for Social Welfare, to whom the powers and duties of the said Minister under the Social Welfare Acts 1952 to 1975 have been delegated under the Social Welfare (Delegation of Ministerial Functions) Order, 1975 ( S.I. No. 193 of 1975 ) in exercise of the powers conferred on the Minister for Social Welfare by section 5 of the Social Welfare (Pay-Related Benefit) Act, 1975 (No. 8 of 1975) hereby order as follows:

1. This order may be cited as the Social Welfare (Extension of Duration of Pay-Related Benefit) Order, 1975.

2. This Order shall come into operation on the 4th day of September, 1975.

3. Notwithstanding the provisions of subsection (2) of section 3 and of section 4 of the Social Welfare (Pay-Related Benefit) Act, 1973 (No. 2 of 1973) (inserted by the Social Welfare (Pay-Related Benefit) Act, 1975 (No. 8 of 1975))—

( a ) the number of days of incapacity for work and the number of days of unemployment in respect of which a person is entitled to pay-related benefit under the provisions of the Social Welfare (Pay-Related Benefit) Acts, 1973 and 1975, is hereby extended by a period of 78 days, and

( b ) the weekly rate at which pay-related benefit shall be payable to a person in respect of the days for which it is payable by virtue of this order shall be twenty-five per cent of the part (if any) of his reckonable weekly earnings for the relevant income tax year that exceeds £14 but does not exceed such limit as stands prescribed for the time being, subject to such conditions as may be prescribed to restrict by reference to those earnings the total amount of benefit payable under the Social Welfare Acts 1952 to 1975, to the person in respect of any week:

Provided, however, that in any period of interruption of employment a person shall not be entitled by virtue of this order to pay-related benefit in respect of any day of incapacity for work after the three hundred and fifteenth day of incapacity for work in that period or in respect of any day of unemployment after the three hundred and fifteenth day of unemployment in that period.

EXPLANATORY NOTE.

This order extends by 78 days the period for which pay-related benefit is payable under the provisions of the Social Welfare (Pay-Related Benefit) Acts, 1973 and 1975, in respect of days of incapacity for work and days of unemployment. The extension is subject to the condition that in any period of interruption of employment benefit shall not be payable after the three hundred and fifteenth day in that period of incapacity for work or of unemployment. The weekly rate at which pay-related benefit is payable by virtue of this order is twenty-five per cent of reckonable earnings subject to the prescribed conditions.
