BROADCASTING (RECEIVING LICENCES) (AMENDMENT) REGULATIONS, 1971.

I, GERARD COLLINS, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 6 (1) of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), as amended by the Wireless Telegraphy Act, 1956 (No. 4 of 1956), and with the consent of the Minister for Finance, hereby make the following Regulations:

1. (1) These Regulations may be cited as the Broadcasting (Receiving Licences) (Amendment) Regulations, 1971.

(2) The Broadcasting (Receiving Licences) Regulations, 1961 to 1970, and these Regulations may be cited together as the Broadcasting (Receiving Licences) Regulations, 1961 to 1971.

(3) These Regulations shall come into operation on the 1st day of September, 1971.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

"the Principal Regulations" means the Broadcasting (Receiving Licences) Regulations, 1961 ( S.I. No. 279 of 1961 .);

"the Regulations of 1963" means the Broadcasting (Receiving Licences) (Amendment) Regulations, 1963 ( S.I. No. 199 of 1963 );

"the Regulations of 1970" means the Broadcasting (Receiving Licences) (Amendment) Regulations, 1970 ( S.I. No. 141 of 1970 ).

4. Regulation 7 of the Principal Regulations, as amended by Regulation 4 of the Regulations of 1963 and Regulation 4 of the Regulations of 1970, is hereby amended by the substitution of the following paragraphs for paragraph (i):

"(i) Save as is otherwise provided by this Regulation, a fee of seven pounds fifty new pence shall be paid on the grant of a receiving licence in the form set out in the First Schedule hereto, and a fee to be calculated in accordance with paragraph (1A) of this Regulation shall be paid on the grant of a receiving licence in the form set out in the Second Schedule hereto.

(1A) (a) In case the licence is not being granted by way of renewal of a previous receiving licence, the fee to be paid on the grant thereof shall be twelve and a half new pence for each completed month and the part (if any) of a month between the date on which it is granted and the 31st day of August, 1972, both dates inclusive.

(b) In case the licence is being granted by way of renewal of a previous receiving licence, the fee to be paid on the grant thereof shall be twelve and a half new pence for each month in the period beginning on the expiration of the previous receiving licence and ending on whichever of the following is the earlier, namely, one year after the expiration of the previous receiving licence, or the 31st day of August, 1972.

(1B) Every fee payable under this Regulation shall be paid in the Post Office in which the receiving licence is obtained and shall be so paid in cash or by cheque, money order or postal order."

5. Regulation 8 of the Principal Regulations is hereby amended by the substitution of the following paragraphs for paragraphs (1) and (2)—

"(1) Every receiving licence (not being a licence granted by way of renewal) shall come into force on the day on which it is granted and shall, unless sooner revoked by the Minister under these Regulations, continue in force until—

(a) in case it is a receiving licence in the form set out in the First Schedule hereto, the end of the eleventh month after the month in which it is granted, and

(b) in case it is a receiving licence in the form set out in the Second Schedule hereto, the 31st day of August, 1972.

(2) Every receiving licence granted by way of renewal of a previous receiving licence shall come into force at whichever of the following times is the later, that is to say, the expiration of the previous receiving licence or the grant of the renewal licence, and shall in every case, unless sooner revoked by the Minister under these Regulations, continue in force until—

(a) in case it is in the form set out in the First Schedule hereto, the end of one year from the expiration of the previous receiving licence, and

(b) in case it is in the form set out in the Second Schedule hereto, the end of one year from the expiration of the previous receiving licence or the 31st day of August, 1972, whichever is the earlier."

6. Regulation 14 of the Principal Regulations is hereby amended by the substitution of the following paragraph for paragraph (2) (inserted by Regulation 5 of the Regulations of 1970):

"(2) The rebate in respect of a licence for which a fee of one pound fifty new pence (or one pound ten shillings) or a fee calculated in accordance with paragraph (a) or (b) of Regulation 7 (1A) of these Regulations was paid shall be calculated at the rate of twelve and a half new pence for each complete month and the part (if any) of a month for which the licence would otherwise have continued in force from the date of the surrender thereof."

7. The Principal Regulations are hereby amended by the substitution of the following for the First and Second Schedules thereto:

EXPLANATORY NOTE.

These Regulations provide for a revised fee for the Broadcasting Receiving Licence (including television) and for payment, during the year ending 31st August, 1972, on a pro-rata basis, of the fee for the Broadcasting Receiving Licence (excluding Television).
