BROADCASTING (RECEIVING LICENCES) (AMENDMENT) REGULATIONS, 1970.

I, GERARD COLLINS, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 6 (1) of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), as amended by the Wireless Telegraphy Act, 1956 (No. 4 of 1956), and with the consent of the Minister for Finance, hereby make the following Regulations:

1. (1) These Regulations may be cited as the Broadcasting (Receiving Licences) (Amendment) Regulations, 1970.

(2) The Broadcasting (Receiving Licences) Regulations, 1961 and 1963, and these Regulations may be cited together as the Broadcasting (Receiving Licences) Regulations, 1961 to 1970.

(3) These Regulations shall come into operation on the 1st day of July, 1970.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

"the Principal Regulations" means the Broadcasting (Receiving Licences) Regulations, 1961 ( S.I. No. 279 of 1961 );

"the Regulations of 1963" means the Broadcasting (Receiving Licences) (Amendment) Regulations, 1963 ( S.I. No. 199 of 1963 ).

4. Regulation 7 (1) of the Principal Regulations, as amended by Regulation 4 of the Regulations of 1963, is hereby amended by the substitution of "six pounds" for "five pounds" and the substitution of "one pound, ten shillings" for "one pound, five shillings".

5. Regulation 14 of the Principal Regulations is hereby amended by the substitution of the following paragraph for paragraph (2):

"(2) (a) The rebate in respect of a licence for which a fee of one pound, five shillings was paid shall be calculated—

(i) in case the unexpired receiving licence is surrendered before the 15th day of February, 1971, at the rate of two shillings and one penny for each complete month and the part (if any) of a month for which the licence would otherwise have continued in force from the date of the surrender thereof, and

(ii) in case such receiving licence is surrendered on or after that day, at the rate of ten and a half new pence for each complete month and the part (if any) of a month for which the licence would otherwise have so continued in force.

(b) The rebate in respect of a licence for which a fee of one pound, ten shillings was paid shall be calculated—

(i) in case the unexpired receiving licence is surrendered before the 15th day of February, 1971, at the rate of two shillings and six pence for each complete month and the part (if any) of a month for which the licence would otherwise have continued in force from the date of the surrender thereof, and

(ii) in case such receiving licence is surrendered on or after that day, at the rate of twelve and a half new pence for each complete month and the part (if any) of a month for which the licence would otherwise have so continued in force."

6. The First Schedule to the Principal Regulations is hereby amended by the substitution of "£6" for "£5" (inserted by Regulation 6 of the Regulations of 1963) in each place where it occurs.

7. The Second Schedule to the Principal Regulations is hereby amended by the substitution of "£1.10.0" for "£1.5.0" (inserted by Regulation 7 of the Regulations of 1963) in each place where it occurs.

EXPLANATORY NOTE.

These Regulations provide for revised fees for both combined and sound receiving licences and also for a revised rate of rebate where a sound licence is surrendered in certain circumstances.
