GREYHOUND RACE TRACK (TOTALISATOR) (OPERATING) REGULATIONS, 1971.

PART I.Preliminary and General.

Bord na gCon, in exercise of the powers conferred on it by subsection (3) of Section 40 of the Greyhound Industry Act, 1958 (No. 12 of 1958), hereby makes the following regulations, which shall constitute the terms of contract on which bets may be made and accepted on the totalisator, that is to say:—

1 Definitions.

1. In these regulations the following words and expressions have the meanings hereby assigned to them, that is to say:—

"advertised runner" means a greyhound whose number is shown on either the public totalisator indicator or runners' board as being engaged to run in a race;

"bet" means a sum of money or the stake lodged with the totalisator by a person buying a ticket;

"the Board" means Bord na gCon established under the Greyhound Industry Act, 1958 ;

"combination" means a bet in the forecast, double or multiple event pools in which the person making the bet couples the numbers of the selected greyhounds in the manner required for each pool;

"dividend" means the amount declared by the operator to be payable for any pool on each unit on a winning or placed greyhound or winning combination;

"double event pool" means a pool for nominating the winning greyhounds of two selected races;

"forecast pool" means a pool for nominating the winning greyhound and the second greyhound in the order of finish;

"multiple event pool" means a pool for nominating the winning or placed greyhounds in respect of the selected races;

"net pool" means :

(i) the balance remaining after the deduction from the pool of

(a) refundable, withdrawn or cancelled stakes and

(b) the percentage for the time being prescribed by the Board under regulations;

or

(ii) in the case of multiple event pools where a pool or part or parts of a pool is or are carried forward to a meeting the amount mentioned at (i) above together with any amount or amounts carried forward;

"nomination" means the naming of a greyhound or the naming of a combination of greyhounds for a bet made on the totalisator in respect of which a ticket is purchased on which the number of the greyhound or the numbers of the greyhounds in such combination may be printed, written or perforated;

"to nominate" means to make such a nomination by the purchase of ticket or tickets;

"number" means the number applied to a greyhound running in a race as shown either on the totalisator public indicator or runners' board;

"operator" means the Board or person or body appointed by the Board to operate the totalisator on behalf of the Board;

"order of finish" means the order in which the noses of the greyhounds reach the winning line when confirmed as final by the stewards by the showing of either a green light or a green flag;

"place pool" means a pool for nominating a placed greyhound;

"placed greyhound" means a greyhound awarded first or second place;

"pool" means the total amount of money staked on the totalisator on the result of a race, a combination of results in a race or a combination of races and may apply to a win pool, place pool, forecast pool, double event pool or any other pool authorised by the Board;

"race" means a greyhound race in which an object propelled by mechanical means is pursued by the greyhounds engaged in the race;

"rules of racing" means the greyhound racing rules made or approved by the Board as the case may be and for the time being in force;

"selected race" means a specified race selected by the operator for the purpose of betting on a double event pool or any other pool authorised by the Board;

"stewards" means the officials for the time being in charge of racing at the meeting;

"start" in relation to a race means when the traps are opened;

"ticket" means a voucher or certificate issued by the totalisator operator in accordance with greyhound race track totalisator regulations made by the Minister for Finance under Section 6 (i) of the Totalisator Act, 1929 and for the time being in force;

"total amount staked" means the money equivalent of the totalisator tickets sold for each pool after making adjustments for non-starters and other causes;

"unit" means the minimum stakes accepted for betting on a pool;

"winning combination" means in the case of

(a) a forecast pool the winning greyhound and the greyhound placed second in the order of finish;

(b) a double event pool the nomination of the winning greyhounds of the two selected races;

(c) a multiple event pool the nomination of the winning or/and placed greyhounds in respect of the selected races;

"winning greyhound" means the first greyhound in the order of finish;

"win pool" means a pool for nominating the winning greyhound;

"Twin Double Pool" means a pool for nominating the winning greyhounds in four selected races;

"Quinella Forecast Pool" means a pool for nominating the winning greyhound and the second greyhound in either order in respect of the number of selected races determined by the operator;

"Jackpot Pool" means a pool for nominating the winning greyhounds in three, four, five or six selected races as the operator may determine.

2 Restriction on totalisator betting by certain persons.

2. The employees of the totalisator whilst so employed shall not engage in any betting either by means of the totalisator or in any other manner at the greyhound race track on which the totalisator is operated.

3 Condition as to totalisator betting.

3. Every person who bets on the totalisator shall be deemed to have express notice of these operating regulations and to have agreed to be bound by them and to have express notice of the greyhound race track totalisator regulations made by the Minister for Finance under Section 6 (i) of the Totalisator Act, 1929 , and the greyhound race track totalisator percentage regulations for the time being in force.

4 Checking tickets, dividends, change and returnable bets.

4. Tickets, change, dividends and returnable bets shall be checked at the time of receipt and mistakes cannot be rectified afterwards.

5 Calculation of dividends.

5. (a) The dividend shall be calculated on the basis of the unit and dividends on bets of higher value than the unit shall be the same multiple of the dividend on the unit as the higher value bet is of the unit.

(b) The dividend on the unit shall be paid to a multiple of one new penny and for that purpose every fraction of one new penny shall, as the Board may think proper in respect of each such fraction, be distributed or retained.

6 Payment of dividends and of returnable bets.

6. (a) Dividends shall be declared after the display by the stewards of the green light or green flag signal and, regardless of any objection or disqualification that may be made, shall be payable on presentation of the appropriate winning tickets or counterfoil portions of winning tickets as the case may be, whole and not unreasonable defaced or unrecognisable.

(b) All dividends payable and all bets returnable under these regulations may be claimed only within one month of the termination of the race meeting at which the bets were made and only at the totalisator while such totalisator is working or at such place and time as may be designated by the operator.

(c) the holder of a winning ticket or counterfoil portion of a winning ticket as the case may be shall be deemed to be the only person entitled to receive the dividend payable thereon.

(d) Where bets are returnable, they shall be returnable only on presentation of the appropriate ticket whole and not unreasonably defaced or unrecognisable save that if after inquiry the operator is of opinion that a totalisator ticket in respect of which a sum would be distributable or repayable has been lost or mislaid the operator may at his discretion and subject to any conditions he thinks fit to impose, pay such sum to any person who applies for payment within a period of one month after the ticket was issued and who appears to be the person properly entitled to payment.

(e) Whenever a totalisator ticket, to the holder of which a sum would be distributable or repayable under these regulations, if not presented for payment at the place prescribed and within the time limit imposed by these regulations such sum shall become the property of the operator at the expiration of the said time limit.

(f) In the event of a dispute arising with regard to any ticket or bet, or any other matter whatsoever in these regulations, the decision of the operator shall be final and binding.

7 Objections and Disqualifications.

7. No dividend shall be declared or paid except on the order of the operator and when he has ordered the dividend or dividends to be paid on any greyhound or greyhounds in any race or in any double or multiple event, no person who has made a bet on any other greyhound or greyhounds in such race or in the double or multiple event shall be entitled to receive a dividend notwithstanding that by a subsequent decision of the stewards, another greyhound or greyhounds shall be declared to be the winner or winners or to have been placed in such race or races instead of the greyhound or greyhounds declared to be the winner or winners or to have been placed when the order of finish was shown, any rule of law or rule of racing to the contrary notwithstanding.

8 Race not run or declared a "No Race.".

8. Otherwise than in a double or multiple event all bets staked in a race not run or declared a " No Race " shall be valid for the re-run race should such re-run race take place at that race meeting. If such race or " no race " be not re-run at that meeting then all bets shall be returnable in full.

9 Abandoned Race.

9. Otherwise than in a double or multiple event all bets staked in a race subsequently abandoned shall be returnable in full.

10 Withdrawn Greyhound.

10. Otherwise than in a double or multiple event if a greyhound or greyhounds be withdrawn from a race after the opening of betting on the race, all bets on the greyhound or greyhounds so withdrawn shall be returnable in full and shall be deducted from the appropriate pools before calculation of the dividends. In the event, however, of the remaining runners amounting to less than four in the Place Pool or less than three in the Forecast Pool or less than two in the Win Pool, all bets in the pool or pools so affected shall be returnable in full.

11 Reserve Greyhound.

11. Should a reserve greyhound be declared a runner to replace a greyhound withdrawn from a race, such reserve greyhound shall be deemed a runner for the purpose of betting on all pools in such race.

12 Close of Betting

12. Bets shall not be taken on the totalisator after the start of the race.

13 Displayed Figures.

13. The totals of units shown on the public visual indicator shall not necessarily be taken as the total amount staked upon which dividends will be calculated since before the declaration of any dividend an allowance may have to be made for non-starters, tickets issued in error and other causes.

14 Uncompleted Bet.

14. Where a person purchasing a number of tickets receives only some of the required tickets and the totalisator operator fails to issue the remainder either because the race has started or the machine has developed a fault, the tickets issued are valid and the person is entitled only to a refund of his stake in respect of the tickets not issued.

15 Acceptance of Bet.

15. No bet made by means of a totalisator shall be retracted or withdrawn after the issue from such totalisator of a totalisator ticket in respect of such bet and the ticket so issued shall be conclusive evidence of the making of the bet, the amount thereof and of the totalisator pool on which the bet was made.

16 Cancellation of Pools.

16. Notwithstanding anything contained in these regulations, the operator may, after the commencement of betting in any pool arising out of an act of God, unlawful act of any person, riot, civil commotion, fire, strike, mechanical breakdown of the totalisator or any part thereof, or any other cause, cancel such pool or pools and the bets staked in the cancelled pool or pools shall be refundable in full.

PART II.Win Pool.

17 Number of Runners.

17. Win pools shall be held only on races in which there are at least two advertised runners.

18 Calculation of Dividend.

18. The dividend in the win pool shall be calculated by dividing the net pool by the number of units on the winning greyhound.

19 No unit on winning greyhound or greyhounds.

19. (a) In the event of there being no unit on the winning greyhound or greyhounds, the dividend shall be declared on the next greyhound or greyhounds in order of finish on which bets have been made.

(b) In the event of there being no unit on any of the placed greyhounds the dividend shall be declared on the next greyhound or greyhounds in order of finish on which bets have been made.

(c) Where a dividend is declared under this Article on greyhounds that have run a dead-heat, the dividend shall be calculated in the same manner as in the event of a dead- heat for First Place.

20 Dead-heat.

20. (a) In the event of a dead-heat for first place, the net pool shall be divided into as many equal portions as there are greyhounds that have run the dead-heat. The dividends shall then be calculated by dividing each portion by the number of units on the dead-heating greyhound to which it refers.

(b) In the event of there being no unit on one or more of the greyhounds dead-heating for first place, the net pool shall be divided into as many equal portions as there are dead- heating greyhounds on which there are units. The dividends shall then be calculated by dividing each portion by the number of units on the dead-heating greyhound to which it refers.

PART III.Place Pool.

21 Number of Runners.

21. (a) Place pools shall be held only on races in which there are at least four advertised runners.

(b) Dividends for the place pool shall be paid on two places.

22 Calculation of Dividends.

22. The dividends in the place pool shall be calculated as follows:—

After deducting from the net pool the value of the units on both the placed greyhounds, the balance shall be divided into two equal portions and each portion shall then be divided by the number of units on the greyhound to which it refers. To the resultant in each case shall be added the value of the unit as previously deducted.

23 Dead-heat.

23. (a) (i) If two greyhounds dead-heat for first place, such greyhounds shall be deemed the " placed greyhounds " for the purpose of the place pool and the dividends shall be calculated in accordance with Article 22 of these regulations.

(ii) If more than two greyhounds dead-heat for first place the dividends shall be calculated as follows:—

After deducting from the net pool two-thirds of the value of the units on the greyhounds dead-heating if three greyhounds have so dead-heated—or one half if four greyhounds have so dead-heated—the remainder shall be divided into as many equal portions as there are greyhounds dead-heating. Each of these portions shall then be divided by the number of units on the dead-heating greyhound to which it refers and to the resultant in each case shall be added the part value of the unit on the dead-heating greyhound as previously deducted.

(b) In the event of a dead-heat for second place the dividends shall be calculated as follows:—

After deducting from the net pool the value of the units on the first placed greyhound together with half the value of the units on the two greyhounds dead-heating for second place (one-third if there are three greyhounds, or proportionately if there are more) the balance shall be divided into two equal portions. One of these portions shall be divided by the number of units on the first placed greyhound and to the resultant shall be added the full value of the unit on the first placed greyhound as previously deducted. The other portion shall be divided into as many equal portions as there are greyhounds that have run the dead-heat for second place. Each of these latter portions shall then be divided by the number of units on the dead-heating greyhound to which it refers and to the resultant in each case shall be added the part value of the unit on the dead-heating greyhound as previously deducted.

24 Only one greyhound placed.

24. If only one greyhound is placed the whole of the net pool shall be divided by the number of units on such greyhound and the dividend shall be calculated as though the event were a win pool.

25 No unit on a placed greyhound or greyhounds.

25. (a) In the event of there being no unit on a placed greyhound the dividend or dividends shall be declared by reference to the other placed greyhound or greyhounds on which there are units.

(b) In the event of there being no unit on any of the placed greyhounds, the dividend will be declared on the next greyhound or greyhounds in order of finish on which bets have been made.

PART IV.Forecast Pool.

26 Number of Runners.

26. Forecast pools shall be held only on races in which there are at least three advertised runners.

27 Calculation of Dividend.

27. The dividend in the forecast pool shall be calculated by dividing the net pool by the number of units on the winning combination.

28 Dead-heat.

28. (a) In the event of a dead-heat for first place, such dead-heating greyhounds shall be deemed the " winning combination " for the purpose of the forecast pool and the dividends shall be calculated by dividing the net pool into as many equal portions as there are winning combinations. Each portion shall then be divided by the number of units on the winning combination to which it refers.

(b) In the event of the dead-heat for second place, the winning greyhound coupled with each of the dead-heating greyhounds shall be deemed " winning combinations " for the purpose of the forecast pool and the dividends shall be calculated by dividing the net pool into as many equal portions as there are winning combinations. Each portion shall then be divided by the number of units on the winning combination to which it refers.

29 No unit on a winning combination or combinations.

29. (a) In the event of a dead-heat for first or second place and of there being no unit on one or more but not all of the winning combinations, the dividend or dividends shall be calculated by dividing the net pool into as many equal portions as there are winning combinations on which there are units and each portion shall then be divided by the number of units on the winning combination to which it refers.

(b) In the event of there being no unit on any of the winning combinations the dividend shall be calculated by dividing the net pool by the number of units on all combinations which have nominated the winning greyhound or failing such nominations then on all combinations which have correctly nominated the second greyhound.

30 Only one greyhound placed.

30. If only one greyhound is placed, the dividend shall be calculated by dividing the net pool by the number of units on all combinations which have correctly nominated the winning greyhound.

PART V.Double Event Pool.

31 Number of Runners.

31. Double event pools shall be held only on races in which there are at least two advertised runners.

32 Issue of Tickets.

32. Where separate tickets are issued in respect of each race in the double event, bets for the first race shall only be made up to the time of the start of that race. Holders of a winning ticket for the first race of the double event shall exchange their tickets for a ticket bearing a greyhound number in the second race of the double event. Such tickets shall be exchanged up to the time of the start of the second race of the double event. All persons making bets on the first selected race shall pay the full amount of the betting unit and no further payment shall be made in respect of the ticket for the second selected race.

33 Calculation of Dividend.

33. The dividend in the double event shall be calculated by dividing the net pool by the number of units on the winner of the second selected race.

34 Dead-heat.

34. (a) In the event of a dead-heat for first place in the first selected race all tickets bearing the number or numbers of the greyhounds dead-heating shall be exchangeable for the second selected race.

(b) In the event of a dead-heat for first place in the second selected race, the dividend shall be calculated by dividing the net pool into as many equal portions as there are greyhounds dead-heating. Each portion will then be divided by the number of units on such greyhounds.

35 No unit on winner.

35. (a) If, after the completion of the first selected race, the winner is unbacked then all tickets issued on the losing greyhounds shall become exchangeable tickets.

(b) If, after completion of the second selected race, the winners of the first and second selected races have been unbacked, the holders of tickets on the next greyhound in the order of finish in the second selected race on which there are units shall be entitled to a dividend calculated by dividing the net pool by the number of units on such greyhound.

(c) If, after the completion of the second selected race, there has been no ticket exchanged on the winner, then holders of all tickets on the second selected race shall be entitled to a dividend, calculated by dividing the net pool by the number of units on the winner of the first selected race. The resultant dividends shall be paid on presentation of tickets issued for the second selected race or unexchanged winning tickets for the first selected race.

36 Withdrawn greyhounds.

36. (a) In the event of a greyhound or greyhounds being withdrawn from the first selected race after the opening of betting in the race all bets on the greyhound or greyhounds so withdrawn shall be returnable in full and shall be deducted from the pool before the calculation of the dividend. In the event of the number of remaining runners being less than two, then the pool shall be cancelled and all bets shall be returnable in full.

(b) If, after the opening of betting on the second selected race a greyhound is withdrawn, then the double event pool shall cease and a dividend shall be declared, calculated by dividing the net pool by the number of units on the winner of the first selected race. The resultant dividends shall be paid on presentation of tickets issued for the second selected race, or unexchanged winning tickets for the first selected race.

37 Failure to exchange Ticket.

37. Where the double event has been completed and where a winning ticket in the first selected race has not been exchanged, the stake shall be deducted from the pool and shall be refunded in full on presentation of the ticket. If, however, the double event is uncompleted and a dividend has been declared on the first selected race, then all winning tickets on the first selected race, whethed exchanged or not, shall qualify for a dividend calculated by dividing the net pool by the number of units on the winner of the first selected race. The resultant dividend shall be paid on presentation of tickets issued for the second selected race or unexchanged winning tickets for the first selected race.

38 Race not run or declared a "No Race".

38. (a) If the first selected race is declared a "no race" or is not held at all, then the double event shall become void and all stakes shall be returnable in full.

(b) If the second selected race is declared a "no race" or is not held at all or if for any reason the double event cannot be completed, the double event shall cease and a dividend shall be declared calculated by dividing the net pool by the number of units on the winner of the first selected race. The resultant dividend shall be paid on presentation of tickets issued for the second selected race or unexchanged winning tickets for the first selected race.

PART VI.Twin Double Pool.

39 Minimum number of Runners.

39. Twin Double Pools shall be held only on races in which there are at least two advertised runners.

40 Issue of Tickets.

40. Separate tickets shall be issued in respect of the first two selected races and the second two selected races in the pool. Bets for the first two selected races shall only be made up to the time of the start of the first selected race. Holders of tickets bearing the numbers of the winning greyhounds in the first two selected races shall exchange their tickets up to the time of the start of the third selected race of the pool for a ticket bearing a combination in the second two selected races. All persons making bets on the first two selected races shall pay the full amount of the betting unit and no further payment shall be made in respect of the tickets for the second two selected races.

41 Calculation of Dividend.

41. The dividend shall be calculated by dividing the net pool by the total number of units on the winning combination or combinations of the second two selected races where the winning combination or combinations are unbacked and the operator decides to proceed under Article 43 (b) of these regulations, then the sum to be distributed under that article shall be calculated on the combination or combinations containing the winning greyhounds in such number of races in the pool as the operator may determine.

42 Dead-Heat.

42. In the event of a dead-heat for first place in any of the selected races such dead-heating greyhounds shall be deemed the winners of that selected race.

43 No unit on winning combination or combinations.

43. If after the completion of the first two or the second two selected races the winning combination or combinations are unbacked, then the operator may at his discretion—

(a) carry forward the net pool to be added either in whole or in such parts as the operator may determine to the net pool in a subsequent Twin Double Pool whether at the same or another greyhound race track; or

(b) carry forward the net pool in the manner provided in sub-paragraph (a) of this Article, less such sum as the operator may decide to distribute amongst the holders of tickets who have nominated the winning greyhounds in such number of races in the pool as the operator may determine.

44 Withdrawn Greyhounds

44. (a) If a greyhound is withdrawn in the first or the third selected races in the pool then the tickets bearing the number of the withdrawn greyhound shall be exchanged for tickets in the first or third selected races as the case may be.

(b) If a greyhound is withdrawn in the second or the fourth selected races in the pool then the tickets bearing the number of the withdrawn greyhound together with the winning greyhound of the first selected race or the third selected race, as the case may be, shall be exchangeable for tickets bearing a combination of the winner of the first or third selected races, as the case may be, together with a greyhound advertised as a runner in the respective races.

45 Race not run or declared a "No Race'.

45. (a) In the event of any of the selected races not being run or being declared a " no race " then the pool shall be operated on the remaining selected races.

(b) In the event of any three of the four selected races not being run or being declared a " no race " then the pool shall be cancelled and the total amount staked in the pool at that meeting shall be refunded on presentation of the tickets.

46 Abandoned or postponed Meeting.

46. In the event of a meeting being abandoned or postponed before the completion of the second selected race then the pool shall be cancelled and the total amount staked in the pool at that meeting shall be refunded on presentation of the tickets.

47 Failure to exchange Tickets.

47. (a) Where exchangeable tickets have not been exchanged, the amount of the stakes for such unexchanged tickets shall be deducted from the pool and shall be refunded on presentation of the tickets.

(b) No liability can be accepted by the operator in the event of the holder of an exchangeable ticket failing, for any reason, to exchange such ticket.

PART VII.Quinella Forecast Pool.

48 Minimum number of Runners.

48. Quinella forecast pools shall be held only on races in which there are at least three advertised runners. If for any reason there are less than three runners in any of the selected races then the pool shall be operated on the remaining selected races.

49 Issue of Tickets.

49. Separate tickets shall be issued in respect of each selected race in the pool. Bets for the first selected race shall only be made up to the time of the start of that race. Holders of winning tickets shall exchange their tickets for a ticket bearing the combination of their choice in the next selected race. All persons making bets on the first selected race shall pay the full amount of the betting unit and no further payment shall be made in respect of the tickets for the remaining selected races.

50 Calculation of Dividend.

50. The dividend shall be calculated by dividing the net pool by the number of units on the winning combination or combinations of the last selected race or where Article 52 of these regulations applies on the such earlier selected race as the operator may determine.

51 Dead-heat.

51. (a) In the event of a dead-heat for first place in any of the selected races, such dead-heating greyhounds shall be deemed the winning combination and all tickets bearing a combination of the greyhounds dead-heating shall be exchangeable for the next selected race or qualify for a dividend as the case may be.

(b) In the event of a dead-heat in any of the selected races for second place all tickets bearing, in either order, the number of the winning greyhound and any of the greyhounds dead-heating for second place shall be exchangeable for the next selected race or entitled to a dividend as the case may be.

52 No unit on winning combination or combinations.

52. If after the completion of any of the selected races, the winning combination or combinations are unbacked, then the operator may at his discretion:—

(a) carry forward the net pool to be added either in whole or in such parts as the operator may determine to the net pool in a subsequent Quinella Forecast Pool whether at the same or another greyhound race track; or

(b) carry forward the net pool in the manner provided in sub-paragraph (a) of this Article, less such sum as the operator may decide to distribute amongst the holders of tickets who have nominated the winning combinations in such number of races in the pool as the operator may determine.

53 Withdrawn Greyhounds.

53. If, after the opening of betting in any of the selected races a greyhound is withdrawn, then the tickets issued for that race bearing the number of the withdrawn greyhound shall become exchangeable tickets for that race or refundable tickets at the option of the holder.

54 Race not run or declared a "No Race".

54. In the event of any of the selected races not being run or being declared a "no race" then the pool shall be operated on the remaining selected races.

55 Minimum number of selected Races.

55. If, for any reason less than two of the selected races are run, then the pool shall be cancelled and the total amount staked in the pool at that meeting shall be refunded on presentation of the appropriate tickets.

56 Failure to exchange Tickets.

56. (a) Where winning tickets in the selected races have not been exchanged, the amount of the stakes for such unexchanged tickets shall be deducted from the pool and shall be refunded on presentation of the tickets.

(b) No liability can be accepted by the operator in the event of the holder of a winning ticket failing, for any reason, to exchange such winning ticket.

57 Only one placed Greyhound.

57. In the event of there being only one placed greyhound in any of the selected races, then tickets including the number of such placed greyhound shall be exchangeable for the next selected race or shall qualify for a dividend as the case may be.

PART VIII.Jackpot Pool.

58 Purchase of Tickets.

58. (a) Jackpot tickets consisting of two detachable parts:—

(a) the ticket portion and (b) the counterfoil portion, numbered identically, may be purchased at the totalisator at a meeting where the pool is operated;

(b) Jackpot tickets as follows may be purchased at the totalisator at a meeting where the pool is operated:—

(i) a single unit ticket on which the purchaser may nominate one greyhound in each selected race in the pool;

(ii) a ticket of a declared number of units on which the purchaser may nominate as many greyhounds in each selected race of the pool as provided for on such ticket; and

(iii) a combination ticket for such amount as the purchaser may wish to bet so that the purchaser may have one unit on every combination of the greyhounds nominated for each selected race of the pool.

59 Completion of Tickets.

59. (a) In the case of tickets referred to at Article 58 (b) (i) and 58 (b) (ii) of these regulations, the purchaser shall legibly insert in the appropriate spaces on the ticket the race card numbers of the greyhounds being advertised runners, which he nominates to win and shall legibly insert the same numbers on the counterfoil portion of the ticket in the spaces provided for that purpose.

(b) In the case of the combination ticket referred to at Article 58 (b) (iii) of these regulations, the purchaser shall inform the totalisator officer from whom the ticket is purchased of the nominations required, the greyhounds nominated to be advertised runners. On completion of the ticket by the totalisator officer, the ticket portion shall be retained by the operator and the purchaser shall check the counterfoil before leaving the window to ensure that his nominations are correctly entered and the operator shall not afterwards be liable for any mistakes in the completion of the ticket.

60 Posting of Tickets.

60. (a) In the case of tickets referred to at Article 58 (b) (i) and 58 (b) (ii) of these regulations, the purchaser shall detach the ticket portion and place it in the receptacle provided prior to the first race in the pool or dispose of it as may be otherwise directed by the operator.

(b) Should the counterfoil portion be inadvertently placed in the receptacle, the operator may at his discretion regard the counterfoil as a valid ticket portion.

(c) Except as provided in Article 61 of these regulations, no amendment or alteration may be made in any ticket which has been posted as aforesaid or in any completed combination ticket.

61 Excess Combinations on ticket.

61. If the number of combinations nominated on a ticket is in excess of the number authorised by the sum bet on that ticket at the time of purchase thereof, the operator may at his discretion, deem the ticket a losing ticket or may reduce the number of combinations on the ticket in the following manner:—

(a) if more than one greyhound or combination is nominated for the selected races on a single unit ticket then the greyhounds or combinations below the one nearest the top of the columns shall be deleted;

(b) if more than the authorised number of combinations are nominated on a ticket referred to in Article 58 (b) (ii) of these regulations, then the combination or combinations in excess of the authorised number nearest the bottom of the columns shall be deleted.

62 Vacant spaces on Tickets.

62. If any of the spaces provided on a ticket referred to in Article 58 (b) (ii) of these regulations are not used, each vacant space shall be deemed to contain the selection entered in the nearest space above in which an entry has been made for the same race.

63 Indecipherable or Ambiguous Entries.

63. (a) If in the opinion of the operator any entry made by a purchaser on a ticket is indecipherable or ambiguous the combination to which such entry relates shall be regarded for by Article 60 of these regulations; or

(b) Any combination on a ticket which includes an entry other than a number of a greyhound advertised as a runner in such race shall be regarder as a losing combination.

64 Tickets valid only at meeting where purchased.

64. Tickets purchased at a meeting may be used only at that meeting and except as provided in Article 72 of these regulations no refund of the purchase price or any part thereof shall be made.

65 Lost or mislaid Tickets.

65. The operator, his officers or servants shall not be liable if, for any reason whatsoever:—

(a) the purchaser fails to post a completed ticket as provided as a losing one.

(b) a completed ticket is lost or mislaid.

66 Dead-Heat.

66. In the event of a dead-heat for first place in any of the selected races, the dead-heating greyhounds shall be deemed the winners of that selected race.

67 No unit on winning combination or combinations.

67. If after the completion of the selected races in the pool, the winning combination or combinations are unbacked then the operator may at his discretion:—

(a) carry forward the net pool to be added either in whole or in such parts as the operator may determine to the net pool in a subsequent Jackpot Pool whether at the same or another greyhound track; or

(b) carry forward the net pool in the manner provided in sub-paragraph (a) of this Article, less such sum as the operator may decide to distribute amongst the holders of tickets who have nominated a combination containing the winning greyhounds in such number of races in the pool as the operator may determine.

68 Calculation of Dividend.

68. The dividend shall be calculated by dividing the net pool by the total number of units on the winning combination or combinations of the selected races. Where the winning combination or combinations are unbacked and the operator decides to proceed under Article 67 (b) of these regulations, then the sum to be distributed under that article shall be calculated on the combination or combinations containing the winning greyhounds in such number of races in the pool as the operator may determine.

69 Payment of Dividends.

69. Dividends shall be payable on presentation of the appropriate counterfoil portions of winning tickets whole and not unreasonably defaced or unrecognisable.

70 Withdrawn Greyhounds.

70. (a) If a greyhound is withdrawn from any of the selected races then the tickets bearing the number of the withdrawn greyhound shall be deemed to contain in lieu thereof, the race card number of the greyhound running in that race upon which the greatest number of units has been staked in the Totalisator Win Pool operated on that race.

(b) If an equal number of units in such Win Pool has been staked on two or more greyhounds running in that race, and if the number is greater than the number of units staked in such Win Pool on any other runner in that race, then any ticket containing the race card number of any greyhound withdrawn as aforesaid from that race, shall be deemed to contain, in lieu thereof, the numerically lowest race card number of such equally backed greyhounds.

(c) If for any reason it is, in the opinion of the operator, not possible to determine the number of the greyhound which should be substituted, every ticket containing the race card number of a greyhound withdrawn, shall be deemed to contain in lieu thereof the race card number of such greyhound as may be determined by the operator.

71 Race not run or declared a "No Race".

71. In the event of any of the selected races not being run or being declared a " no race " then the pool shall be operated on the remaining selected races.

72 Minimum number of selected Races.

72. If for any reason, less than three of the selected races in the pool are run, then the pool shall be cancelled and the total amount staked in the pool at that meeting shall be refunded on presentation of the appropriate counterfoil portions of tickets whole and not unreasonably defaced or unrecognisable.

PART IX.Miscellaneous.

73 Revocation.

73. The following regulations are hereby revoked:—

The Greyhound Race Track (Totalisator) (Operating) Regulations, 1960 ( S.I. No. 65 of 1960 ).

The Greyhound Race Track (Totalisator) (Operating) (Amendment) Regulations, 1963 ( S.I. No. 33 of 1963 ).

The Greyhound Race Track (Totalisator) (Twin Double) Regulations, 1966 ( S.I. No. 89 of 1966 ).

The Greyhound Race Track (Totalisator) (Quinella Treble Forecast) Regulations, 1966 ( S.I. No. 90 of 1966 ).

The Greyhound Race Track (Totalisator) (Jackpot) Regulations, 1969 ( S.I. No. 104 of 1969 ).

74 Citation and Commencement.

74. (a) These regulations may be cited as the Greyhound Race Track (Totalisator) (Operating) Regulations, 1971.

(b) These regulations shall come into operation on the 15th day of February, 1971.
