ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF KILKENNY) REGULATIONS, 1968.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) and as respects article 7 after consultation with the Commissioner of the Garda Síochána and the road authority concerned and as respects article 5 on the application of the said Commissioner hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Kilkenny) Regulations, 1968.

2 Commencement.

2. These Regulations shall come into operation on the 1st day of June, 1968.

3 Interpretation.

3. In these Regulations save where the context otherwise requires

"the Act" means the Road Traffic Act, 1961 ;

"road" means a public road ;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town ;

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following :—

(a) ambulances,

(b) fire brigade vehicles, and

(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation.

7. Articles 5 and 6 of the Road Traffic (Speed Limits) Regulations, 1963 ( S.I. No. 18 of 1963 ) in so far as they relate to roads in the County of Kilkenny are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the town of Callan :

(a) Upper Haggardsgreen, Lower Haggardsgreen, The Ballywalter Road.

(b) The Kilkenny Road for a distance of 250 yards from the town boundary.

(c) The Minnauns Road for a distance of 535 yards from the town boundary.

(d) The Coolagh Road between the town boundary and a point 100 yards south-east of its junction with the Clonmel Road.

(e) The Clonmel Road between the town boundary and a point 90 yards south-west of its junction with the Coolagh Road.

(f) Chapel Lane between its junction with the Carrabine Bridge Road and a point 45 yards north-west of its junction with Green Street.

(g) The Carrabine Bridge Road for a distance of 140 yards from the point where the town boundary intersects the northern side of the road.

(h) The laneway leading from the Carrabine Bridge Road to the King's River.

(i) Flaggy Lane between its junction with Upper Haggardsgreen and a point 30 yards west of its junction with Lower Bridge Street.

2. The following roads in the Borough of Kilkenny :

(a) The Old Glendine Road, The New Glendine Road, The Castleinch Road.

(b) The Castlecomer Road for a distance of 1,300 yards from the Borough boundary.

(c) The Dublin Road between the Borough boundary and a point 30 yards south-east of its junction with O'Loughlin Road.

(d) College Road and its continuation as the Callan Road for a distance of 900 yards from the Borough boundary.

(e) The Circular Road between the Borough boundary and a point 20 yards south-east of its junction with the Castleinch Road.

(f) The Ballycallan Road for a distance of 180 yards from the Borough boundary.

SECOND SCHEDULE.

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Ballyhale :

(a) The Kilkenny-Waterford road between a point 300 yards north-west of its junction with the Coolmore Road and a point 185 yards south of the said junction.

(b) The Coolmore Road for a distance of 50 yards from its junction with the Kilkenny-Waterford road.

2. The following roads at Ballyragget :

(a) The Square, The Fair Green.

(b) Castle Street and its continuation as the Kilkenny Road for a distance of 725 yards from the junction of Castle Street with the Square.

(c) High Street and its continuation as the Castlecomer Road for a distance of 400 yards from the junction of High Street with Patrick Street.

(d) Patrick Street and its continuation as Smith's Road for a distance of 130 yards from the junction of Patrick Street with High Street.

(e) Moat Street and its continuation as the Moatpark Road between the junction of Moat Street with the Square and a point 140 yards north of the junction of the Moatpark Road with the Fair Green.

(f) Bridge Street and its continuation as the Durrow Road between the junction of Bridge Street with the Square and a point 35 yards east of the junction of the Durrow Road with the Freshford Road.

3. The following roads at Bennettsbridge :

(a) The Ring, Marian Terrace.

(b) The Thomastown-Kilkenny Road between a point 80 yards west of its junction with the Tullaherin Road and a point 90 yards east of its junction with the Annamult Road.

(c) The Gowran Road for a distance of 400 yards from its junction with the Kilkenny-Thomastown road.

(d) The Maddockstown Road for a distance of 80 yards from its junction with the Gowran Road.

4. The following roads adjacent to the town of Callan :

(a) Fair Green Lane.

(b) Mill Street and its continuation as the Dunnamaggan Road for a distance of 150 yards from the point where the boundary of the town of Callan intersects the north-eastern side of the road.

(c) The easternmost laneway leading from Mill Street to the King's River.

5. The following roads at Castlecomer :

(a) Market Lane, Market Square, Mill Lane, The Glebe, Love Lane, Maryville Housing Scheme.

(b) The Kilkenny-Dublin road between a point 120 yards south of its junction with Hospital Lane and a point 525 yards east of its junction with Barrack Street.

(c) Barrack Street and its continuation as the Ballyragget Road between the junction of Barrack Street with the Kilkenny-Dublin road and a point 200 yards north-west of the junction of the Ballyragget Road with Love Lane.

(d) The Old Road between its junction with the Ballyragget Road and a point 20 yards west of its western junction with the Glebe.

(e) Hospital Lane for a distance of 155 yards from its junction with the Kilkenny-Dublin road.

(f) Chatsworth Row between its junction with the Kilkenny-Dublin road and a point 35 yards south of its junction with the Skehana Road.

6. The following roads at Fiddown :

(a) The Waterford-Carrick-on-Suir road between a point 30 yards north of its junction with the Strand Road and a point 225 yards north-west of its junction with the Rathmore Road.

(b) The Rathmore Road for a distance of 100 yards from its junction with the Waterford-Carrick-on-Suir road.

7. The following roads at Freshford :

(a) The Square.

(b) The Kilkenny-Thurles road between a point 125 yards south-east of its junction with the Clintstown Road and a point 230 yards west of its junction with Bohergloss Street.

(c) The Clintstown Road for a distance of 40 yards from its junction with the Kilkenny-Thurles road.

(d) The Moat Road for a distance of 75 yards from its junction with the Uppercourt Road.

(e) Chapel Street and its continuation as the Uppercourt Road for a distance of 280 yards from the junction of Chapel Street with the Kilkenny-Thurles road.

(f) Buncrusha Street and its continuation as the Ballylarkin Road for a distance of 750 yards from the junction of Buncrusha Street with the Kilkenny-Thurles road.

(g) The road connecting Buncrusha Street with the Kilkenny-Thurles Road.

(h) Bohergloss Street and its continuation as the Ballyragget Road for a distance of 300 yards from the junction of Bohergloss Street with the Kilkenny-Thurles road.

8. The following roads at Goresbridge :

(a) Chapel Street, Cluin Mhuire Road.

(b) The Borris-Gowran road between the centre point of the Barrow Bridge and a point 380 yards west of its junction with Barrack Street.

(c) Barrowmount Road for a distance of 200 yards from its junction with the Borris-Gowran road.

(d) Barrack Street and its continuation as the Carlow Road for a distance of 200 yards from the junction of Barrack Street with the Borris-Gowran road.

9. The following roads at Gowran :

(a) The Carlow-Waterford road between its junction with the Goresbridge Road and a point 50 yards south of its junction with the Chapel Road.

(b) The Mill Road for a distance of 70 yards from its junction with the Carlow-Waterford road.

(c) The Kilkenny Road for a distance of 180 yards from its junction with the Carlow-Waterford road.

(d) The Chapel Road between its junction with the Carlow-Waterford road and a point 110 yards south of its junction with the Kilkenny Road.

10. The following roads at Graiguenamanagh :

All roads in the area enclosed by a line commencing at a point on the Carlow Road 100 yards north of its junction with the Thomastown Road and drawn thence in straight lines successively to the following points :—

(a) the northwesternmost point of the Fairview Cottages Road,

(b) a point on the Killeen Road 50 yards north of its northern junction with the Fairview Cottages Road,

(c) a point on the Ullard Road 380 yards north-east of its junction with Barrow Lane,

(d) the easternmost point of the Quay,

(e) the centre point of Graiguenamanagh Bridge,

(f) a point on the New Ross Road 60 yards south of its junction with the Inistioge Road,

(g) a point on the Inistioge Road 60 yards west of its junction with the New Ross Road,

(h) a point on the Thomastown Road 40 yards north-west of its junction with the Carlow Road

and from the last-mentioned point in a straight line to the commencement point on the Carlow Road.

11. The following roads at Inistioge :

(a) Hatchery Lane, The Square.

(b) The Thomastown-New Ross road between a point 350 yards north of its junction with the Killeen Road and a point 50 yards west of its junction with the Cappagh Road.

(c) The Killeen Road for a distance of 370 yards from its junction with the Thomastown-New Ross road.

(d) The Ballyduff Road for a distance of 300 yards from its junction with the Killeen Road.

12. The following roads at Johnstown :

(a) The Square.

(b) The Dublin-Cork road between a point 700 yards north-east of its junction with the Kilkenny Road and a point 240 yards south-west of the said junction.

(c) The Kilkenny Road for a distance of 90 yards from its junction with the Dublin-Cork road.

(d) The Canal Road for a distance of 90 yards from its junction with the Dublin-Cork road.

13. The following roads adjacent to the Borough of Kilkenny :

(a) The Mount Brilliant Road, The New Road, The Old Golf Links Road, The Newpark Cottages Road, Lover's Lane, Asylum Lane, Coote's Lane, Park View Road, O'Loughlin Road.

(b) The Kilkieran Road for a distance of 50 yards from its junction with the Old Golf Links Road.

(c) The Johnswell Road for a distance of 85 yards from its junction with the Old Golf Links Road.

(d) The Cellarstown Road between the boundary of the Borough of Kilkenny and a point 15 yards east of its junction with O'Loughlin Road.

(e) The Waterford Road for a distance of 45 yards from the boundary of the Borough of Kilkenny.

(f) The Kells Road where the said road is a perimeter road.

(g) The Tullaroan or Bonnetstown Road for a distance of 75 yards from the boundary of the Borough of Kilkenny.

(h) The Granges Road for a distance of 270 yards from the boundary of the Borough of Kilkenny.

(i) The Bleach Road for a distance of 115 yards from the boundary of the Borough of Kilkenny.

(j) The continuation of Ballybought Street between the boundary of the Borough of Kilkenny and its junction with the New Road.

14. The following roads at Knocktopher :

(a) The Kilkenny-Waterford road between a point 150 yards south-east of its junction with the Kells Road and a point 65 yards south of its junction with the Thomastown Road.

(b) The Thomastown Road for a distance of 50 yards from its junction with the Kilkenny-Waterford road.

(c) The Kilmoganny Road for a distance of 80 yards from its junction with the Kilkenny-Waterford road.

15. The following roads at Mooncoin :

(a) The Pound Cottages Road.

(b) The Waterford-Carrick-on-Suir road between a point 200 yards east of its junction with the Doornane Road and a point 330 yards north-west of its junction with the Pollrone Road.

(c) The Doornane Road for a distance of 150 yards from its junction with the Waterford-Carrick-on-Suir road.

(d) The Grange Road for a distance of 50 yards from its junction with the Waterford-Carrick-on-Suir road.

(e) Chapel Street for a distance of 260 yards from its junction with the Waterford-Carrick-on-Suir road.

(f) The road leading from the northern side of the Waterford-Carrick-on-Suir road at a point approximately 300 yards north-west of the junction of the latter road with the Pollrone Road.

(g) The Pollrone Road for a distance of 75 yards from its junction with the Waterford-Carrick-on-Suir road.

16. The following roads at Mullinavat :

(a) The Waterford-Kilkenny road between a point 20 yards north of its junction with the Creamery Road and a point 80 yards north of its junction with the New Ross Road.

(b) The Piltown Road for a distance of 50 yards from its junction with the Waterford-Kilkenny road.

(c) The Glenmore Road for a distance of 120 yards from its junction with the Waterford-Kilkenny road.

17. The following roads at Piltown :

(a) The Creamery Road.

(b) The Waterford-Carrick-on-Suir road between a point 140 yards north-west of its junction with the Ardclone Road and a point 360 yards west of its junction with Kerr's Road.

(c) The Kilmoganny Road between its junction with the Waterford-Carrick-on-Suir road and a point 125 yards south-east of its junction with Kerr's Road.

(d) Kerr's Road for a distance of 60 yards from its junction with the Waterford-Carrick-on-Suir road.

(e) The Tibberaghny Road for a distance of 75 yards from its junction with the Waterford-Carrick-on-Suir road.

18. The following roads at Slievroe :

(a) The New Ross-Waterford road between a point 250 yards north-east of its junction with the Kilmacow Road and a point 350 yards south-west of the said junction.

(b) The Kilmacow Road for a distance of 150 yards from its junction with the New Ross-Waterford road.

(c) The road leading from the southern side of the New Ross-Waterford road at a point approximately 50 yards north-east of the junction of the latter road with the Kilmacow Road.

19. The following roads at Thomastown :

All roads in the area enclosed by a line commencing at a point on the Kilkenny Road 100 yards north of Lady's Well Cross Roads and drawn thence in straight lines successively to the following points :—

(a) a point on the Carlow Road 150 yards north of its junction with Newtown Terrace,

(b) a point on Chapel Lane 140 yards east of its junction with Maudlin Street,

(c) a point on the Quay 180 yards east of its junction with Logan's Street,

(d) a point on the Creamery Road 425 yards south-east of its junction with the Ballyhale Road,

(e) a point on the Ballyhale Road 200 yards south-west of its junction with the Creamery Road,

(f) a point on the Station Road 220 yards south-west of its junction with Market Street,

(g) a point on the Newtown Road 30 yards north-west of its junction with the Kilkenny Road

and from the last-mentioned point in a straight line to the commencement point on the Kilkenny Road.

20 The following roads at Urlingford :

(a) St. Mary's Terrace.

(b) The Dublin-Cork road between a point 100 yards north-east of its junction with the Kilkenny Road and a point 250 yards south-west of its junction with the Killenaule or Gortnahoe Road.

(c) The Killenaule or Gortnahoe Road for a distance of 100 yards from its junction with the Dublin-Cork road.

(d) The New Line for a distance of 200 yards from its junction with the Dublin-Cork road.

(e) Lumper Lane for a distance of 135 yards from its junction with the Dublin-Cork road.

(f) The Kilkenny Road for a distance of 100 yards from its junction with the Dublin-Cork road.

(g) Mill Street and its continuation as the Island Road for a distance of 230 yards from the junction of Mill Street with the Dublin-Cork road.

21. The following roads adjacent to the County Borough of Waterford :

(a) The Kilkenny or Dublin Road for a distance of 60 yards from the point where the boundary of the County Borough of Waterford intersects the northern side of the road.

(b) The Rockshire Road between the boundary of the County Borough of Waterford and a point 50 yards north of its junction with the Smartscastle Road.

(c) The Smartscastle Road for a distance of 300 yards from its junction with the Rockshire Road.

(d) The New Ross Road for a distance of 200 yards from the point where the boundary of the County Borough of Waterford intersects the south-eastern side of the road.

(e) The Abbey Road for a distance of 110 yards from the boundary of the County Borough of Waterford.

THIRD SCHEDULE.

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following road at Castlecomer :

The Kilkenny Road between a point 120 yards south of its junction with Hospital Lane and a point 460 yards south of the said junction.

2. The following roads in and adjacent to the Borough of Kilkenny:

( a ) The Castlecomer Road between a point 1,300 yards south-east of the boundary of the Borough of Kilkenny and a point 300 yards north of its junction with the New Glendine Road.

( b ) The Dublin Road between a point 30 yards south-east of its junction with O'Loughlin Road and a point 1,000 yards south-east of the boundary of the Borough of Kilkenny.

( c ) The Bennettsbridge Road for a distance of 480 yards south-east of the boundary of the Borough of Kilkenny.

( d ) The Waterford Road between a point 45 yards south of the boundary of the Borough of Kilkenny and a point 830 yards south of the said boundary.

( e ) College Road and its continuation as the Callan Road between a point 900 yards north-east of the boundary of the Borough of Kilkenny and a point 175 yards north-east of the said boundary.

( f ) The Freshford Road for a distance of 700 yards north-west of the boundary of the Borough of Kilkenny.

( g ) The Sion Road for a distance of 80 yards from its junction with the Dublin Road.

3. The following roads at Stoneyford:

( a ) The Kilkenny-Waterford road between a point 110 yards north-east of its junction with the Kells Road and a point 100 yards south-east of its junction with the Thomastown Road.

( b ) The Kells Road for a distance of 35 yards from its junction with the Kilkenny-Waterford road.

( c ) The Thomastown Road for a distance of 30 yards from its junction with the Kilkenny-Waterford road.

( d ) The Stonecarthy Road for a distance of 25 yards from its junction with the Kilkenny-Waterford road.

( e ) The Norelands Road for a distance of 30 yards from its junction with the Kilkenny-Waterford road.

4. The following road adjacent to the County Borough of Waterford:

The Kilkenny or Dublin Road between a point 60 yards west of the point where the boundary of the County Borough of Waterford intersects the northern side of the road and a point 220 yards north of its junction with the Newrath Road.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) Regulations, 1963 and 1965, in their application to the County of Kilkenny and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule for all mechanically propelled vehicles.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
