ROAD TRAFFIC (SPEED LIMITS) REGULATIONS, 1963.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 , 44 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) and, as respects Article 6, on the application of the Commissioner of the Garda Síochána hereby makes the following Regulations :—

1. These Regulations may be cited as the Road Traffic (Speed Limits) Regulations, 1963.

2. These Regulations shall come into operation on the 1st day of April, 1963.

3. In these Regulations, save where the context otherwise requires

" the Act " means the Road Traffic Act, 1961 ;

" road " means a public road;

" perimeter road " means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

" ordinary speed limit ", " special speed limit " and " built-up area speed limit " have the meanings respectively assigned to them in Part IV of the Act;

" distance " means distance as measured along the centre line of a road;

" station wagons " includes station wagons, estate cars and other similar vehicles which are constructed or adapted for alternative purposes (including the carriage of one or more passengers) and which are fitted with seats, whether rigid, collapsible or detachable, in the area to the rear of the driver's seat;

" passenger accommodation " means seating passenger accommodation determined in accordance with the provisions of the Road Traffic (Passenger Accommodation of Mechanically Propelled Vehicles) Regulations, 1962 ( S.I. No. 143 of 1962 ).

4. (1) There shall be a speed limit of fifty miles per hour in respect of all roads for—

(a) station wagons and

(b) single-decked mechanically propelled vehicles intended or adapted primarily for the carriage of passengers

which have passenger accommodation for more than eight persons.

(2) There shall be a speed limit of forty miles per hour in respect of all roads for double-decked mechanically propelled vehicles intended or adapted primarily for the carriage of passengers and having passenger accommodation for more than eight persons.

(3) There shall be a speed limit of forty miles per hour in respect of all roads for mechanically propelled vehicles not intended or adapted primarily for the carriage of passengers and which exceed two tons in weight unladen.

(4) (a) There shall be speed limits in respect of all roads for mechanically propelled vehicles drawing another vehicle or vehicles as follows :—

(i) where the drawn vehicle is attached to the mechanically propelled vehicle by way of partial superimposition, and no other vehicle is drawn, the speed limit shall be forty miles per hour;

(ii) where the drawn vehicle is not so attached, and no other vehicle is drawn, the speed limit shall be thirty-five miles per hour;

(iii) where there is more than one drawn vehicle the speed limit shall be twenty miles per hour.

(b) There shall be excepted from the speed limits prescribed in sub-paragraph (a) of this paragraph any mechanically propelled vehicle drawing not more than one vehicle the weight unladen of which does not exceed 5 cwts.

(5) A speed limit prescribed in this article shall not apply in respect of any road in respect of which a lesser speed limit is prescribed in the act or in these Regulations.

5. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the act.

6. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

7. There shall be excepted from the ordinary speed limits prescribed in Article 4 of these Regulations, from the special speed limit prescribed in Article 6 of these Regulations and from the built-up area speed limit the following :—

(a) ambulances,

(b) fire brigade vehicles, and

(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

8. The Bray Special Speed Limit Regulations, 1950 ( S.I. No. 69 of 1950 ) are hereby revoked.

FIRST SCHEDULE

ROADS DECLARED NOT TO BE PUBLIC ROADS IN A BUILT-UP AREA FOR THE PURPOSES OF SECTION 45 OF THE ACT.

COUNTY BOROUGH OF DUBLIN

The following roads in the County Borough of Dublin :—

(a) Clontarf Road.

(b) James Larkin Road.

(c) The Howth Road between a point 65 yards east of its junction with Brookwood Avenue and a point 150 yards west of its junction with the West Pier, Howth.

(d) Greenfield Road, Sutton.

(e) Carrickbrack Road between its junction with Greenfield Road and a point 100 yards north-west of its junction with Ceanchor Road.

(f) Strand Road, Baldoyle and its continuation along Main Street, Baldoyle, to the County Borough boundary.

(g) The part of the Grange Road at Baldoyle which lies inside the County Borough boundary for a distance of 730 yards from the point where the said boundary intersects the southern side of the road.

(n) The part of Ballymun Road which lies inside the County Borough boundary for a distance of 330 yards from the point where the said boundary intersects the eastern side of the road.

(o) The North Road for a distance of 800 yards from the County Borough boundary.

(p) Chapelizod Road.

(q) The part of Lucan Road which lies inside the County Borough boundary.

(r) St. Laurence Road, Chapelizod.

(s) Sarsfield Road between its junction with St. Laurence Road and its junction with Con Colbert Road.

(t) Con Colbert Road.

(u) The Ring Road between Kylemore Road railway bridge and its junction with the Long Mile Road.

(v) The Naas Road between its junction with Tyrconnell Road and the County Borough boundary.

(w) Davitt Road.

(x) The Long Mile Road between its junction with Lansdowne Valley and the County Borough boundary.

(y) The part of the main Dublin-Bray road which lies inside the County Borough boundary between a point 200 yards south-east of its junction with Beaver Row and the point where the said boundary intersects the northeastern side of the road.

(z) Merrion Road between a point 100 yards south-east of its junction with Sandymount Avenue and the County Borough boundary.

(aa) Ailesbury Road between its junction with Merrion Road and a point 165 yards west of its junction with Ailesbury Drive.

COUNTY BOROUGH OF LIMERICK

The following roads in the County Borough of Limerick :—

(a) The Limerick-Foynes road for a distance of 700 yards from the County Borough boundary at Bawney Bridge.

(b) The road from Sixmilebridge to Watch House Cross Roads for a distance of 950 yards from the County Borough boundary.

(c) The part of the Long Pavement which lies inside the County Borough boundary for a distance of 800 yards from the point where the said boundary intersects the eastern side of the road.

(d) The Tipperary Road for a distance of 700 yards from the County Borough boundary.

(e) The Kilmallock Road for a distance of 800 yards from the County Borough boundary.

(f) The part of the Roxboro' Road which lies inside the County Borough boundary for a distance of 550 yards from the point where the said boundary intersects the eastern side of the road.

(e) The Scotsman's Road between the town boundary and a point 100 yards south-west of its junction with Fairy Hill.

(f) The Laurel Hill Road between the town boundary and a point 50 yards from its junction with Hawkes' Hill.

7. The following roads in the Urban District of Skibbereen :—

(a) The part of each perimeter road which lies inside the Urban District boundary.

(b) The part of High Street and its continuation eastwards between the Urban District boundary and a point 100 yards east of the junction of High Street with St. Fachtna's Terrace.

(c) St. Fachtna's Terrace between its junction with Chapel Lane and a point 100 yards from its junction with High Street.

(d) Chapel Lane for a distance of 250 yards from the Urban District boundary.

(e) The Castletownsend Road between the Urban District boundary and a point 100 yards south-east of Creamery Cross Roads.

(f) The Baltimore Road between the Urban District boundary and a point 200 yards south-west of its junction with the Mardyke Road.

(g) The Compass Hill Road between Asollas Cross Roads and the Urban District boundary at Coronea.

(d) The part of the Bawnmore Road and its continuation south-westwards between a point 50 yards from Mental Hospital Cross and the Urban District boundary.

(e) The Kilcoran Road for a distance of 100 yards from its junction with the Bawnmore Road.

COUNTY OF DONEGAL

1. The following roads in the town of Ballyshannon :—

(a) The Rossnowlagh Road for a distance of 450 yards from the town boundary.

(b) The part of the Knather Road which lies inside the town boundary for a distance of 830 yards from the point where the said boundary intersects the southern side of the road.

(c) The Belleek Road for a distance of 500 yards from the town boundary.

(d) The part of the Station Road which lies inside the town boundary for a distance of 40 yards from the point where the said boundary intersects the north-eastern side of the road.

(e) The Rock Road for a distance of 410 yards from the town boundary.

(f) The part of the Sligo-Donegal road which lies inside the town boundary between a point 100 yards west of its junction with the Old Kinlough Road and the point where the said boundary intersects the northern side of the road.

2. The following roads in the Urban District of Buncrana :—

All roads in the Urban District of Buncrana other than those in the area enclosed by a line commencing at a point on the Urban District boundary at the Black Rock in the townland of Ballymacarry Lower and drawn thence in straight lines successively to the following points :—

(a) a point on the eastern edge of the Buncrana-Bridgend road 920 yards from the Urban District boundary at Luddon,

(b) a point on Maginn Avenue 420 yards from its junction with Lower Main Street,

(c) a point on the Lisona Road 300 yards from the Urban District boundary at Magherintoor,

(d) a point on the southern edge of Cassy Road 100 yards from its junction with the Cock Hill Road,

(e) a point on the eastern edge of the Cock Hill Road 150 yards north of its junction with Westbrook Road,

(f) a point on the north-eastern edge of Westbrook Road 200 yards from its junction with the Cock Hill Road,

(g) a point on the Urban District boundary due west of the seaward end of the Boat Slip approximately 200 yards south-east of Ned's Point

and from the last-mentioned point in a southerly direction along the Urban District boundary to the commencement point.

3. The following roads in the Urban District of Bundoran :—

(a) Bogtown Lane between the Urban District boundary and a point 50 yards from its junction with the Sligo-Ballyshannon road.

(b) The part of the Rock Road which lies inside the Urban District boundary.

(c) Bay View Terrace Lane for a distance of 410 yards from the Urban District boundary.

(d) The Kinlough or Chapel Road for a distance of 525 yards from the Urban District boundary.

(e) The part of the Ardfarn or Newtown Road which lies inside the Urban District boundary.

(f) The Drumacrin Road between the Urban District boundary and a point 230 yards from its junction with the Sligo-Ballyshannon road.

(c) The road leading in a north-easterly direction from the Glencar Irish Road at a point on the latter road 300 yards north-west of its junction with the Ballyboe Road.

(d) The part of the Glencar Scotch Road which lies inside the Urban District boundary where the said road is a perimeter road.

(e) The part of Glencar School Road which lies inside the Urban District boundary.

(f) The Ballymacool Road for a distance of 100 yards from the Urban District boundary.
