ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF KERRY) REGULATIONS, 1967.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) and as respects article 7 after consultation with the Commissioner of the Garda Síochána and the road authority concerned and as respects article 5, on the application of the said Commissioner hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Kerry) Regulations, 1967.

2 Commencement.

2. These Regulations shall come into operation on the 1st day of November, 1967.

3 Interpretation.

3. In these Regulations save where the context otherwise requires "the Act" means the Road Traffic Act, 1961 ;

"road" means a public road;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

(a) ambulances,

(b) fire brigade vehicles, and

(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation.

7. Articles 5 and 6 of the Road Traffic (Speed Limits) Regulations, 1963 ( S.I. No. 18 of 1963 ) as amended by the Road Traffic (Speed Limits) (Amendment) Regulations, 1965 ( S.I. No. 86 of 1965 ) in so far as they relate to roads in the County of Kerry are hereby revoked.

FIRST SCHEDULE

Roads declared not to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Killarney:—

(a) Ross Road, The Spa Road.

(b) Rock Road and its continuation as the Tralee Road between the Urban District boundary and a point 50 yards northwest of its junction with St. Margaret's Road.

(c) St. Margaret's Road between the Urban District boundary and a point 300 yards north-west of its junction with Rock Road.

(d) Emmett's Road or Lewis Road and its continuation as the Kilcummin Road between the Urban District boundary and a point 70 yards north of its junction with d'Alton's Terrace.

(e) Park Road and its continuation as the Cork Road between the Urban District boundary and a point 500 yards east of the junction of Park Road with Emmett's Road or Lewis Road.

(f) Woodlawn Road between its junction with the Cork Road and a point 30 yards north-east of its junction with the Ballycasheen Road.

(g) Flesk Road between the Urban District boundary and a point 50 yards south of its junction with the Countess Road.

(h) Port Road between the Urban District boundary and a point 20 yards north-west of its junction with New Road.

2. The following roads in the Urban District of Listowel:—

(a) The Ballygrenane Road.

(b) The Greenville Road between the Urban District boundary and a point 450 yards south-west of its junction with the Ballybunion Road.

(c) The Ballybunion Road between the Urban District boundary and a point 150 yards north-west of its junction with the Greenville Road.

(d) The Ballylongford Road for a distance of 1,300 yards from the Urban District boundary.

(e) The Ballygowloge Road between the Urban District boundary and a point 400 yards north-east of its junction with the Tarbert Road.

(f) The Tarbert Road between the Urban District boundary and a point 170 yards east of its junction with the Ballygowloge Road.

(g) The Duagh Road between the Urban District boundary and a point 5 yards north-west of its junction with the Ballygrenane Road.

(h) The Tralee Road between the Urban District boundary and a point 50 yards south-west of its junction with the Duagh Road.

3. The following roads in the Urban District of Tralee:—

(a) The Killierisk Road, Racecourse Road, The Doon Road, The Shanakill Road, the Curragraigue Road, Kearney's Road.

(b) The Dingle Road between the Urban District boundary at Blennerville and a point 50 yards west of its junction with the Ballyard Road.

(c) The road leading from Blennerville to Ballyard.

(d) Basin Road for a distance of 140 yards from its junction with the Dingle Road.

(e) The Kerries Road where the said road is a perimeter Road.

(f) The Abbeydorney Road between the Urban District boundary and a point 50 yards north-east of its junction with the Buntalloon Road.

(g) Buntalloon Road between the Urban District boundary and a point 20 yards north-west of its junction with St. Brendan's Park.

(h) Oakpark Road between the Urban District boundary and a point 160 yards north-east of its junction with Riverside.

(i) The Clash Road between the Urban District boundary and a point 400 yards north-east of its junction with Quill Street.

(j) Quill Street and its continuation as the Killarney Road between the Urban District boundary and a point 300 yards south-east of Ballinorig Cross.

(k) The Ballyard Road between the Urban District boundary and a point 50 yards south-west of its junction with the Dingle Road.

SECOND SCHEDULE

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Abbeydorney:—

(a) The Tralee-Ballybunion road between a point 300 yards south-east of its junction with the Ardfert-Lixnaw road and a point 100 yards north-west of the said junction.

(b) The Ardfert-Lixnaw road between a point 340 yards south-west of its junction with the Tralee-Ballybunion road and a point 250 yards north-east of the said junction.

2. The Following road at Annascaul:—

(a) The Tralee-Dingle road between a point 100 yards south-west of its junction with the Derrygorman Road and a point 20 yards east of the centre line of Annascaul Bridge.

3. The following roads at Ardfert:—

(a) The Square, Cathedral Road.

(b) The Tralee-Ballyheigue road between a point 150 yards south-east of its junction with the Abbeydorney Road and a point 260 yards north-west of its junction with the Fenit Road.

(c) The Causeway Road for a distance of 325 yards from its junction with Cathedral Road.

(d) The Fenit or Chapel Road for a distance of 160 yards from its junction with the Tralee-Ballyheigue road.

(e) The Abbeydorney or Station Road for a distance of 50 yards from its junction with the Tralee-Ballyheigue road.

4. The following roads at Ballybunion:—

(a) Church Road, Georges Street, Georges Terrace, Marian Terrace, South Circular Road, Strand Road, the road connecting Church Road with Strand Road.

(b) The Ballybunion-Listowel road between its junction with the Sandhill Road and a point 220 yards north-west of its junction with Ahafona Cross Roads.

(c) The Sandhill Road for a distance of 880 yards from its junction with the Ballybunion-Listowel road.

(d) The Doon Road between the northern end of the Strand Road and a point 430 yards south of its junction with the Beale Road and the Ballylongford Road.

5. The following roads at Ballyduff:—

(a) The School Road.

(b) The Tralee-Ballybunion road between a point 75 yards south of its junction with the Bishopscourt road and a point 50 yards north-east of its junction with the Ballyhorgan road.

(c) The Bishopscourt Road for a distance of 50 yards from its junction with the Tralee-Ballybunion road.

(d) The Ballyhorgan Road for a distance of 70 yards from its junction with the Tralee-Ballybunion road.

(e) The Strand Road for a distance of 25 yards from its junction with the Tralee-Ballybunion road.

(f) The Meenaghane Road for a distance of 100 yards from its junction with the Tralee-Ballybunion road.

(g) The Heart Hill Road for a distance of 50 yards from its junction with the Tralee-Ballybunion road.

6. The following roads at Ballylongford: —

(a) The Astee-Tarbert (Upper) road between a point 400 yards north-west of its junction with the Listowel Road and a point 320 yards south-east of the said junction.

(b) The Listowel-Tarbert (Lower) road between a point 450 yards south-west of its junction with the Astee-Tarbert (Upper) road and a point 400 yards north-east of the said junction.

7. The following roads at Caherciveen:—

All roads in the area enclosed by a line commencing at a point on the Killorglin Road 250 yards north-east of its westernmost junction with the Reenrusheen Road and drawn thence in straight lines successively to the following points:—

(a) the southern terminal point of Top Street,

(b) a point on the Waterville Road 335 yards south-west of its junction with Old Post Office Street,

(c) the western terminal point of the Breakwater,

(d) a point on Bridge Street 55 yards north-west of its junction with Marconi Terrace,

(e) the easternmost terminal point of Marconi Terrace,

(f) a point on the Reenrusheen Road 170 yards north-east of its junction with the Killorglin Road,

and from the last-mentioned point in a straight line to the commencement point on the Killorglin Road.

8. The following roads at Castleisland:—

All roads in the area enclosed by a line commencing at a point on the Tralee Road 300 yards north-west of its junction with Main Street and drawn thence in straight lines successively to the following points:—

(a) a point on the Pound Road 230 yards north-west of its junction with the Tralee Road.

(b) a point on the Limerick Road 360 yards north-west of its junction with Upper Main Street,

(c) a point on the College Road 400 yards north-east of its junction with the Cordal Road,

(d) a point on the Cordal Road 300 yards north-east of its junction with the College Road,

(e) a point on the Ballydesmond Road 390 yards south-east of its junction with Main Street,

(f) a point on the Killarney Road 530 yards south-west of its junction with Main Street,

and from the last-mentioned point in a straight line to the commencement point on the Tralee Road.

9. The following roads at Castlemaine:—

(a) The Tralee-Cahirciveen road between a point 135 yards north of its junction with the Ballyfinnane Road and a point 70 yards north of the centre line of the bridge over the river Maine.

(b) The Ballyfinnane Road for a distance of 100 yards from its junction with the Tralee-Cahirciveen road.

(c) The Dingle Road for a distance of 200 yards from its junction with the Tralee-Cahirciveen road.

10. The following roads at Dingle:—

All roads in the area enclosed by a line commencing at a point on Strand Road 640 yards south-east of Milltown Cross and drawn thence in straight lines successively to the following points:—

(a) the southernmost terminal point of station Row,

(b) the southernmost terminal point of John Street,

(c) a point on Spa Road 200 yards north-east of its junction with Main Street,

(d) the northernmost terminal point of Chapel Lane,

(e) a point on Goat Street 25 yards south-east of Workhouse Cross,

and from the last-mentioned point in a straight line to the commencement point on Strand Road.

11. The following roads at Glenbeigh:—

(a) the Tralee-Cahirciveen road between a point 190 yards north-east of its junction with the Station Road and a point 125 yards south-west of its junction with the Rossbeigh Road.

(b) The Station Road for a distance of 250 yards from its junction with the Tralee-Cahirciveen road.

(c) the Rossbeigh Road for a distance of 100 yards from its junction with the Tralee-Cahirciveen road.

(d) the Coomasaharn Road for a distance of 150 yards from its junction with the Tralee-Cahirciveen road.

12. The following roads at Kenmare:—

All roads in the area enclosed by a line commencing at a point on the Glengarriff Road 15 yards north of its junction with Pier Road and drawn thence in straight lines successively to the following points:—

(a) a point on the Kilgarvan Road 75 yards north-east of its junction with Main Street,

(b) a point on the Hospital Road 390 yards north-east of its junction with the Square,

(c) a point on the Killarney Road 300 yards north-west of its junction with the Square,

(d) a point on the Tubbrid Road 160 yards south-west of its junction with the Killarney Road,

and from the last-mentioned point in a straight line to the commencement point on the Glengarriff Road.

13. The following roads at Killorglin: —

(a) Market Street, Hill Road, Convent Road,

(b) the Tralee-Cahirciveen road between a point 400 yards north-east of its junction with the Killarney Road and a point 200 yards north-east of its junction with the Cromane Road,

(c) the Killarney Road for a distance of 100 yards from its junction with the Tralee-Cahirciveen road.

(d) the roads serving the County Council housing scheme at Drumavally.

(e) the Glencar Road for a distance of 200 yards from its junction with the Tralee-Cahirciveen road.

(f) Langford Street and its continuation as the Caragh Lake Road for a distance of 400 yards from its junction with the Tralee-Cahirciveen road.

(g) the Sunhill Road for a distance of 580 yards from its junction with the Tralee-Caherciveen road.

(h) the Ballykissane Road between its junction with the Tralee-Caherciveen road and a point 35 yards north of its junction with the Hill Road.

14. The following roads at Milltown:—

(a) Kilcolman Square, Main Street, Mart Lane, Spout Lane, Miles Lane, The Square.

(b) the Tralee-Caherciveen road between a point 50 yards north of its junction with Miles Lane and a point 80 yards north of its junction with the Ballyvirrane Road.

(c) Old Chapel Lane between its junction with Main street and a point 60 yards north-east of its junction with Miles Lane.

(d) Church Street and its continuation as the Killarney Road for a distance of 435 yards from its junction with the Tralee-Caherciveen road.

15. The following roads at Rathmore:—

(a) Ard Mhuire.

(b) the Killarney-Mallow road between a point 490 yards northwest of its junction with the Station Road and a point 75 yards west of its junction with the Hollymount Road.

(c) the Station Road for a distance of 250 yards from its junction with the Killarney-Mallow road.

(d) the Mill or Bog Road for a distance of 50 yards from its junction with the Killarney-Mallow road.

16. The following roads at Sneem:—

(a) Fair Green North, Fair Green South, Quay Road.

(b) the Waterville-Kenmare road between a point 210 yards west of its junction with the Maulagallane Road and a point 250 yards south-east of its junction with Quay Road.

(c) the Maulagallane Road for a distance of 200 yards from its junction with the Waterville-Kenmare road.

(d) the Killarney Road for a distance of 180 yards from its junction with the Waterville-Kenmare road.

(e) the road leading from the Waterville-Kenmare road to the Catholic Church.

(f) the Derreenavurrig Road for a distance of 20 yards from its junction with the Waterville-Kenmare road.

17. The following roads at Tarbert:—

(a) St. Patrick's Terrace,

(b) the Glin-Ballylongford (Upper) road between a point 240 yards south-east of its junction with the Square and a point 90 yards south-west of its junction with the Ballylongford (Lower) road.

(c) the Ballylongford (Lower) Road for a distance of 90 yards from its junction with the Glin-Ballylongford (Upper) Road.

(d) the Tarbert Island Road between its junction with the Glin-Ballylongford (Upper) road and a point 20 yards north-east of its northernmost junction with St. Patrick's Terrace.

(e) the Square, Chapel Street and its continuation as the Listowel Road for a distance of 400 yards from the junction of the Square with the Glin-Ballylongford (Upper) road.

18. The following roads adjacent to the Urban District of Tralee:—

(a) the Ballyvelly Road for a distance of 365 yards from the boundary of the Urban District of Tralee.

(b) the Castlemaine Road for a distance of 50 yards from the boundary of the Urban District of Tralee.

(c) the Clogher Road for a distance of 75 yards from the boundary of the Urban District of Tralee.

19. The following roads at Waterville:—

(a) Spunkane Cottages Road, Sportsfield Road.

(b) the Caherciveen-Kenmare road between a point 170 yards north-west of its junction with the Cliff Road and a point 760 yards south of its junction with the Spunkane Road.

(c) the Cliff Road for a distance of 70 yards from its junction with the Caherciveen-Kenmare road.

(d) the Spunkane Road for a distance of 735 yards from its junction with the Caherciveen-Kenmare road.

(e) the Beenbane Road for a distance of 300 yards from its junction with the Caherciveen-Kenmare road.

THIRD SCHEDULE

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following roads at Barraduff:—

(a) the Killarney-Rathmore road between a point 525 yards west of its junction with the Lisbaba Road and a point 100 yards east of the said junction.

(b) the Lisababa-Glenflesk road between a point 100 yards north of its junction with the Killarney-Rathmore road and a point 100 yards south of the said junction.

2. The following road at Castleisland:—

The Ballydesmond Road between a point 390 yards southeast of its junction with Main Street and a point 935 yards south-east of the said junction.

3. The following roads at Duagh:—

(a) the Cemetery Road.

(b) the Listowel-Abbeyfeale road between a point 275 yards north-west of its junction with the Lisroe Road and a point 525 yards south-east of the said junction.

(c) the Lisroe Road for a distance of 50 yards from its junction with the Listowel-Abbeyfeale Road.

4. The following roads at Farranfore:—

(a) the Tralee-Killarney road between a point 100 yards southeast of its junction with the Castleisland Road and a point 650 yards south-east of the said junction.

(b) the Fieries Road for a distance of 105 yards from its junction with the Tralee-Killarney road.

(c) the Currow Road for a distance of 120 yards from its junction with the Tralee-Killarney road.

5. The following roads in and adjacent to the Urban District of Killarney:—

(a) Rock Road and its continuation- as the Tralee Road between a point 50 yards north-west of its junction with St. Margaret's Road and a point 35 yards north of the point where the boundary of the Urban District of Killarney intersects the western side of the road.

(b) Park Road and its continuation as the Cork Road between a point 500 yards east of the junction of Park Road with Emmett's Road or Lewis Road and a point 100 yards southeast of its junction with the Spa Road.

(c) the Spa Road for a distance of 380 yards from its junction with the Cork Road.

(d) Flesk Road between a point 50 yards south of its junction with the Countess Road and a point 150 yards north of the boundary of the urban District of Killarney.

(e) Ross Road for a distance of 400 yards from its junction with the Flesk Road.

6. The following roads in and adjacent to the Urban District of Listowel:—

The Tarbert Road between a point 170 yards east of its junction with the Ballygowloge Road and a point 150 yards east of the boundary of the Urban District of Listowel.

7. The following roads in and adjacent to the Urban District of Tralee:—

(a) Oakpark Road between a point 160 yards north-east of its junction with Riverside and a point 450 yards north-east of the boundary of the Urban District of Tralee.

(b) Racecourse Road for a distance of 600 yards from its junction with Oakpark Road.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) Regulations, 1963 and 1965, in their application to the County of Kerry, and alter the speed limits applicable to certain roads in this area.

The Regulation exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule for all mechanically propelled vehicles.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
