ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF MONAGHAN) REGULATIONS, 1967.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) and as respects article 7 after consultation with the Commissioner of the Garda Síochána and the road authority concerned and as respects article 5, on the application of the said Commissioner hereby makes the following Regulations :—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Monaghan) Regulations, 1967.

2 Commencement.

2. These Regulations shall come into operation on the 1st day of March, 1967.

3 Interpretation.

3. In these Regulations save where the context otherwise requires

" the Act " means the Road Traffic Act, 1961 ;

" road " means a public road ;

" perimeter road " means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town ;

" special speed limit " and " built-up area speed limit " have the meanings respectively assigned to them in Part IV of the Act ;

" distance " means distance as measured along the centre line of a road.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following :—

(a) ambulances,

(b) fire brigade vehicles, and

(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation.

7. Articles 5 and 6 of the Road Traffic (Speed Limits) Regulations, 1963 ( S.I. No. 18 of 1963 ) as amended by the Road Traffic (Speed Limits) (Amendment) Regulations, 1965 ( S.I. No. 86 of 1965 ) in so far as they relate to roads in the County of Monaghan are hereby revoked.

FIRST SCHEDULE

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the town of Ballybay :—

(a) The Monaghan Road for a distance of 120 yards from the town boundary.

(b) The Clones Road for a distance of 10 yards from the town boundary.

2. The following roads in the Urban District of Carrickmacross :—

(a) The Shercock Road between the Urban District boundary and a point 60 yards north-west of its junction with The Pound.

(b) The Mullanarry Road for a distance of 415 yards from the Urban District boundary.

(c) The Lurgans Road between the Urban District boundary and a point 25 yards south-west of its junction with the Mullanarry Road.

(d) The Ardee Road for a distance of 195 yards from the point where the Urban District boundary intersects the eastern side of the road.

(e) The Dundalk Road between the Urban District boundary and a point 30 yards south-east of its southernmost junction with Pearse Avenue.

(f) The Crossmaglen Road for a distance of 90 yards from the Urban District boundary.

(g) The Castleblayney Road for a distance of 160 yards from the Urban District boundary.

3. The following roads in the Urban District of Castleblayney :—

(a) The Connabury Road, The Bree Road.

(b) The Keady Road for a distance of 280 yards form the Urban District boundary.

(c) The Carrickmacross Road between the Urban District boundary and a point 20 yards north of its junction with the Connabury Road.

(d) The Shercock Road for a distance of 30 yards from the Urban District boundary.

(e) The Monaghan Road for a distance of 140 yards from the Urban District boundary.

4. The following roads in the Urban District of Clones :—

(a) Mullanamoy Lane, Lisnaroe Lane, The Drumard Road, River Lane.

(b) The Cavan Road for a distance of 700 yards from the Urban District boundary.

(c) The Newtownbutler Road between the Urban District boundary and a point 80 yards east of its junction with Lisnaroe Lane.

(d) The Millbrook Road for a distance of 60 yards from the Urban District boundary.

(e) The Rosslea Road for a distance of 250 yards from the Urban District boundary.

(f) The Monaghan Road for a distance of 250 yards from the Urban District boundary.

(g) The Newbliss Road for a distance of 210 yards from the Urban District boundary.

5. The following roads in the Urban District of Monaghan :—

(a) The Tullyhirm Road, The Old Armagh Road.

(b) The Pound Road for a distance of 50 yards from the Urban District boundary.

(c) The Clones Road for a distance of 100 yards from the Urban District boundary.

(d) The Milltown Road between the Urban District boundary and a point 20 yards north-west of its junction with Rope Walk.

(e) The Castleblayney Road between the Urban District boundary and a point 30 yards south-east of its junction with Connolly Park or Pound Hill.

SECOND SCHEDULE

Roads declared to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following roads adjacent to the town of Ballybay :—

(a) The Carrickmacross Road for a distance of 100 yards from the boundary of the town of Ballybay.

(b) The Castleblayney Road for a distance of 220 yards from the boundary of the town of Ballybay.

2. The following roads adjacent to the Urban District of Carrickmacross :—

(a) The Horse Hill Road.

(b) The Magheraboy Road where the said road is a perimeter road.

(c) The Kingscourt Road where the said road is a perimeter road.

3. The following roads adjacent to the Urban District of Monaghan :—

(a) The Coolshannagh Road for a distance of 300 yards from the boundary of the Urban District of Monaghan.

(b) The Emyvale Road for a distance of 30 yards from the point where the boundary of the Urban District of Monaghan intersects the northern side of the road.

4. The following roads at Rockcorry :—

(a) The Monaghan-Cootehill road between a point 225 yards north-east of its junction with the Newbliss Road and a point 115 yards south-west of its junction with the Ballybay Road.

(b) The Newbliss Road for a distance of 100 yards form its junction with the Monaghan-Cootehill road.

(c) The Ballybay Road for a distance of 100 yards from its junction with the Monaghan-Cootehill road.

(d) The Old Road for a distance of 30 yards from its junction with the Monaghan-Cootehill road.

THIRD SCHEDULE

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following roads adjacent to the town of Ballybay :—

(a) O'Duffy Terrace.

(b) The Carrickmacross Road between a point 100 yards southwest of the boundary of the town of Ballybay and a point 150 yards north-west of its junction with the Creeve Road.

2. The following roads in and adjacent to the Urban District of Carrickmacross :—

(a) The Shercock Road between a point 65 yards north-west of the boundary of the Urban District of Carrickmacross and a point 60 yards north-west of its junction with The Pound.

(b) The Castleblaney Road between a point 160 yards south of the boundary of the Urban District of Carrickmacross and a point 230 yards north of the said boundary.

(c) The Ballybay Road for a distance of 150 yards from its junction with the Castleblayney Road.

3. The following road in the Urban District of Castleblayney :—

The Carrickmacross Road between a point 20 yards north of its junction with the Connabury Road and a point 430 yards south of the said junction.

4. The following road in and adjacent to the Urban District of Clones :—

The Newtownbutler Road between a point 80 yards east of its junction with Lisnaroe Lane and a point 25 yards east of its junction with Mullanamoy Lane.

5. The following roads at Emyvale :—

(a) The Dublin-Derry road between a point 300 yards south of its junction with the Glaslough Road and a point 270 yards north of its junction with the Mullan Road.

(b) The Glaslough Road for a distance of 100 yards from its junction with the Dublin-Derry road.

(c) The McCready Mills Road for a distance of 75 yards from its junction with the Dublin-Derry road.

(d) The Mullan Road for a distance of 75 yards from its junction with the Dublin-Derry road.

6. The following roads in and adjacent to the Urban District of Monaghan :—

(a) The Old Armagh Road between its junction with the Castleblayney Road and a point 75 yards north-east of the boundary of the Urban District of Monaghan.

(b) The Castleblayney Road between a point 250 yards northwest of its junction with the Latlorcan Road and a point 30 yards south-east of its junction with Connolly Park or Pound Hill.

7. The following roads at Smithborough :—

(a) The Monaghan-Clones road between a point 200 yards north-east of its junction with the Rosslea Road and a point 200 yards south-west of the said junction.

(b) The Rosslea Road for a distance of 110 yards from its junction with the Monaghan-Clones road.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) Regulations 1963 and 1965, in their application to the County of Monaghan, and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule for all mechanically propelled vehicles.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
