DUBLIN TRAFFIC AND PARKING TEMPORARY RULES, 1966.

I, WILLIAM P. QUINN, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by sections 89 (3) and 90 (7) of the Road Traffic Act, 1961 (No. 24 of 1961), and with the consent of the Minister for Local Government, hereby make the following temporary rules in respect of the area comprising the streets, portions of streets and bridges specified in column (2) of the Schedule to these rules :

1 Short title.

1. These rules may be cited as the Dublin Traffic and Parking Temporary Rules, 1966.

2 Commencement.

2. These rules shall come into operation on the 5th day of December, 1966.

3 Definitions.

3. In these rules—

" the Act " means the Road Traffic Act, 1961 (No. 24 of 1961);

" holiday " means any of the following days :

St. Patrick's Day or, if it falls on a Sunday, the following day,

Easter Monday,

Whit Monday,

the first Monday in August,

Christmas Day or, if it falls on a Sunday, the following Tuesday,

St. Stephen's Day or, if it falls on a Sunday, the following day, or, whenever a day is appointed under the Public Holidays Act, 1924 (No. 56 of 1924), to be a bank holiday instead of any of those days, the day so appointed;

" the Schedule " means the Schedule to these rules;

" scheduled place" means a street, part of a street or bridge specified in column (2) of the Schedule;

" vehicle " does not include a pedal cycle.

4 Prohibition on stopping or parking of vehicles.

4. Subject to rules 6 and 7 in a scheduled place the stopping or the parking for any purpose of a vehicle on a day which is not a Saturday, Sunday or holiday is hereby prohibited during the period specified in column (3) of the Schedule opposite the mention in column (2) thereof of that scheduled place.

5 Qualified prohibition on parking.

5. In a scheduled place the parking of a vehicle is hereby prohibited on the days and at the times specified in column (4) of the Schedule opposite the scheduled place, unless the parking is either for the purpose of permitting a person to enter or leave the vehicle or for the purpose of loading goods into or on to the vehicle or unloading goods from it and the loading or unloading is to or from premises fronting or adjacent to where the vehicle is parked.

6 Non-application of rule 4.

6. Rule 4 shall not apply to an omnibus stopped at a stopping place or stand directed by notice under section 85 of the act or to the stopping of a vehicle when either the stopping is required under the Act or the Road Traffic General Bye-Laws, 1964 ( S.I. No. 294 of 1964 ), or is caused by the exigencies of traffic.

7 Non-application of rule 4.

7. Rule 4 shall not apply to—

(a) a vehicle being used in connection with—

(i) the removal of obstruction to traffic,

(ii) the maintenance, improvement or reconstruction of a street or part thereof, or

(iii) the provision, alteration or repair of a sewer, or of any main, pipe or apparatus for the supply of gas, water or electricity, or of a telegraphic or telephonic line;

(b) a fire engine or ambulance, or a vehicle being used in pursuance of the powers and duties of the Garda Síochána by a member thereof;

(c) a vehicle stopped or parked because the stopping or parking is necessary in order to avoid an accident.

EXPLANATORY NOTE.

Rule 4 prohibits the stopping or parking of a vehicle for any purpose from Mondays to Fridays inclusive (other than holidays) during the hours specified in column (3) of the Schedule, except in the case of an omnibus which is actually engaged in picking up or setting down passengers.

Rule 5 prohibits parking during the days and times specified in column (4) of the Schedule, unless the parking is for letting down or taking up passengers or for loading or unloading goods to or from adjacent premises. It should be noted that the prohibitions imposed by rule 5 (and set out in column (4) of the Schedule) apply outside the times mentioned in column (3), and that during the times mentioned in column (3) stopping or parking is prohibited for any purpose.

These rules operate in lieu of the Dublin Parking Bye-Laws 1962 ( S.I. No. 11 of 1963 ), made under section 90 of the Road Traffic Act, 1961 in so far as those bye-laws apply in the streets or portions of streets specified in column (2) of the Schedule to the rules.
