GREYHOUND TRAINERS' REGULATIONS, 1961.

Bord na gCon, in exercise of the powers conferred on it by section 37 of the Greyhound Industry Act, 1958 (No. 12 of 1958), and also by sub-section (3) of section 5 of the said Act, hereby makes the following regulations, that is to say :—

1 Definitions.

1. In these regulations, the following words and expressions have the meanings hereby assigned to them, that is to say :—

" the Act " means the Greyhound Industry Act, 1958 (No. 12 of 1958) ;

" the Board " means Bord na gCon established under the Act ;

" racing regulations " means the Greyhound Race Track (Racing) Regulations, 1960 ( S.I. No. 64 of 1960 ) ;

" public trainer " means a person holding a licence from the Board authorising him to train and manage greyhounds for reward ;

" private trainer " means a person (other than a permanent full time employee of either a public trainer or a registered owner who manages greyhounds for such trainer or owner) holding a licence from the Board authorising him to train and manage for reward not more than four greyhounds at the same time ;

" the Club " means the Irish Coursing Club ;

" race track " means a greyhound race track licensed by the Board under the Act on which greyhound races are held for reward ;

" race " means a competition on a greyhound race track licensed by the Board in which an object propelled by mechanical means is pursued by the greyhounds engaged in the competition and on the result of which a prize is awarded to the winning and/or placed greyhounds ;

" greyhound " includes dog or bitch entered for a race ;

" control steward " means a steward appointed under permit from the Board to fulfil the duties of an authorised officer under the Act and the duties assigned to him under these regulations ;

" stipendary steward " means a steward appointed by the Board to fulfil the duties of an authorised officer under the Act.

2 Training of greyhounds.

2. It shall not be lawful for any person to train greyhounds for reward save under and in accordance with a licence granted by the Board at its discretion.

3 Classes of licences.

3. There shall be two classes of licences :—

(a) Public trainer's licence, which shall entitle the holder to train and manage greyhounds for reward,

(b) Private trainer's licence, which shall entitle the holder to train and manage for reward not more than four greyhounds at the same time.

4 Applications for licences.

4.—(1) A person who proposes to act either as a public or a private trainer and who is not disqualified from doing so under sub-paragraph (2) of this Article shall make application to the Board for the grant or the renewal (as the case may be) of a licence and the application shall be made in such form or manner as the Board may direct and shall be accompanied by the appropriate fee as prescribed in Article 7 of these Regulations. In the event of an application for the grant or renewal of a licence being refused, the Board shall refund the fee paid on foot of such application.

(2) A person shall be disqualified from acting as a public or a private trainer if an exclusion order made under the Act applies to him.

5 Conditions attaching to licences.

5.—(1) It shall be a condition of any licence granted under these regulations that the holder of such licence shall comply in all respects with the racing regulations for the time being in force and with the directions of the Board.

(2) It shall be a condition of any licence granted under these regulations that the holder of such licence shall complete and forward to the Board such records and documents as the Board may, from time to time, direct.

(3) It shall be a condition of any licence granted under these regulations that the kennels of the licensee be kept in a condition deemed satisfactory by the Board.

(4) Without prejudice to the conditions prescribed in the foregoing sub-paragraphs of this Article, the Board may, on the grant or renewal of a licence under these regulations, attach such other conditions as it thinks fit to the licence.

6 Grant of licences.

6.—(1) The Board may grant or refuse to grant an application for a licence or for the renewal of a licence under these regulations.

(2) The Board may, at any time, suspend for such time as it thinks fit or revoke any licence granted under these regulations.

(3) A licence granted by the Board under these regulations shall not be transferable to any other person and shall be valid until 31st December next following the date of issue unless previously suspended or revoked.

(4) Every person holding a licence to carry out the duties of a public or private trainer shall be deemed to have express notice of these regulations and of the racing regulations for the time being in force and to have agreed to be bound by them.

7 Charges for licences.

7. The charges payable to the Board for the grant and renewal of licences shall be as follows:—

8 Production of licence on demand.

8. The holder of a licence granted under these regulations shall produce such licence for inspection at all reasonable times on the demand of a Control Steward or Stipendary Steward (subject to production by such steward if so required of his appointment).

9 Revocation and surrender of licence.

9. Where a person who is the holder of a licence granted under these regulations is convicted of an offence under the Act, his licence may, at the discretion of the Board, be revoked.

10 Duties of public trainer.

10.—(1) It shall be the duty of a public trainer to keep an up to date record of a type approved by the Board of all greyhounds which he has on his premises and also records showing the date of arrival of each greyhound at such premises and the date of its departure subsequently. The records shall indicate destination of each greyhound leaving the premises.

(2) Copies of such records shall be sent to the Board on the first and third Friday of each month.

(3) The records referred to in sub-paragraph (1) above shall be available for inspection or the taking of extracts by a Control Steward or a Stipendiary Steward and such steward may, at all reasonable times, inspect greyhounds kennelled at the premises of a public trainer.

(4) Where it is established that the number of greyhounds actually on the premises does not correspond with the number as shown in the records referred to in sub-paragraph (1) above, the matter shall be reported to the Board for investigation and the Board may direct that the identity cards of specified greyhounds be impounded pending the result of the investigation.

(5) Where a greyhound arriving at the premises of a public trainer has already been entered for a race, it shall be the duty of the trainer to notify the racing manager at the track or tracks at which such greyhound has been entered that the greyhound has come under his control.

11 Duties of private trainer.

11.—(1) On accepting a greyhound for training, a private trainer shall notify the Board of the fact in writing and such greyhound shall not be raced until permission has been granted by the Board.

(2) A private trainer shall notify the Board of all greyhounds which have left his kennels.

(3) Where it is established that a private trainer has accepted a greyhound for training and has not duly notified the Board of the fact, the matter shall be investigated and the identity card of any greyhound the subject of such investigation shall be impounded pending the result of the investigation.

(4) Where a greyhound arriving at the premises of a private trainer has already been entered for a race, it shall be the duty of the trainer to notify the racing manager at the track or tracks at which such greyhound has been entered that the greyhound has come under his control.

12 Condition of kennels.

12.—(1) The kennels of any person applying for a licence to carry out the duties of a public or private trainer shall be inspected beforehand by a Control Steward or Stipendiary Steward, who shall report on the general lay-out, etc., to the Board.

(2) The kennels of a public or private trainer shall be periodically inspected by a Control Steward or Stipendiary Steward, who shall make a report to the Board. If the Board is satisfied that the kennels are not properly kept, the Board may suspend or revoke the licence of the trainer concerned or take such other disciplinary action as it may deem necessary.

(3) Trainers shall ensure that kennels, muzzles, feeding bowls, etc., are kept in a clean and good condition.

(4) Where possible, trainers shall ensure that stud dogs or bitches in season are not kennelled in the vicinity of the kennels in which greyhounds entered for races are kept.

13 Citation and commencement.

13.—(1) These regulations may be cited as the Greyhound Trainers' Regulations, 1961.

(2) These regulations shall come into operation on the seventeenth day of April, 1961.

EXPLANATORY NOTE.

The effect of these Regulations is that from 17th April, 1961, persons training greyhounds for reward must hold licences from Bord na gCon.
