I, PATRICK SMITH, Minister for Agriculture, in exercise of the powers conferred on me by section 12 of the Dairy Produce Marketing Act, 1961 (No. 1 of 1961), hereby make the following Regulations :

1 Short title.

1. These Regulations may be cited as the Dairy Produce Marketing Act, 1961 (Nominations and Ballots) Regulations, 1961.

2 Definitions.

2. In these Regulations :—

"the Act" means the Dairy Produce Marketing Act, 1961 (No. 1 of 1961) ;

"the Board" means An Bord Bainne established under the Act ;

"nomination day" means a day appointed to be a nomination day for the purposes of the Act under section 7 of the Act.

3 Provisions in relation to Sundays and bank holidays.

3. Whenever a day on which anything is required by these Regulations to be done falls on a Sunday or bank holiday, such thing shall be done on the next preceding day which is neither a Sunday nor a bank holiday.

4 Notice by returning officer.

4. The returning officer shall, in every nomination year not less than one month before the nomination day in that year, insert in a notice in Form No. 1 in the Schedule hereto the particulars of the place and dates for the insertion of which provision is made in the form and shall publish the notice in at least one daily newspaper circulating in the State.

5 Electoral rolls.

5.—(1) The Minister shall, in every nomination year not less than one month before the nomination day in that year, cause to be furnished to the returning officer lists of the names and addresses of the societies that are the registered proprietors of creameries or cream-separating stations :—

(a) situate in the county of Clare, Cork, Kerry, Kilkenny, Laoighis, Limerick, Tipperary, Waterford or Wexford ; and

(b) situate elsewhere in the State.

(2) The Minister shall, in every nomination year during the period commencing on the day on which the lists referred to in paragraph (1) of this Regulation are furnished to the returning officer and ending on the day before the nomination day in that year, cause the returning officer to be informed of any alterations in, additions to or deletions from the lists supplied under the said paragraph and the date of each such alteration, addition or deletion.

(3) Each of the following, that is to say, University College, Cork, the Dairy Disposal Company Limited, the Condensed Milk Company of Ireland (1928), Limited and the Newmarket Dairy Company (1932), Limited (in this Regulation referred to as the proprietors) shall, in every nomination year not less than twenty days before the nomination day in that year deliver to the returning officer the following particulars in respect of each premises, being a creamery or cream-separating station, of which it is the registered proprietor under the Dairy Produce Act, 1924 (No. 58 of 1924) :—

(a) a description of the premises, indicating whether it is a creamery or a cream-separating station and giving its location ;

(b) the registered number of the premises, that is to say, the identification letter and number assigned to the premises in the appropriate register kept under the Dairy Produce Act, 1924 ;

(c) the name and address of each person who supplied milk, or on whose behalf milk was supplied, to the said premises during the month ending immediately before the commencement of the period of one month ending immediately before the nomination day in that year, and shall list the said names and addresses in the numerical order of the numbers referred to in subparagraph (d) of this paragraph ;

(d) the number allotted to each such supplier in the records kept at the premises.

(4) The societies and persons named in the lists furnished in any nomination year to the returning officer in accordance with paragraphs (1), (2) and (3) of this Regulation shall be the societies and persons entitled to propose persons for nomination as members of the Board under section 9 or section 10 of the Act, as may be appropriate, in that year and to vote in a ballot in that year under those provisions.

(5) The returning officer shall, before the commencement of the period of one month ending immediately before the nomination day in any nomination year, send by registered post to each of the proprietors a notification in writing of the requirements of paragraph (3) of this Regulation and the notification shall set out the returning officer's address at which the lists referred to in that paragraph are to be delivered to him.

6 Forms of proposal under sections 9 and 10 of the the Act.

6.—(1) (a) A proposal under subsection (1) of section 9 of the Act of a person for nomination as a member of the Board shall be in Form No. 2 in the Schedule hereto, shall specify the name, address and description of the person proposed, and the name and address of each society making the proposal, shall have affixed thereto and authenticated in such manner, in each case, as its rules require, the seal of each such society and shall specify the date on which each seal is so affixed.

(b) A proposal under subsection (2) of the said section 9 of a person for nomination as a member of the Board shall be in Form No. 3 in the Schedule hereto, shall specify the name, address and description of the person proposed, and the name and address of each society making the proposal, shall have affixed thereto and authenticated in such manner, in each case, as its rules require, the seal of each such society and shall specify the date on which each seal is so affixed.

(c) A proposal under subsection (3) of the said section 9 of a person for nomination as a member of the Board shall be in Form No. 4 in the Schedule hereto, shall specify the name, address and description of the person proposed, and the name and address of each society making the proposal, shall have affixed thereto and authenticated in such manner, in each case, as its rules require, the seal of each such society and shall specify the date on which each seal is so affixed.

(2) A proposal under subsection (1) of section 10 of the Act of a person for nomination as a member of the Board shall be in Form No. 5 in the Schedule hereto, shall specify the name, address and description of the person proposed and shall be signed by the persons making the proposal in the presence of a witness who shall be a clergyman, a Peace Commissioner or a member of the Garda Síochána not below the rank of sergeant (and shall also be signed by the witness) and shall specify the address and description of the witness, the date on which each person making the proposal signs and shall specify the name of the creamery or cream-separating station to which each such person supplies milk and the number of each such person in the records of that creamery or cream-separating station.

7 Form of consent to proposal.

7. For the purposes of subsection (4) of section 9 and subsection (2) of section 10 of the Act, the statement in writing signed by the person proposed for nomination as a member of the Board signifying his consent to a proposal under section 9 or section 10 shall be in Form No. 6 in the Schedule hereto, shall be completed in the manner indicated in that form and shall be signed by the person in the presence of a witness who shall be a clergyman or a Peace Commissioner or a member of the Garda Síochána not below the rank of sergeant, and the witness shall also sign the statement and state thereon his address and occupation, and shall specify the date on which it is signed and the address and description of the witness.

8 Issue of forms of proposal and forms of consent to a proposal.

8. The returning officer shall, when requested to do so by any society or by any person purporting to be entitled to make a proposal under Section 9 or 10of the act supply free of charge to such society or person the appropriate form of proposal and a form of consent to a proposal.

9 Withdrawal of consent to a proposal.

9. Any person who has completed a form of consent to a proposal for nomination as a member of the Board under Section 9 or 10of the act may withdraw his consent to such proposal by delivering a notification in writing to that effect to the returning officer at any time before the nomination day and, where such notification is so delivered, the person shall be deemed on the nomination day not to stand proposed for nomination.

10 Delivery to the returning officer of proposals for nomination.

10.—(a) In every nomination year the returning officer shall attend to receive proposals of persons for nomination under sections 9 and 10 of the the Act at such place as may be specified by the returning officer for that purpose (hereinafter referred to as the place for receiving proposals) between the hours of 10 o'clock in the morning and 1 o'clock in the afternoon and between the hours of 3 o'clock in the afternoon and 5 o'clock in the afternoon, on the day immediately before the nomination day in that year (which periods are hereinafter referred to as the time for receiving proposals for nomination).

(b) A proposal of a person for nomination in any nomination year may be delivered to the returning officer by handing it to him personally at the place for receiving proposals during the time for receiving proposals for nomination or by sending it by prepaid registered post so as to reach him during the period of one month ending immediately before the nomination day in that year or by handing it to him personally during that period.

11 Examination of proposals and notification of results.

11.—(1) On the nomination day in any nomination year it shall be the duty of the returning officer to scrutinise each proposal for nomination and consent to such proposal and to reject as invalid any such proposal or consent which does not comply or purport to comply with the provisions of the Act and these Regulations.

(2) Every question which arises during the scrutiny or in relation to the scrutiny or validity of proposals for nomination or consents to such proposals shall be decided by the returning officer and his decision on any question shall be final and unappealable.

(3) On completion by the returning officer of his scrutiny of proposal forms and forms of consent and his determination of their validity, he shall forthwith send in writing to the Minister and to each person proposed for nomination notification of the names, addresses and occupations of the persons standing proposed, and, in the case of a notification sent to a proposed person, the notification shall relate only to proposals received under the provision of the Act under which such person was proposed.

12 Forms of ballot papers.

12.—(1) A ballot paper in relation to a ballot under section 9 of the Act shall be in Form No. 7 in the Schedule hereto and shall describe the societies among which the ballot is being held in the manner in which they are described in subsection (1), (2) or (3), as the case may be, of that section.

(2) A ballot paper in relation to a ballot under section 10 of the Act shall be in Form No. 9 in the Schedule hereto.

(3) Each ballot paper shall contain a list of the persons standing proposed for nomination on the nomination day in the nomination year in which the ballot is being held, described by their names, addresses and occupations as given in the proposals and arranged in the alphabetical order of their surnames and, in cases of identity of surname, of their other names.

(4) Each ballot paper shall have a printed number on the back thereof.

13 Forms of declaration of identity of voter.

13.—(1) A declaration of identity in relation to a ballot paper in Form No. 7 shall be in Form No. 8 in the Schedule hereto and shall be printed on the back of the ballot paper, and shall contain the name and address of the society completing the ballot paper and shall be sealed with the seal of the society authenticated in such manner as its rules require.

(2) A declaration of identity in relation to a ballot paper in Form No. 9 shall be in Form No. 10 in the Schedule hereto and shall be printed on the back of the ballot paper and shall be signed by the voter in the presence of a witness who shall also sign the declaration and shall be a clergyman, a Peace Commissioner or a member of the Garda Siochána not below the rank of sergeant and shall specify the address of the voter and the name of the creamery or cream-separating station to which he supplies milk and his number in the records of the creamery or cream-separating station, and the address and description of the witness.

14 Day of issue of ballot papers.

14. In every nomination year the day appointed for the issue of ballot papers shall be the tenth day after the nomination day in that nomination year.

15 Issue of ballot papers and declaration of identity.

15.—(1) In every nomination year the returning officer shall, on the day appointed for the issue of ballot papers in that year, send by post to each society or person entitled to vote in the ballot one ballot paper and an envelope addressed to the returning officer.

(2) The returning officer shall keep a record of the number on the ballot paper issued to each society or person entitled to vote in the ballot.

16 Issue of duplicate ballot paper.

16.—(1) If any society to which or person to whom a ballot paper has been issued by the returning officer does not receive the ballot paper within three days of the day on which it was issued and soinforms the returning officer, the returning officer may issue to such society or person another ballot paper bearing the word "DUPLICATE" clearly marked in red ink on its face.

(2) Where a ballot paper marked " DUPLICATE " is returned duly completed to the returning officer, he shall, when the completed ballot papers are being examined by him, take such steps as seem reasonable to him to ascertain whether the original to which the duplicate relates has also been returned to him duly completed and in the latter event the original ballot paper shall be deemed to be invalid.

17 Completion of ballot papers and forms of declaration of identity.

17.—(1) If a person to whom a ballot paper is issued by the returning officer proposes to take part in the ballot to which the ballot paper relates, the person shall complete the ballot paper and declaration of identity in the manner set out thereon, insert them in the envelope addressed to the returning officer, close the envelope, affix thereto the appropriate postage stamp and place the envelope in the post.

(2) If a society to which a ballot paper is issued by the returning officer proposes to take part in the ballot to which the ballot paper relates, a person duly authorised by the society in that behalf shall arrange to have the ballot paper and declaration of identity completed in the manner set out thereon, to have the ballot paper inserted in the envelope addressed to the returning officer, to have the envelope closed to have affixed thereto the appropriate postage stamp and to have the envelope placed in the post.

(3) In every nomination year, the latest time and day for the receipt of completed ballot papers by the returning officer shall be twelve o'clock midday on the tenth day after the day appointed for the issue of ballot papers in that year, and any ballot paper which is received by the returning officer after that time or any ballot paper in respect of which the appropriate declaration of identity has not been duly made shall be invalid.

18 Scrutiny and counting of votes.

18.—(1) In every nomination year the scrutiny of ballot papers and declarations of identity and the counting of votes cast in a ballot shall commence as soon as may be after the latest time in that year for the receipt of completed ballot papers by the returning officer.

(2) A ballot paper, in respect of which a declaration of identity has not been duly made, or in respect of which there has been a contravention of the provisions of the Act or of these Regulations or of any arrangement made by the returning officer, shall be declared by the returning officer to be invalid, and, if so declared, it shall be invalid and shall be rejected by him and the vote marked on it shall be disallowed.

(3) The returning officer shall credit with one vote every candidate against whose name a mark is placed on a valid ballot paper indicating that the elector votes for such candidate.

(4) If before the close of the ballot the returning officer receives notice of the death of a candidate, votes cast for such candidate shall not be counted.

(5) The returning officer shall, subject to the provisions of these Regulations, count the number of votes credited to the candidates as expressed on the ballot papers and shall make a record of the total number of votes credited to each candidate.

19 Notification of the result of a ballot.

19. As soon as may be after the completion of the counting of votes in a ballot the returning officer shall :—

(a) prepare and sign a statement indicating the number of valid votes cast for each candidate and, where the result of the ballot was required to be determined by lot because of an equal number of votes being cast for two or more candidates, the result of such determination, and deliver such statement to the Minister ;

(b) send a copy thereof to each candidate addressed to him at his address as given in the ballot paper ; and

(c) publish in at least one daily newspaper circulating in the State a notice containing the information contained in the statement.

20 Non-disclosure of identity of a voter.

20. The manner of voting or the effect of the vote of a society or a person casting a vote in a ballot shall not be disclosed by the returning officer or an assistant of the returning officer.

21 Decision of questions.

21. Every question which arises at or in relation to a ballot shall be decided by the returning officer and his decision on any question shall be final and unappealable.

22 Destruction of documents.

22. Forms of proposal for nomination and consent to nomination and ballot papers shall be retained by the returning officer for a period of six months immediately following the latest day for the receipt of completed ballot papers by the returning officer in the ballot to which the papers related and upon the expiration of that period shall be destroyed by him.

FORM NO. 1.

3. A proposal must be made on the appropriate proposal form, copies of which may be obtained from the returning officer on request sent to him at the above address by any society or person entitled to make the proposal.

4. A proposal of a person for nomination under subsection (1) of section 9 of the Act must be made on Form No. 2 by any six societies that are registered proprietors of creameries or cream-separating stations situate in the county of Clare, Cork, Kerry, Kilkenny, Laoighis, Limerick, Tipperary, Waterford or Wexford. A society may not propose more than one person under that subsection.

5. A proposal of a person for nomination under subsection (2) of section 9 of the Act must be made on Form No. 3 by any six societies that are registered proprietors of creameries or cream-separating stations situate elsewhere in the State than in the counties specified in the previous paragraph. A society may not propose more than one person under that subsection.

6. A proposal of a person for nomination under subsection (3) of section 9 of the Act must be made on Form No. 4 by any six societies that are the registered proprietors of creameries or cream-separating stations situate anywhere in the State. A society may not propose more than one person under that subsection.

7. A proposal of a person for nomination under section 10 of the Act must be made on Form No. 5 by any twenty persons each of whom supplied milk during the period from the       to the     , both days inclusive, to a creamery or a cream-separating station operated by University College, Cork, the Dairy Disposal Company, Ltd., the Condensed Milk Company of Ireland (1928), Ltd., or the Newmarket Dairy Company (1932). Ltd.

8. A completed proposal form delivered to the returning officer must be accompanied by a statement in writing signed by the person proposed signifying his consent to the proposal. The statement must be made on Form No. 6 copies of which may be obtained from the returning officer on request sent to him at the above address by any society or person entitled to propose a person for nomination. No person may sign more than one statement consenting to a proposal for nomination.

9. A person who has completed a form of consent to a proposal for nomination may withdraw his consent by notifying the returning officer in writing to that effect before the

Section 11 of the Dairy Produce Marketing Act, 1961 , provides that a person shall not sign a statement in writing signifying his consent to a nomination under section 8 of the Act or to a proposal for nomination under any of the provisions of sections 9 or 10 of the Act if he has already signed such a statement in relation to a nomination or proposal for nomination under any of those sections.

The witness to the signature of the person completing this form of consent must be either a clergyman or a Peace Commissioner or a member of the Garda Síochána not below the rank of sergeant.

This form, when completed, together with the proposal form to which it relates, must be delivered to the returning officer in the manner and within the time already announced for the purpose by the returning officer.

1. A society may vote for ONE candidate only.

Instructions for completing the above Form

1. All the information requested on the Form must be given. Failure to complete the Form fully may invalidate the Vote.

2. The voter must sign this form in the presence of a witness who must also sign the form and state thereon his address and description.

3. The witness must be either a clergyman, a Peace Commissioner or member of the Garda Síochána not below the rank of sergeant.

EXPLANATORY NOTE.

These Regulations set out the procedure to be followed and the forms to be used in connection with (a) the proposing of persons for nomination as members of An Bord Bainne and (b) the holding of ballots where more than one person is proposed for nomination under any of the provisions of sections 9 and 10 of the Dairy Produce Marketing Act, 1961 .
