CORK TAXIMETER AREA FARE BYE-LAWS, 1957.

I, DANIEL COSTIGAN, Commissioner of the Garda Siochána, in exercise of the powers conferred on me by sections 139 and 140 of the Road Traffic Act, 1933 (No. 11 of 1933), after consultation with the Lord Mayor, Alderman and Burgesses of Cork, the Council of the County of Cork, and the Town Commissioners of Passage West and with the consent of the Minister for Local Governmen , make the following bye-laws :

1. These Bye-Laws may be cited as the Cork Taximeter Area Fare Bye-laws, 1957.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Bye-laws.

3. These Bye-laws apply to the area declared to be a taximeter area by the City of Cork Taximeter Area Order, 1939 ( S. R. & O. No. 89 of 1939 ), namely—the County Borough of Cork together with such portion of the County of Cork (including the town of Passage West) as lies within a radius of ten miles having its centre at the Principal Post Office at Oliver Plunkett Street in the city of Cork.

4.—(1) The fares which may lawfully be charged for the hire of street service vehicles hired in the area to which these Bye-laws apply shall be in accordance with the Schedule.

(2) This Bye-law shall not affect the validity of a contract for the payment of a lower fare than that hereby provided for.

5. A printed notice in the form of the Schedule to these Bye-laws shall be securely fixed in a glass-covered frame in the rear passenger compartment of every street service vehicle in such a position that it can be read conveniently by the passengers.

6. The Cork Taximeter Area Fare Bye-laws, 1955 ( S.I. No. 133 of 1955 ), are hereby revoked.

SCHEDULE.

FARES FOR THIS VEHICLE FIXED BY THE COMMISSIONER, GARDA SIOCHANA.

This Vehicle is fitted with a TAXIMETER recording the Fare by a combination of TIME and DISTANCE.

(a) Hiring charge

6d.

(b) For any distance not exceeding one statute mile, or time not exceeding fifteen minutes

1s.

(c) For any distance exceeding a statute mile, or time exceeding fifteen minutes :—

(i) For each third of a mile or time not exceeding five minutes

6d.

(ii) For any less distance or time

6d.

NOTES.

(i) The minimum fare is two shillings plus the hiring charge.

(ii) The fare is calculated by time when the vehicle is standing or is travelling at not more than four miles an hour.

(iii) No addition may be made to a fare in respect of a hiring on a Sunday or during the night time.

(iv) The fare is calculated from the time when the hiring begins.

(v) No charge may be made for any return journey when the vehicle is returning empty after the hiring has ended.

EXTRA PAYMENTS.

I.—Additional Passengers.

For each passenger (excluding infants in arms) beyond one. For whole or part of journey

6d.

Note :—One or two children under the age of ten years count as one passenger, three or four as two passengers, and so on.

II.—LUGGAGE.

Luggage carried on the luggage platform or other carrier :

(a) For each bicycle, perambulator or child's mail cart (except when folded)

(b) For each other article or package so carried

3d.

Luggage not carried on the luggage platform or other carrier :—

For each article or package* beyond two

3d.

*(No account is taken of and no charge made for (a) articles of personal wear or use ordinarily carried on the person or in the hand ; (b) articles ordinarily so carried for games or sport ; (c) personal luggage not exceeding 2 feet in length in the form of attache cases, bags, satchels, parcels or other similar packages or articles).

For each basket or other receptacle containing one or more live animals

For each live animal not in a basket or other receptacle

The above extra payments are not payable unless—

(a) the driver records the amount on the taximeter, or

(b) the amount exceeds the amount that can be shown on the taximeter.

WHEREAS in pursuance of section 8 of the Road Traffic Act, 1933 (No. 11 of 1933), the Commissioner of the Garda Siochana has submitted the foregoing bye-laws to the Minister for Local Government:

AND WHEREAS the provisions of subsections (1) and (5) of that section have been complied with in relation to the said bye-laws :

NOW, the Minister for Local Government, in exercise of the powers conferred on him by section 139 of the said Act, hereby consents to the making of the said bye-laws.

Explanatory Note.

These bye-laws fix the fares that may lawfully be charged for the hire of a street service vehicle (i.e.,a street taxi) hired in the Cork Taximeter Area.

The Cork Taximeter Area Fare Bye-Laws, 1955, are revoked and replaced by these bye-laws.
