CORK TRAFFIC (PARKING AND WAITING) (AMENDMENT) BYE-LAWS, 1949

ARRANGEMENT OF BYE-LAWS.

Bye-Law.

1. Short title and collective citation.

2. The principal bye-laws.

3. Interpretation.

4. Amendment of Fifth Schedule to the principal bye-laws.

5. Amendment of Sixth Schedule to the principal bye-laws.

WHEREAS the Commissioner of the Gárda Síochána has, before making the bye-laws hereinafter set forth, consulted the Lord Mayor, Aldermen and Burgesses of Cork in regard thereto :

NOW, I, MICHAEL J. KINNANE, Commissioner of the Gárda Síochána, in exercise of the powers conferred on me by subsection (1) of section 150 of the Road Traffic Act, 1933 (No. 11 of 1933), and of any and every other power me in this behalf enabling, hereby, with the consent of the Minister for Local Government, testified by his official seal affixed hereto, make the following bye-laws in respect of the area consisting of the County Borough of Cork, that is to say :

1 Short title and collective citation.

1.—(1) These bye-laws may be cited as the Cork Traffic (Parking and Waiting) (Amendment) Bye-Laws, 1949.

(2) The principal bye-laws and these bye-laws may be cited together as the Cork Traffic (Parking and Waiting) Bye-Laws, 1939 and 1949.

2 The principal bye-laws.

2.—(1) In these bye-laws the expression " the principal bye-laws " means the Cork Traffic (Parking and Waiting) Bye-Laws, 1939 ( S. R. & O. No. 112 of 1939 ).

(2) These bye-laws shall be construed together with the principal bye-laws.

3 Interpretation.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these bye-laws.

4 Amendment of Fifth Schedule to the principal bye-laws.

4.—(1) The Fifth Schedule to the principal bye-laws is hereby amended by the substitution, for all matter contained at item No. 5, of the matter contained in the First Schedule to these bye-laws.

5 Amendment of Sixth Schedule to the Principal bye-laws.

5.—(1) The Sixth Schedule to the principal bye-laws is hereby amended—

(a) by the substitution for the words: " the portion north of the junction with Washington Street " of the following—" the portion north of No. 9," and

(b) by the addition of the matter contained in the Second Schedule to these bye-laws.

(2) The principal bye-laws, and in particular paragraph (4) of bye-law 12 thereof, shall be construed and be given effect with due regard to the amendments made by this bye-law in the Sixth Schedule to those bye-laws.

FIRST SCHEDULE.

Streets (in which waiting in the Day-time is alternatively Prohibited and Restricted on each side of the Street) added to the Fifth Schedule to the Principal Bye-Laws.

Note : In this Schedule the expression " even date " means a day of which the number in the month is an even number, and the expression " odd-date " means a day of which the number in the month is an odd number.

WHEREAS in pursuance of section 8 of the Road Traffic Act, 1933 , the Commissioner has submitted the foregoing bye-laws to the Minister for Local Government ; AND WHEREAS the provisions of subsections (1) and (5) of the said section 8 have been complied with in relation to the said bye-laws : NOW THEREFORE, the Minister for Local Government in exercise of the powers conferred on him by section 150 of the said Act hereby consents to the making of the said bye-laws.
