ROAD TRANSPORT ACT, 1932, REGULATIONS, 1949.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 4 of the Road Transport Act, 1932 (No. 2 of 1932), and of every and any other power me in this behalf enabling, hereby make the following regulations :—

1.—(1) These Regulations may be cited as the Road Transport Act, 1932 , Regulations, 1949.

(2) These Regulations and the Road Transport ( Road Transport Act, 1932 ) Regulations, 1932 and 1933, may be cited together as the Road Transport Act, 1932 , Regulations, 1932 to 1949.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. For the purpose of charging fares the route of every omnibus service shall be divided by the licensee into stages.

4. Fare-paying passengers over fourteen years of age may be charged for any stage a minimum fare of 2d.

5.—(1) This Regulation applies to an omnibus service whose terminal points are both situated within eight miles from the General Post Office in Dublin.

(2) Subject to Regulation 4, the passenger fare for a stage shall not exceed an amount calculated in accordance with Scale A in the Schedule hereto.

6.—(1) This Regulation applies to an omnibus service to which Regulation 5 does not apply.

(2) Subject to Regulation 4, the passenger fare for a stage shall not exceed an amount calculated as follows :

(a) for a stage wholly within eight miles from the General Post Office in Dublin ; under Scale A in the Schedule hereto ;

(b) for a stage wholly without such distance : under Scale B in the Schedule hereto :

(c) for a stage partly within and partly without such distance : under Scale A in the Schedule hereto in respect of the portion within, and under Scale B in the Schedule hereto in respect of the portion without.

7.—(1) Under Scale A any fraction of a mile shall be reckoned as a mile and any fraction of a penny in the fare shall be reckoned as a penny.

(2) Under Scale B any fraction of a mile shall be reckoned as a mile.

(3) In the calculation of a fare partly under Scale A and partly under Scale B—

(a) any fraction of a mile shall be reckoned as a mile ;

(b) any fraction of a mile falling in Scale B shall, however, be disregarded if the total chargeable distance resulting from the calculation would otherwise exceed the total length of the stage, any fraction of a mile in the total length having been reckoned as a mile.

(4) In the calculation of a fare under Scale B or partly under Scale A and partly under Scale B—

(a) any fraction of a penny in the fare shall be reckoned as a penny if the stage does not exceed ten miles ;

(b) any fraction of threepence in the fare shall be reckoned as threepence if the stage exceeds ten miles but does not exceed thirty miles ;

(c) any fraction of sixpence in the fare shall be reckoned as sixpence if the stage exceeds thirty miles.

8. In respect of any motor-coach service the passenger fares shall not exceed amounts calculated in accordance with Scale C in the Schedule hereto. In the calculation of any fare under this Scale any fraction of a mile shall be reckoned as a mile.

9. Every fare-paying passenger over fourteen years of age travelling by an omnibus service in respect of which an annual passenger licence is in operation shall be entitled to take with him personal luggage not exceeding 28 lb. in weight free of charge. For any weight of passengers' luggage in excess thereof charges may be made not exceeding the amounts shown in Scale D in the Schedule hereto in respect of the various distances.

10.—(1) Where a passenger licence authorises or requires the carriage of merchandise other than that provided for in Regulation 9 the charges for such carriage shall be at rates varying with weights and distances carried and not exceeding the amounts shown in Scale E in the Schedule hereto.

(2) Where such merchandise consists of parcels which are frail or bulky in proportion to weight, charges may be made at rates not exceeding double the amounts shown in Scale E.

11. Where a passenger licence authorises or requires the carriage of bicycles (other than motor-bicycles), perambulators, children's push-cars, or dogs, or any of them, the charges for such carriage shall be at rates varying with weights and distances carried and not exceeding the amounts shown in Scale F in the Schedule hereto.

12. In Scale F in the Schedule hereto the expression " accompanied " means accompanied by a fare-paying passenger travelling on the vehicle on which the merchandise is carried.

13. The following Regulations are hereby revoked :—Part III of the Road Transport Regulations, 1932 ( S. R. & O. No. 26 of 1932 ), and the Third Schedule thereto ; Part III of the Road Transport ( Road Transport Act, 1932 ) Regulations, 1933 ( S. R. & O. No. 135 of 1933 ) ; and the Road Transport ( Road Transport Act, 1932 ) Regulations, 1947 ( S. R. & O. No. 82 of 1947 ).
