STATUTORY RULES AND ORDERS. 1932. No. 26.

THE ROAD TRANSPORT REGULATIONS, 1932.

The Road Transport Regulations, 1932, made by the Minister for Industry and Commerce on the 12th day of April, 1932, pursuant to Section 4 of the Road Transport Act, 1932 .

WHEREAS it is enacted by Section 4 of the Road Transport Act, 1932 , that the Minister for Industry and Commerce may by order make regulations for prescribing anything which in that Act is referred to as prescribed, and also anything which he is by the said Act authorised to prescribe by regulations made under the Act :

NOW, THEREFORE, I, SEÁN F. LEMASS, the Minister for Industry and Commerce, in the exercise of the powers conferred on me by Section 4 of the Road Transport Act, 1932 , and of all other powers me in this behalf enabling do hereby make the following Regulations :

PART I.

PRELIMINARY

1.—These Regulations may be cited for all purposes as the Road Transport Regulations, 1932.

2.—Words and expressions, defined or established by the Road Transport Act, 1932 , shall have the same meanings where they occur in these regulations as in that Act.

In these regulations—

the expression " omnibus service " means a passenger road service taking up and setting down passengers along its route on request or at fixed stopping places without pre-arrangement as between the passengers and the licensee ;

the expression " motor-coach service " means any other passenger road service ;

the word " licensee " means a person holding a passenger licence which is in force (whether by original grant or renewal of such licence) under and in accordance with the Road Transport Act, 1932 .

3.—The Interpretation Act, 1923 , shall apply to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

PART II.

PASSENGER LICENCES.

4.—Every application for the grant, renewal, or transfer of a passenger licence shall be in the appropriate form indicated in the First Schedule hereto, that is to say :—

Application for the transfer of a passenger licence

5.—Every application for the grant, renewal, or transfer of a passenger licence shall be made on a printed form (which may be purchased from the Government Publications Sale Office, 3-4 College Street, Dublin) and a separate form must be used in each case in respect of each passenger road service.

6.—(1) Application for the grant of an annual passenger licence to commence on the *appointed day shall be lodged not later than the 14th May, 1932.

(2) Application for the grant of an annual passenger licence to commence on a date later than the appointed day shall be lodged not later than two calendar months before the proposed date of commencement.

(3) Application for the renewal of an annual passenger licence shall be lodged not later than the 1st day of October next preceding its expiry.

(4) Application for the grant of an occasional passenger licence for one occasion shall be lodged not later than one week before the occasion.

(5) Application for the grant of an occasional passenger licence for two or more occasions shall be lodged not later than one calendar month before the first of such occasions.

(6) Application for the transfer of a passenger licence shall be lodged not later than one calendar month before the proposed date of transfer, or such shorter period as the Minister may, in special circumstances, allow.

7.—The fees payable to the Minister on the grant, renewal, or transfer of a passenger licence shall be those prescribed in the Second Schedule hereto.

Every such fee shall be payable immediately upon the grant, renewal, or transfer of a passenger licence, as the case may be.

Fees shall be payable in the form of a Post Office Money Order payable to the Paymaster-General at the General Post Office, Dublin, and crossed " /& Co./" or in the form of a banker's draft or of a cheque guaranteed by the bank on which it is drawn payable to the credit of the account of the Paymaster-General, or if the amount of the fee does not exceed five shillings by payment in cash or by cheque or by Postal Order.

Every fee collected in respect of passenger licences shall be paid into the Exchequer.

*By Order No. 23, dated 31st March, 1932, the Minister has fixed the 25th July, 1932, as the appointed day.

PART III.

PASSENGER ROAD SERVICE CHARGES.

8.—The route of every omnibus service shall be divided into such stages as the licensee may determine.

Provided that the stages so determined in respect of any omnibus service whose terminal points are both situated within fifteen miles from the General Post Office in Dublin shall include a division of the route into stages for which the maximum fare chargeable shall be 1d., a division of the route into stages for which the maximum fare chargeable shall be 1½d., and a division of the route into stages for which the maximum fare chargeable shall be 2d.

9.—In respect of any omnibus service, whose terminal points are both situated within fifteen miles from the General Post Office in Dublin, the passenger fares for the several stages shall not exceed the amounts calculated at Scale A in the Third Schedule hereto.

10.—In respect of any omnibus service, other than an omnibus service to which the next preceding regulation relates, the passenger fares for the several stages shall not exceed the amounts calculated as follows :

(i) For any stage wholly within fifteen miles from the General Post Office in Dublin : at Scale A in the Third Schedule hereto.

(ii) For any stage partly within and partly without such area : at Scale A in the Third Schedule hereto in respect of the portion within, and at Scale B in the Third Schedule hereto in respect of the portion without ; any fraction of 3d. in the total fare so calculated being reckoned as 3d. in respect of any stage the total length of which exceeds 10 miles but does not exceed 30 miles, and any fraction of 6d. in the total fare so calculated being reckoned as 6d. in respect of any stage the total length of which exceeds 30 miles ;

Provided that if the amount so calculated exceeds that calculated at Scale B for the total length of the stage, the latter shall be the maximum.

(iii) For any stage wholly without such area : at Scale B in the Third Schedule hereto.

11.—In respect of any motor-coach service the passenger fares shall not exceed the amounts calculated at Scale C in the Third Schedule hereto.

12.—Every fare-paying passenger over 14 years of age travelling by an omnibus service, in respect of which an annual passenger licence is in operation, shall be entitled to take with him personal luggage not exceeding 28 lbs. in weight free of charge. For any weight of passengers' luggage in excess thereof charges may be made not exceeding the amounts shown in Scale D in the Third Schedule hereto.

13.—Where a passenger licence authorises or requires the carriage of merchandise other than that provided for in the next succeedingregulation the charges for such carriage shall not exceed the amounts shown in Scale E in the Third Schedule hereto.

Provided that for parcels, frail or bulky in proportion to weight, charges may be made not exceeding double the amounts shown in Scale E.

14.—Where a passenger licence authorises or requires the carriage of bicycles (other than motor-bicycles), perambulators, children's push-cars, and dogs, or any of them, the charges for such carriage shall not exceed the amounts shown in Scale F in the Third Schedule hereto.

PART IV.

ACCOUNTS AND RETURNS.

15.—(1) Every licensee shall keep such full and accurate records as will enable him to prepare the Statement of Accounts and the Financial and Statistical Returns (including Record of Traffic) and the Monthly Statistical Return and half-yearly Statistical Return of Staff Employed referred to in the next succeeding paragraphs in respect of his entire passenger road transport business.

(2) Every licensee shall within two months after the 31st December in each year furnish to the Minister a Statement of Accounts, duly audited and certified, and the Financial and Statistical Returns (including Record of Traffic) in the respective forms prescribed in Parts I. and II. of the Fourth Schedule hereto in respect of the year ended on that date or, where a passenger road transport business was commenced after the 1st January of the year to which the Accounts and Returns relate, in respect of the period dating from the commencement of such business and ending on 31st December of that year.

(3) Every licensee shall within seven days after the termination of each calendar month furnish to the Minister a Statistical Return in respect of that calendar month in the form prescribed in Part III of the Fourth Schedule hereto.

(4) Every licensee shall, within seven days after the last pay-day of the month of February and the month of August respectively, furnish to the Minister a Statistical Return of Staff Employed during the last pay week of each of these months respectively in the form prescribed in Part IV of the Fourth Schedule hereto.

16. Where the passenger road transport business, to which the Accounts and Returns required by regulation 15 (2) relate, is carried on as part of a larger undertaking, the preparation of the Accounts and Returns prescribed in the Fourth Schedule hereto shall include allocations, as between the passenger road transport business and the remainder of the said undertaking, of receipts and expenditure (including capital expenditure) and other items common to both on as fair and equitable a basis as possible.

17.—Where the passenger road transport business, to which the Accounts and Returns furnished under regulation 15 (2) relate, is carried on as part of a larger undertaking, the licensee shall furnish to the Minister at the same time :

(i) a brief statement of the character of the said undertaking other than passenger road transport carried on by him ;

(ii) a statement showing the allocations made in accordance with regulation 16 and the basis on which they have been made;

(iii) all such other information as the Minister may from time to time require as to the compilation of the Accounts and Returns relating to passenger road transport or the relation thereof to the licensee's business as a whole.

Provided, however, that no part of the information disclosed under this Regulation and not otherwise disclosed shall appear directly in any publication made under the authority of sub-section (3) of Section 22 of the Road Transport Act, 1932 .

INSTRUCTIONS FOR THE COMPILATION OF THE MONTHLY RETURN.

(1). The Return Should be made in respect of each Calendar month and should be furnished not later than the 7th day of the month following that to which the return refers. In case no services were run during the month the word " Nil " should be inserted and the form returned not later than the day specified above.

(2). In columns A particulars of each route operated should be shown, and in columns B, C, D and E separate particulars should be furnished in respect of each route as specified in columns A. If services are run between the same terminal points by different routes, particulars should be furnished for each of such routes.

COLUMN B—

In the case of a direct trip between two terminal points, a " single " journey means a journey in one direction only and a trip out and in should be counted as two " single " journeys. A " round " trip should be counted as two " single " journeys.

COLUMN C—

Passengers paying return or circular faxes should be counted as making two " single passenger journeys." As regards Season Ticket Holders, the number of " single passenger journeys " made during the month should be estimated as accurately as possible.

COLUMN D—

By " vehicle miles " is meant the distance run by vehicle ( or vehicles ) while engaged on passenger road services on the route operated. Distance run from or to garage or depot or otherwise while not actually so engaged on passenger services is not to be included.

COLUMNS E—

Gross Receipts :—In the receipts from " Passenger Fares " should be included all fares received in respect of passengers, whether adults or children, carried by a passenger road service whether under an annual or an occasional passenger licence. In " Other Receipts " should be included all amounts received in respect of the conveyance of passengers' luggage, merchandise, bicycles, perambulators, children's push cars, dogs and mails.

INSTRUCTIONS FOR THE COMPILATION OF THE RETURN OF STAFF EMPLOYED.

(1.) The Return should be made in respect of each of the pay-bill weeks ending the last Saturday or nearest pay-day of February and the last Saturday or nearest pay-day in August in each year, and should be furnished not later than seven days after the period to which the Return relates.

(2.) Particulars relating to proprietors not working in the Passenger Road Transport Business are not to be entered in the return. As regards proprietors working in the Business and not drawing fixed salary or wage, only the number need be stated. Amounts of money drawn by such proprietors should be excluded. If a proprietor working in the Business is drawing fixed salary or wage he should be counted under the appropriate description according to the class of work performed and his salary or wage included in the return as in the case of other employees.

(3.) The " Total amount payable for normal full-time attendance during week " should be the total amount which would have been paid during the particular week if the employees worked the normal time required by the terms of their engagement. Overtime and Meal, Lodging and other allowances, should be excluded. Salary should be calculated on the basis of 1-52nd of the annual salary.

(4.) The " Total amount actually paid during week " should include all extra payments made for Overtime and Meal, Lodging or other allowances, after all deductions for absences, etc., have been made. The full earnings before deductions for Unemployment or National Health Insurance for work performed in connection with the Passenger Road Transport Business should be stated.

(5.) Meal, Lodging and other allowances.—Payments for overtime or special duty should not be included in this column.

(6.) Staff employed in the Passenger Road Transport Business only and not in any other Business connected with the Proprietor or Firm.—Particulars should be included of all staff, whether permanent or casual, paid salaries or wages for three or more days in the particular week. Particulars of staff whose earnings were less than the equivalent of three days' pay should be excluded.

(7.) Staff employed partly in the Passenger Road Transport Business and partly in other Business connected with the Proprietor or Firm.—An estimate should be made on the following basis of the particulars to be included in the Return, e.g., 3 employees each paid £4 per week (of 6 days) who are each engaged for only 2 of the 6 days in connection with the Passenger Road Transport Business should be regarded for the purposes of the return as 1 employee engaged fully in such Passenger Road Transport Business for 1 week and paid at the rate of £q. per week. If the estimate, however, amounts to less than three full days' employment in the particular week it should be excluded.

Notes respecting Part I. (a) of Fourth Schedule :

(1) Where a passenger road transport business was commenced after 1st January of the year to which this return relates, the information required is for so much of the year as the business was in existence.

(2) Proportion or whole as the case may be of the salaries of the Superintendent or other Officers (if any) under whose supervision the maintenance of the buildings is carried out to be included under the head of Superintendence.

Wages of the Licensee's employees (if any), i.e., tradesmen and labourers engaged on the maintenance of buildings and materials used thereon to be charged to maintenance.

Where work is carried out by a Contractor, the total cost to be included opposite the maintenance item.

(3) Salaries of works managers, superintendents, overseers, foremen, etc., solely engaged in supervising construction and maintenance of motor vehicles to be charged to superintendence. In the case of officials whose time is divided between this and other work, only the relevant proportion to be charged under superintendence. Wages of mechanics, tradesmen and labourers engaged on repairs or renewals of vehicles, with materials used, to be charged to the respective relevant items shown under this head.

In the case of renewals of vehicles or chassis on hire purchase system the instalments of Principal accrued during the year should be charged under the head of Vehicles (complete) or Chassis (complete) as the case may be.

Vehicles or chassis which represent additions to stock and not renewals of existing stock should be dealt with in Capital account and not under this head.

(4) Salaries of traffic manager and superintendents, to be included under the head of superintendence. Wages, including allowances, of traffic inspectors, foremen, drivers, ticket inspectors, conductors, etc., to be shown under the head of Wages.

(5) Telephone rent, messengers' and office cleaners' wages, stationery, fire, lighting, etc., to be charged to Office Expenses.
