S.I. No. 402/1939 - Control of Imports (Quotas Nos. 1 To 32) (Amendment) Order, 1939.

STATUTORY RULES AND ORDERS. 1939. No. 402.

CONTROL OF IMPORTS (QUOTAS Nos. 1 TO 32) (AMENDMENT) ORDER, 1939.

WHEREAS it is enacted by Section 11 of the Control of Imports Act, 1934 (No. 12 of 1934), as adapted in consequence of the enactment of the Constitution, that the Government may at any time by order amend any quota order previously made under that Act :

AND WHEREAS it is enacted by Section 2 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), as adapted in consequence of the enactment of the Constitution, that the Government may, in and by a quota order, exempt from the prohibition effected by such order goods imported for a specified purpose or in specified circumstances or in a specified manner or in limited quantities and attach to any such exemption a condition requiring the Revenue Commissioners to be satisfied of specified matters before the exemption takes effect :

AND WHEREAS it is enacted by Section 3 of the said Control of Imports (Amendment) Act, 1937 , as so adapted, that the Government may amend, under the said Section 11 of the Control of Imports Act, 1934 , any quota order made before the passing of the said Control of Imports (Amendment) Act, 1937 , by inserting in such quota order any provision which could lawfully have been inserted therein if that Act had been in force when such quota order was made and may declare that such amendment shall have effect as from the date of such quota order :

AND WHEREAS the several quota orders mentioned in the second column of the First Schedule to this Order were made under the said Control of Imports Act, 1934 , before the passing of the said Control of Imports (Amendment) Act, 1937 :

NOW, the Government, in exercise of the powers conferred on them by the joint operation of Section 11 of the Control of Imports Act, 1934 (No. 12 of 1934), as adapted in consequence of the enactment of the Constitution, and sections 2 and 3 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), as similarly adapted, and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Control of Imports (Quotas Nos. 1 to 32) (Amendment) Order, 1939.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. Every quota order mentioned in the second column of the First Schedule to this Order is hereby amended by the insertion in such quota order, by way of exemption from the prohibition of importation effected by such order, of such of the several exemptions set out in the second column of the Second Schedule to this Order as are mentioned (by reference number and short title) in the fourth column of the said First Schedule opposite the mention of such quota order in the second column of the said First Schedule.

4. Every amendment made by this Order in a quota order shall have effect as from the date of such quota order.

5. The particulars stated in the third column of the First Schedule to this Order are inserted in that Schedule solely to facilitate identification of the quota orders mentioned in the second column of the said Schedule, and accordingly nothing contained in the said third column shall affect or control the construction or operation of this Order or, in particular, of the said second column.

6. The short titles set out in the third column of the Second Schedule to this Order are inserted in that Schedule solely to facilitate references to the exemptions in the second column of the said Schedule to which such short titles are respectively attached, and neither the statement of any such short title in the said third column nor the use thereof in the fourth column of the First Schedule to this Order shall affect the construction or limit the operation of the exemption to which such short title is attached, save that, if there should be, in the said fourth column, a discrepancy between the reference number and the short title of an exemption, regard shall be had to such short title only and such reference number shall be ignored.
