STATUTORY RULES AND ORDERS. 1934. No. 264.

CONTROL OF IMPORTS (QUOTA No. 6) ORDER, 1934.

WHEREAS it is enacted by section 3 of the Control of Imports Act, 1934 , (No. 12 of 1934), that the Executive Council may at any time by order (in that Act called a quota order) prohibit, subject to the provisions of the said Act, the importation into Saorstát Eireann on or after a specified day (in that Act referred to as the commencement of such order) not prior to the date of such order of any particular description or descriptions of goods and that the Executive Council shall, in and by every quota order, appoint the day (not more than six weeks after the commencement of such order) on which the first quota period under such quota order shall commence :

NOW, the Executive Council, in exercise of the powers conferred on them by section 3 of the Control of Imports Act, 1934 , (No. 12 of 1934), and of every and any other power them in this behalf enabling, do hereby order as follows :

1. This Order may be cited for all purposes as the Control of Imports (Quota No. 6) Order, 1934.

2. The Interpretation Act, 1923 , (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order the expression " the Act " means the Control of Imports Act, 1934 , (No. 12 of 1934).

4. Subject to the exceptions and qualifications mentioned in the next following paragraph of this Order, the importation into Saorstát Eireann on or after the 13th day of October, 1934, of any of the articles mentioned in Part I of the Schedule hereto is hereby prohibited, but such prohibition shall not extend or apply to any of the articles mentioned in Part II of the said Schedule.

5. The prohibition effected by the next preceding paragraph of this Order shall not extend or apply to—

(a) any article which is imported under and in accordance with a licence in that behalf issued under the Act, or

(b) any article to which this Order is precluded by sub-section (4) of section 3 of the Act from applying.

6. The 19th day of November, 1934, is hereby appointed to be the day on which the first quota period under this Order shall commence.

SCHEDULE.

PART I.

ARTICLES THE IMPORTATION OF WHICH IS PROHIBITED BY THIS ORDER.

1. All articles of personal clothing or wearing apparel (whether completely or partially manufactured) made wholly or mainly of woven tissue which, in the opinion of the Revenue Commissioners, has, for the purpose of proofing, been coated with rubber or rubber solution on one or both sides.

2. All articles which are component parts (made wholly or mainly of such woven tissue as aforesaid) of any articles of personal clothing or wearing apparel.

3. All articles of personal clothing or wearing apparel (whether completely or partially manufactured) made wholly or mainly from a composite cloth containing any woven tissue which or any part of which, in the opinion of the Revenue Commissioners, has, for the purpose of proofing, been subjected to a process involving the use of rubber or rubber solution.

4. All articles which are component parts (made wholly or mainly from such composite cloth as aforesaid) of any articles of personal clothing or wearing apparel.

PART II.

ARTICLES EXCEPTED FROM THE PROHIBITION OF IMPORTATION EFFECTED BY THIS ORDER.

1. Boots, shoes, goloshes, sandals, clogs, or other external footwear, and component parts of any such footwear.

2. Articles of a surgical or medical character intended to be worn because of or as a preventive against or remedy for any physical ailment or defect.

3. Any component part of personal clothing or wearing apparel which, in the opinion of the Revenue Commissioners, is of the nature of a crest, badge, or motif.

4. Any article which, in the opinion of the Revenue Commissioners, is designed, constructed, and intended for use by persons in the course of their employment as a protection against injury or disease.
