S.I. No. 235/2026 - Protection of Employees (Employers’ Insolvency) (Amendment) Act 2026 (Commencement) (No. 2) Order 2026

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 5th June, 2026.

I, PETER BURKE, Minister for Enterprise, Tourism and Employment, in exercise of the powers conferred on me by section 1 (3) of the Protection of Employees (Employers’ Insolvency) (Amendment) Act 2026 (No. 7 of 2026), hereby order as follows:

1. This Order may be cited as the Protection of Employees (Employers’ Insolvency) (Amendment) Act 2026 (Commencement) (No. 2) Order 2026.

2. In this Order, “Act of 1984” means the Protection of Employees (Employers’ Insolvency) Act 1984 (No. 21 of 1984).

3. The 8th day of June 2026 is appointed as the day on which the following provisions of the Protection of Employees (Employers’ Insolvency) (Amendment) Act 2026 (No. 7 of 2026) shall come into operation:

(a) paragraphs (a) and (b) of section 4;

(b) subparagraph (i) of paragraph (c) of section 4;

(c) subparagraph (ii) of paragraph (c) of section 4 in so far as it relates to the amendment of section 1(3) of the Act of 1984 by the insertion of paragraph (g);

(d) paragraphs (a) and (b) of section 5;

(e) paragraph (c) of section 5 in so far as it relates to the amendment of section 4(1) of the Act of 1984 by the insertion of paragraph (i);

(f) paragraph (d) of section 5 in so far as it relates to the amendment of section 4 of the Act of 1984 by the insertion of subsection (4);

(g) section 6, other than in so far as it relates to the insertion of section 4F in the Act of 1984;

(h) paragraph (a) of section 7, in so far as it relates to the insertion of subsections (1A) and (1C) in section 6(1) of the Act of 1984;

(i) paragraph (b) of section 7;

(j) subparagraph (ii) of paragraph (e) of section 7, in so far as it relates to the insertion of paragraph (ab) in the definition of “the relevant date” in section 6(9) of the Act of 1984;

(k) section 9, in so far as it is not already in operation;

(l) section 10;

(m) section 12.
