I, JIM O’CALLAGHAN, Minister for Justice, in exercise of the powers conferred on me by section 3 of the Irish Nationality and Citizenship Act 1956 (No. 26 of 1956) (as adapted by the Justice and Equality (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 452 of 2020 )), hereby make the following regulations:

1. (1) These Regulations may be cited as the Irish Nationality and Citizenship Act 1956 (Revocation of Certificate of Naturalisation) (Prescribed Forms) Regulations 2025.

(2) These Regulations shall come into operation on 7 April 2025.

2. In these Regulations, “Act of 1956” means the Irish Nationality and Citizenship Act 1956 (No. 26 of 1956).

3. A notice of intention to revoke referred to in section 19(1A) of the Act of 1956 shall be in the form specified in Schedule 1.

4. A request under section 19(1F) of the Act of 1956 that an inquiry be held into the Minister’s decision to revoke a certificate of naturalisation shall be made in the form specified in Schedule 2.

5. Regulation 11 of the Irish Nationality and Citizenship Regulations ( S.I. No. 569 of 2011 ) is revoked.

NOTICE OF INTENTION TO REVOKE

IRISH NATIONALITY AND CITIZENSHIP ACT 1956

NOTICE OF INTENTION TO REVOKE A CERTIFICATE OF NATURALISATION

The Minister for Justice granted to you a Certificate of Naturalisation Number........., dated.................., on foot of your application for naturalisation as an Irish citizen dated...

Under section 19 of the Irish Nationality and Citizenship Act 1956 the Minister may revoke a certificate of naturalisation if satisfied that any of the conditions prescribed in section 19 (1) apply.

The Minister for Justice intends to revoke your certificate of naturalisation, being satisfied that the following statutory condition(s) applies:

[Section 19(1)(a) the issue of the certificate was procured by fraud, misrepresentation whether innocent or fraudulent, or concealment of material facts or circumstances,]*

AND/OR

[Section 19(1)(b) you have, by overt act, shown yourself to have failed in your duty of fidelity to the nation and loyalty to the State,]*

AND/OR

[Section 19(1)(c) not being of Irish descent or associations, you have been ordinarily resident outside the State or, in the case of an application for a certificate of naturalisation granted under section 15A, resident outside the State, or in the case of an application for a certificate of naturalisation granted under section 15A, resident outside the island of Ireland (otherwise than in the public service) for a continuous period of seven years and without reasonable excuse have not during that period registered annually in the prescribed manner your name and a declaration of your intention to retain Irish citizenship with an Irish diplomatic mission or consular office or with the Minister,]*

AND/OR

[Section 19(1)(d) you are also, under the law of a country at war with the State, a citizen of that country,]*

AND/OR

[Section 19(1)(e) you have by any voluntary act, other than marriage or entry into a civil partnership acquired another citizenship.]*

Reasons for the Minister’s intention to revoke: ......

Submissions in reply to this notice:

You have 28 days from the date this notice is given to you to reply in writing. You or your legal representative may make submissions addressing the Minister’s grounds for the intended revocation.

Submissions may be sent:

(i) by registered post to: Revocations, Citizenship Division, Immigration Service Delivery, Department of Justice, Rosanna Road, Tipperary Town E34 N566, Ireland; or

(ii) by email, together with written confirmation of your consent to this notice being served on or given to you in this manner.

Decision

On the expiry of the 28 day period from the date this notice is given to you, the Minister shall decide whether to revoke the certificate and in making that decision, shall have regard to the representations, if any, made by you or on your behalf and the Minister shall give you a notification in writing of his decision.
