S.I. No. 619/2023 - Housing (Sale of Local Authority Houses) (Amendment) Regulations 2023

I, DARRAGH O’BRIEN, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by sections 4 and 30 of the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014), as adapted by the Housing, Planning and Local Government (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 408 of 2020 ), hereby make the following regulations:

Citation:

1. These Regulations may be cited as the Housing (Sale of Local Authority Houses) (Amendment) Regulations 2023

Commencement:

2. These Regulations shall come into operation on 29 January 2024.

Amendment of Housing (Sale of Local Authority Houses) Regulations 2015:

3. The Housing (Sale of Local Authority Houses) Regulations 2015 (S.I. 484 of 2015) are amended:

(a) In Regulation 5, Paragraph (1), by substituting “ten years” for “one year”

(b) In Regulation 6, by substituting “€11,000” for “€15,000”

Revocation of Housing (Sale of Local Authority Houses) (Amendment) Regulations 2021:

4. The Housing (Sale of Local Authority Houses) (Amendment) Regulations 2021 (S.I. 776 of 2021) are hereby revoked.

EXPLANATORY NOTE

These Regulations revoke the Housing (Sale of Local Authority Houses) (Amendment) Regulations 2021 (S.I. 776 of 2021) and amend the Housing (Sale of Local Authority Houses) Regulations 2015 (S.I. 484 of 2015) to:

1. Provide that the minimum income criteria is reduced to €11,000, and

2. Change the requirement for the duration of receipt of social housing support from one to ten years.
