S.I. No. 132/2023 - Commercial Vehicle Roadworthiness (Roadside Enforcement) (Amendment) Regulations 2023

I, EAMON RYAN, Minister for Transport, in exercise of the powers conferred on me by section 32 of the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 (No. 16 of 2012) (as adapted by the Transport, Tourism and Sport (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 351 of 2020 )) and for the purpose of giving further effect to Articles 4, 10 and 16(2) of Directive 2014/47/EU of the European Parliament and of the Council of 3 April 20141 , as amended by Commission Delegated Directive (EU) 2021/1716 of 29 June 20212 , hereby make the following regulations:

1. (1) These Regulations may be cited as the Commercial Vehicle Roadworthiness (Roadside Enforcement) (Amendment) Regulations 2023.

(2) These Regulations shall come into operation on 3 April 2023.

2. The Commercial Vehicle Roadworthiness (Roadside Enforcement) Regulations 2018 ( S.I. No. 161 of 2018 ) are amended by the substitution of the Schedule to these Regulations for Schedule 1 to those Regulations.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations replace Schedule 1 of the Commercial Vehicle Roadworthiness (Roadside Enforcement) Regulations 2018 ( S.I. No. 161 of 2018 ), with a revised Schedule to provide for minor changes and to ensure alignment with both the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 and Directive 2014/47/EU.
