S.I. No. 622/2022 - European Union (Safety of Toys) (Amendment) (No. 4) Regulations 2022

I, LEO VARADKAR, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2009/48/EC of the European Parliament and of the Council of 18 June 20091 as amended by Commission Directive 2021/903/EU of 3 June 20212 , hereby make the following regulations:

1. (1) These Regulations may be cited as the European Union (Safety of Toys) (Amendment) (No. 4) Regulations 2022.

(2) These Regulations shall come into operation on 5 December 2022.

2. Schedule 1 to the European Union (Safety of Toys) Regulations 2011 ( S.I. No. 14 of 2011 ) is amended –

(a) by the substitution of the following paragraph for paragraph 17:

“17. Commission Directive 2020/2089/EU of 11 December 20203 ,”, and

(b) by the insertion of the following paragraph after paragraph 17:

“18. Commission Directive 2021/903/EU of 3 June 20212 .”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

These Regulations give effect to Commission Directive 2021/903/EU of 3 June 2021 which amends Appendix C to Annex II to Directive 2009/48/EC of the European Parliament and of the Council on the safety of toys, as regards aniline. This Directive sets a limit for aniline in textile toy material and leather toy material of 30 mg/kg after reductive cleavage and a limit for aniline in finger paints of 10 mg/kg as free aniline and 30 mg/kg after reductive cleavage.
