S.I. No. 369/2022 - European Union (Crowdfunding) (Amendment) Regulations 2022

I, PASCHAL DONOHOE, Minister for Finance, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Regulation (EU) 2020/1503 of the European Parliament and Council of 7 October 20201 , hereby make the following regulations:

Citation

1. These Regulations may be cited as the European Union (Crowdfunding) (Amendment) Regulations 2022.

Definition

2. In these Regulations, “Principal Regulations” means the European Union (Crowdfunding) Regulations 2021 ( S.I. No. 702 of 2021 ).

Amendment of Regulation 5 of Principal Regulations

3. (1) Regulation 5 of the Principal Regulations is amended –

(a) by the substitution of the following paragraph for paragraph (2):

“(2) For the purposes of these Regulations and the Crowdfunding Regulation and subject to paragraph (3), responsibility for the information given in a key investment information sheet, attaches to the project owner.”, and

(b) in paragraphs (3) and (4), by the substitution of “project owner” for “responsible persons” in each place it occurs.

Amendment of Regulation 6 of Principal Regulations

4. Regulation 6 of the Principal Regulations is amended –

(a) in paragraph (1), by the substitution of “project owner” for “persons specified in paragraph (2)”, and

(b) by the deletion of paragraph (2).
