I, LEO VARADKAR, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2009/48/EC of the European Parliament and of the Council of 18 June 20091 as amended by Commission Directive 2020/2088/EU of 11 December 20202 and Commission Directive 2020/2089/EU of 11 December 20203 hereby make the following regulations: | ||
1. (1) These regulations may be cited as the European Union (Safety of Toys) (Amendment) (No. 2) Regulations 2022. | ||
(2) These Regulations shall come into operation on the 8th day of July 2022. | ||
2. Schedule 1 to the European Union (Safety of Toys) Regulations 2011 ( S.I. No. 14 of 2011 ) is amended by the insertion of the following paragraphs after paragraph 14: | ||
16. Commission Directive 2020/2088/EU of 11 December 20202 , | ||
17. Commission Directive 2020/2089/EU of 11 December 2020.3 ”. | ||

EXPLANATORY NOTE | ||

These Regulations give effect to two Commission Directives (Directive 2020/2088/EU of 11 December 2020 and Directive 2020/2088/EU of 11 December 2020). Directive 2020/2088/EU of 11 December 2020 amends the allergenic fragrances listed in the table in the third paragraph of point 11 of Part III of Annex II to Directive 2009/48/EC of the European Parliament and of the Council on the safety of toys, to include the allergenic fragrances listed in Table 1 3-1 of the Scientific Committee on Consumer Safety (SCCS) opinion of 26 and 27 June 2012 and amend entry 4 of the table in respect of citronellol. Commission Directive 2020/2089/EU of 11 December 2020 amends the table on the first paragraph of point 11 of Part III of Annex II to Directive 2009/48/EC of the European Parliament and of the Council on the safety of toys, to include the prohibition of the use of atranol, chloroatranol and methyl heptine carbonate in toys. | ||
