S.I. No. 776/2021 - Housing (Sale of Local Authority Houses) (Amendment) Regulations 2021

I, DARRAGH O’BRIEN, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by sections 4 and 30 of the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014), as adapted by the Housing, Planning and Local Government (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 408 of 2020 ), hereby make the following regulations:

Citation and commencement

1. (1) These Regulations may be cited as the Housing (Sale of Local Authority Houses) (Amendment) Regulations 2021.

(2) These Regulations shall come into operation on the 1st day of February 2022.

Amendment of Housing (Sale of Local Authority Houses) Regulations

2. The Housing (Sale of Local Authority Houses) Regulations 2015 (S.I. 484 of 2015) are amended -

(a) in Regulation 5 –

(i) in paragraph (1), by substituting “ten years” for “one year”, and

(ii) in paragraph (2), by substituting “both of the tenants” for “one of the tenants”, and

(b) in Regulation 6, by substituting “€12,500” for “€15,000”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations amend the Housing (Sale of Local Authority Houses) Regulations 2015 (S.I. 484 of 2015) to –

• provide that the minimum income criteria is reduced to €12,500, and

• change the requirement for the duration of receipt of social housing support from 1 to 10 years and, in the case of joint applicants, apply the same requirement to the second applicant.
